An airline company has asked the Regional Trial Court (RTC) to set aside a ruling of a Municipal Trial Court in Cities (MTCC) judge, who allegedly rendered judgment without informing the company about the court proceedings.
Cebu Air Inc. which operates as Cebu Pacific Air, in their petition for certiorari filed before the RTC on Thursday, asked the court to declare as null and void the decision of MTCC Judge Francisco Seville of branch 7 who ordered the company to pay a private individual US$ 281 with legal interest of 12 percent per annum.
Cebu Air also asked the court to issue a temporary restraining order or a writ of preliminary injunction to stop Seville from implementing the writ of execution, which might have the firm's computer unit auctioned.
Also named as respondent in the petition is Lemuel Cres Veloso, the private complainant who demanded financial claims from Cebu Air.
?The motion for execution against the petitioner (Cebu Air), sent to the Mactan Cebu International Airport (MCIA), came as a surprise to the petitioner as it was not aware of any pending case or complaint filed by the private respondent,? Cebu Air said in their petition.
