MANILA, Philippines — Retired major General Carlos P. Garcia was arrested Friday morning at his residence, Defense Secretary Voltaire Gazmin said.

In the media forum organized by the Philippine Information Agency, Gazmin said that the arrest was made in accordance with the verdict issued by the military court on charges of violation of Articles of War 96 and 97.

In the same forum, Armed Forces Chief General Eduardo Oban said that at 7 a.m., personnel from the miitary’s provost martial, the judge advocate general, military police and Philippine National Police were deployed to Garcia’s residence in Quezon City.

At 8:30 a.m., the arrest was made and at 9 a.m., the retired general was turned over to the Armed Forces’ Intelligence Service, Camp Aguinaldo.

Garcia, formerly a comptroller of the Armed Forces, was found guilty for charges of misappropriation of military funds.

Garcia had a plea bargain with the Ombudsman for his graft charges.

Gazmin added that though the military court issued the verdict in 2006, the president Gloria Macapagal-Arroyo did not sign the confirmation letter but which President Benigno Aquino III signed.

Oban added that Garcia did not resist arrest.

Article of War 96 is “conduct unbecoming of an officer and gentleman for failing to disclose/declare all his existing assets in 2002 and 2003 and for holding the status of an immigrant or permanent resident of the United States thereby causing dishonor to the military profession.”

Article of War 97, meanwhile is “conduct prejudicial to good order and military discipline for making untruthful statements under oath his true assets in his 2002 and 2003.”

The sentence, which was confirmed by President Benigno Aquino III last September 9, dictates that Garcia be confined for a period of two years in a penitentiary.

In a separate interview, Judge Advocate General Brigadier General Gilberto Roa said that Garcia would be moved to the Nation Bilibid Prison since the military court ruled that sentences longer than one year will be served in the NBP. He added that Garcia would be moved after some more proceedings like medical check-up. However, Roa did not give an exact date.

When asked if there were other military officials facing similar charges as Garcia, Roa said: “There are some.”

      Si Gen. dela Paz yung sinasabi mo. Ang mrs at anak ni Gen. Carlos Garcia ang nahulihan ng limpaklimpak na US$$ cash na nakamaleta papalabas na ng U.S. Airport. Kung hindi pa nahuli dun eh di pasarap-sarap sana ngayon si Gen. Caloy & family. Isang tanong papano naklusot sa PH airport yung mga maleta puno ng US$$? Ok, ok you don’t have to attempt an answer.

    I feel it’s too early to celebrate, one because it’s a military court arrest. So, question for civilian law and military law experts there, what is the implication if you’ve been arrested through the order of military court? Ano parusa? Lahat nung alam ko na-court martial ni-house arrest lang sa military camp eh. Mababawi ba yung pera pag military court nag-arrest sayo?

    That’s a true military man, he does’t try to evade the arrest..and he is willing to be tried even before. so if he is guilty then be it. he had to suffer the consequence. Let justice prevail, what is in the law be applied to whoever had committed a crime. It should be within the bounds of the law. Not firing squad or any inhumane  form. we are civilized and had a democratic form of governance.

    The end to the impunity. It is definitely not the limit to the penalties that we are owed, but it’s a good first step. At the very least, he will not be able to skip out on his trials for plunder.It would make sense to have more arrests made on the basis of the Articles of War.We wouldn’t want Garcia and his ilk to feel too comfortable while the plunder trials are progressing now … do we?By the way … will there be a trial for plunder? Have they overturned the plea bargain arrangement?

    There had been numerous times this arrested AFP former major general could have redeemed himself by simply telling the Filipino every thing there is to know about his caper.  He thought whoever provided him protection during the years he was in the military brig will permanently shield him from harm.  Boy, was he so wrong.  Perhaps doing the Angelo Reyes act will be the last resort but I doubt if he is man enough to do it.  I hope he aged to the fullest in jail.

    I was formerly with the AFP and now retired, maraming buwaya talaga, hinde ka maka piok, dahil under instruction ka. Ang estimate ko being assigned with Finance, a single general or Commodore, puede siyang lumamon ng Php20,000,000.00 quarterly (more or less) thru conversion.

What the author did not tell you is Carlos Garcia was already under arrest through the order of the civilian court, why have him under arrest under military court?

    Is it not possible for the new Ombudsman to go to Sandiganbayan and take back the plea bargain agreement?

      Kailangang pag-aralan ng mabuti yung kaso kung valido pa ang arrest against Mr. Garcia. At the time of the verdict which Mrs. Arroyo did not sign, Garcia was still in the military service or thereabouts. The government of President Aquino had to carefully review if todays arrest will NOT have a technicality. Thank you.

Garcia also faced graft charges in the same court.In February 2009, Garcia’s sons, Juan Pablo and Ian Carl were indicted in the US with one count of conspiracy to commit bulk cash smuggling, failing to file a report of monetary instruments, and making false statements to a US government agency. The sons were placed in US custody until proven innocent. On the same month, Garcia was found guilty of misdeclaring his assets and liabilities in 2000. He was acquitted from two other perjury cases.On June 2009, the Sandiganbayan acquitted Garcia of the last perjury case, saying there was no proof that the retired general lied in his 1997 SALN. However, the retired general is still facing plunder and forfeiture cases in the Sandiganbayan and is still being detained in Camp Crame.

    2 years lang for stealing millions of pesoses. parang magbabaksyon lang siya sa bilangguan. hindi na nakakapagtaka na lalong dumadami ang magnanakaw sa gobyerno dahil halos hindi sila maparusahan sa mga kabuktutang pinaggagawa. bakit ‘di bulukin sa bilangguan yan para hindi na pamarisan.

    Instead of putting the fake general and utterly corrupt Garcia behind bars, why not put him in the same cage with the father of all crocs Lolong?  It would be quite a spectacle to see who gets to prey on whom.  May Lolong prevail.

    hindi ba pag Plunder case e lifetime na pagkabilanggo? asan na ang mag asawang Ligot? magasawang Arroyo? isama na sila sa kulungan ni Lolong. Gutomin ninyo muna si Lolong bago sila isama.

    Very good move for PNoy; 
     All quiet are the General’s mistahs.

    The General did plunder man.   His kids were caught by US immigration  trying to sneak in hundred of thousands of dollars. 

    Consider adding more years for him in the calabooze!

    magandang development pero sana this case should not end to garcia being nailed as the lone culprit of the crime. the AFP as an organization ay hindi po si garcia and pinakamataas para malayang makagawa ng malawakang pagnanakaw. hindi po siguro nag-prosper ang mga pagnanakaw na iyon w/out due knowledge and approval from his higher-ups…in fairness to garcia the government should act and dig dipper who are those persons involved para magdusa din at maparusahan…

    yung mga anak ni garcia, asan n? dpat isama mga yun s kulungan, nsa bank account n nila yung mga milyones ng tatay nila
    bago matapos ang 2 years, sampahan n ulit ng iba pang kaso, ng mabulok n mga lintek n yan
    asan n pla yung mag asawang ligot?
