Lozada files kidnap, murder raps vs Razon, Atienza, et al

MANILA, Philippines ? (UPDATE 2) Rodolfo Lozada Jr., the key witness in the national broadband network controversy, has filed a case of kidnapping and attempted murder at the Department of Justice against police and government officials allegedly responsible for his abduction last February.

Lozada has named PNP Chief Avelino Razon, Environment Secretary Lito Atienza, Angel Atutubo, assistant general manager of the Ninoy Aquino International Airport; Police Security and Protection Office (PSPO) Chief Romeo Hilomen, Colonel Paul Mascariñas, PSPO assistant director; retired Senior Police Officer 4 Rodolfo Valeroso; and several John Does.

Lawyers for Lozada said that the basis of the kidnapping and attempted murder complaint was his alleged abduction allegedly by government operatives last February 5 at the Ninoy Aquino International Airport upon his arrival from Hong Kong.

"He was taken without the knowledge of his family who are also waiting at the airport," Theodore Te said.

The lawyers said that they also included attempted murder based on what they saw on the NAIA CCTV camera where Atutubo made a gesture of slitting his throat while escorting Lozada.

Lozada went to the office of assistant chief state prosecutor Anthony Fadullon to subscribe his complaint.

From the DoJ, Lozada will go to the 17th Division of the Court of Appeals to file a petition to summon former socio-economic planning secretary Romulo Neri to be a hostile witness to confirm the threat against his life, said Lozada?s lawyer Neri Colmenares.

Colmenares said Neri could not cite executive privilege since it would be the appellate court that would summon him and we could cross examine him.
