No CA resolution yet on Junjun Binay TRO petition

MANILA, Philippines — Currently holed up in his office, Makati Mayor Jejomar Erwin “Junjun” Binay will have to wait until next week to hear from the court.
The Court of Appeals closed Friday afternoon still without any resolution on the suspended Mayor’s petition for an immediate temporary restraining order (TRO), a plea in his certiorari petition filed Thursday against the Office of the Ombudsman.
The Ombudsman had ordered him suspended for six months pending investigation of his involvement in the alleged overpriced construction of the Makati City Hall Building II.
Binay immediately sought relief from the appellate court in a bid to stop his temporary removal from City Hall, naming Ombudsman Conchita Carpio Morales and the Department of Interior and Local Government as respondents.
A check with the appellate court’s information office showed that Binay’s case was raffled off Friday to the Sixth Division, chaired by Associate Justice Jose Reyes Jr. The two members of the division are Associate Justices Eduardo Peralta Jr. and Francisco Acosta.
In his petition, Binay accused Morales of committing grave abuse of discretion in ordering his preventive suspension.
