AIM, 2 suspended profs claim victory in NLRC ruling

MANILA, Philippines—The Asian Institute of Management and two of its professors continue to be locked in a battle of wills as the National Labor Relations Commission (NLRC) issued another decision on the validity of the latter’s suspension.

The NLRC upheld the suspension of AIM professors Victor Limlingan and Emmanuel Leyco, but reduced the duration from one year to six months.

Both parties claimed victory for their side in the NLRC ruling.

AIM management hailed the decision, saying that the NLRC had upheld the suspension of the professors for their “dysfunctional behavior” and “serious misconduct.”

AIM vice president Jake Montenegro said that while the professors were admitted back to work when their suspension expired, they were expected “to discharge their duties in accordance with the academic standards of the institution and behave in a manner compatible with their status and profession.”

But Leyco said the AIM management could not claim full victory in the recent NLRC decision as it only partially modified an earlier NLRC ruling by cutting in half the 12-month back pay awarded to them by labor arbiter Napoleon Menese.

Leyco said the recent ruling also affirmed the earlier decision which found the AIM guilty of violating their rights to due process.

He said the decision even strengthened their claim by ordering AIM to pay a nominal amount of P50,000 to each professor for the violation. Margaux C. Ortiz
