Lawyers to Senate: Luy ‘pork’ list already with the NBI

MANILA, Philippines—Instead of submitting his digital records to the Senate, whistle-blower Benhur Luy deemed it “more prudent” to refer the matter to the National Bureau of Investigation (NBI).

Luy’s digital records purportedly containing lawmakers’ transactions with suspected “pork” scam mastermind Janet Lim-Napoles was the subject of a subpoena issued by the Senate blue ribbon committee.

But in a letter dated May 20, 2014 to Senator Teofisto Guingona III, chairman of the committee, Luy’s lawyers informed the body that their client had already submitted the records to the Cybercrime Division of the NBI.

“In as much as our client wishes to submit to your committee the requested soft copy of digital records relating or relevant to the PDAF (Priority Development Assistance Funds)scam, we deemed it more prudent to refer your directive to the Cybercrime Division of the National Bureau of Investigation,” lawyers Raymund Joseph Ian Mendoza and Patrick Maglinao said in the letter.

“Please be informed that earlier, our client personally submitted to the said Division, the hard drive containing digital records and information in relation to the PDAF transactions of Janet Lim-Napoles for forensic examination and authentication to preserve the integrity and confidentiality of its contents.”

“For this purpose, we have informed the said Division of the subpoena duces tecum that your committee issued to our client for their appropriate action…” the letter added.
