Judge's order in Dacer case is right—lawyer

MANILA, Philippines?(UPDATE) The counsel for three of the accused in the Dacer-Corbito double murder case said Friday he would no longer ask a Manila Regional Trial Court to inhibit herself from the case.

Lawyer Dante David said he realized Manila RTC Judge Myra Garcia-Fernandez was right in allowing former police Senior Superintendent Cesar Mancao to take the witness stand on July 27 to determine if he could become a state witness.

David said he reviewed the transcript of stenographic notes and ?I realized that she was right when she allowed Mancao (to testify) for purposes of determining whether he deserves to be discharged or not.?

?The fact that he was allowed to testify does not mean he will be removed from the case. The court still has to evaluate,? said David, who is the counsel for Senior Police Officer 4 Marino Soberano, SPO3 Mauro Torres and SPO3 Jose Escalante.

The three are among the 21 persons indicted for the double murder of publicist Salvador ?Bubby? Dacer and his driver Emmanuel Corbito in 2000.

David and Alex Avisado, the counsel and spokesman for Senator Panfilo Lacson, had assailed Garcia-Fernandez?s order. Avisado said the judged ?displayed manifest partiality, bias and hostility? in handling the case.
