MANILA, Philippines--Expect House Resolution 1109, the controversial measure calling for the convening of Congress into a constituent assembly to amend the Constitution to just lie there after its swift passage in the House of Representative late Tuesday.
"Wala na kaming gagawin dyan (We will not do anything to it). It will be a Monalisa resolution," Majority Leader Arthur Defensor told INQUIRER.net in a phone interview on Wednesday.
Defensor, chairman of the rules committee, said the chamber has achieved its goal of adopting the resolution in the hope that it would be a "trigger mechanism" that would prod a group or an individual to bring it to the Supreme Court so the tribunal could resolve the issue of whether the two Houses of Congress should vote jointly or separately.
But he said he was not certain if the adoption was enough to trigger a justiciable controversy for the Supreme Court or if there was need for the actual convening of the assembly.
After Tuesday night's viva voce voting, which was done amid objectionw by the minority bloc, Cavite Representative Elpidio Barzaga Jr., one of the sponsors of the resolution, said the next step would be decided by the rules committee and by the House leadership.
Defensor said Speaker Prospero Nograles would likely consult with House leaders and constitution experts on how to go about the resolution.
But should they decide to convene, the Iloilo congressman stood firm that the Senate should have equal participation.
"For the constituent assembly to be validly convened, majority of the House members and majority of the Senators must attend," Defensor said.
And to do this, the Senate must also pass a similar resolution, he added.
Asked to comment on the view of Cebu City Representative Pablo Garcia that the resolution was a "mere invitation" for both the chambers to convene, Defensor said he doubted if the House leadership would even send the adopted measure to the Senate.
"I doubt if we can invite the Senate just because we have passed this resolution. It can't be an invitation, this is not a party," he said.
