Santiago got P15-M Senate funds in 2012 — COA

MANILA, Philippines – No less than the office of Senator Miriam Defensor-Santiago has received more than P15 million additional maintenance and other operating expenses (MOOEs)  in  2012, the head of the Commission on Audits said.

In her letter to Santiago dated January 21, 2013,  COA  chairperson  Maria Gracia Pulido Tan noted that the office of the senator got a total P15, 492,292 last year.

“It appears from records submitted by the Senate accounting office tour resident Auditor that additional MOOEs were given to members of the Senate at different dates during 2012,” Tan said in her letter.

“For your office, we note that a total of P15,492,292 was given on various dates in March, May, June, July, August, September, October, November and December as additional MOOE,”  she added.

Tan’s letter was in response to Santiago’s letter to her last January 10, 2013 regarding the use of savings of the Senate and the power of the Senate President to realign the budget as additional MOOEs of the senators.

Santiago has been questioning the authority of Senate  President Juan Ponce-Enrile to use the Senate’s savings when he gave all senators a total P2.22 million each in November and December 2012 except her and three others—Senate Minority Leader Alan Peter Cayetano, Senators Pia Cayetano and Antonio Trillanes IV.

Santiago and the three senators only received  P600,000 each in November but not the P1.6 million given in December last year.

But in her letter, Tan pointed out that under Section 53 of the General Appropriations Act (GAA), “the President of the Philippines, the Senate President, the Speaker of the House of Representatives, the Chief Justice of the Supreme Court, the Heads of the Constitutional  Commissions enjoying fiscal autonomy, and the Ombudsman are…authorized to augment any item in (the GAA) from savings in other items of their respective appropriations.”

“Congress has also authorized other government agencies to augment these,” she added.

The GAA, Tan said, did not specify when the Senate President can or should exercise his authority to augment any item in the GAA from any savings in other items of the appropriations.

Tan said Section 54 of the GAA also defines “savings as “portions or balance of any appropriation (in the GAA) free from any obligation or encumbrance which are still available after the completion or final discontinuance or abandonment of the work, activity or purpose for which the appropriation is authorized; from appropriation balances arising from unpaid compensation and related costs pertaining to vacant positions and leaves of absence without pay; and from appropriation balances realized from the implementation of measures resulting in improved systems and efficiencies and thus enabled agencies to meet and deliver the required or planned targets programs and services approved at a lesser cost.”

“In our humble opinion as the government’s auditors, the above provision is clear and readily understandable,” Tan said.

It was beyond COA’s mandate, she said, to “enumerate what savings are valid for purposes of augmentation.”

“Our mandate is to examine and audit if the augmentation in fact sourced from savings as so defined by Congress,” she said.

Since the law itself allows augmentation from savings and realignment of appropriations, Tan said the COA does not inquire  anymore if the savings are deliberately being generated for such purposes.

“To reiterate, our duty is to examine and validate if the augmentation is in fact sourced from savings, and whether requirements of law have been complied with in effecting such augmentation ad/or realignment,” she said.

As to Santiago’s query whether an additional MOOEs can be treated by the senator as additional pork barrel spent, not on office expenses but on alleged charitable donations or public works projects, the  COA made it clear that MOOE was not a discretionary fund.

Section 63 of the GAA, she said, provides expressly that appropriations for MOOE shall be “available for release and obligation for the purpose specified and under the same special provisions applicable thereto, for a period of extending to one fiscal year after the end of the year in which such items were appropriated.

In respect to the Senate, Tan said , the MOOE should be used for travelling, communication, repairs and maintenance, transportation and delivery, supplies and materials, rents, utility, training and scholarship, extraordinary and miscellaneous, taxes insurance premium and other fees, professional services, printing and binding, advertising, representation, subscription, and membership dues and contributions.

“As above mentioned, the additional MOOE must be used for the purposes as listed in the GAA. Use as pork barrel is not among them,” the COA head added.

    So, what are “extraordinary and miscellaneous” expenses? Ang lawak nun ah…

    Kaya pala parang naglalaro lang ‘tong mga senador natin at kadalasan ay kinakantyawan pa ang senate president kung may “regalo” ba kapag year-end.

    This MOOE is perhaps the easiest way for them to enjoy Xmas without spending their own money. Malinaw na case of having your cake and eating it too.

    Lol, this coming from arguably the single most CORRUPT government institution we have: the COA. Readers, don’t forget that this is the government agency that allows all other government agencies to be corrupt. This is where they “look the other way.” Local Government Units like to call it the “Commission OR Audit”. Get it? This is where the ball gets dropped. This is the one agency where every single government official’s stolen loot can be traced, because this is the one agency that’s supposed to keep track of government transactions. No anomalies could occur easily if the COA was even half competent. Which I do not believe they are.

      I don’t think so. COA’s job is only as an auditing firm assigned by the government to look onto the records on how appropriations of a government agency/official is spent, adhering to the guidelines vested on the office’s by-laws. So if anomalies are traced, the person who is accusing can bring it up to court, to which COA’s report is used as an evidence, as they have that discretion.

        Yes, but they don’t always give the proper report on an agency’s/official’s records. Not if you pat them enough. They are in the perfect position to help cover-up any anomalies, and I wouldn’t be surprised if they have done so in collusion with corrupt politicians in the past.

    Parang hindi yata tama ang sagot ni tan ng coa sa sulat ni brenda. Merong pa saring, tuloy ang dating ay may kinikilingan. Dili kaya ang manunulat ang may kinakabigan. Hindi naman sa kinukunsinti natin ang brenda, pero ang coa dapat ay patas. Ang mga ganitong balita ay dapat manggagaling kay enirile o lacson, hindi kay tan. Kung ganyan ang siste, sino pa ang maglakas loob na magsasalita sa balang araw. Hindi na nga nakatupad sa mandato sa kanya itong si tan, sumasali pa sa away politico. Kung dapat kasuhan si brenda, edi lalong magaling pero ang tayming ni tan, mali. Tama, kung nasuhulan ni tandang enrile.

    Parang pinalalabas ni tan…tumahimik ka brenda dahil malaki naman ang nagastos mo.

    COA chairperson Maria Gracia Pulido Tan that is not the point what they’ve been arguing.

    Its the SENATE FUND SURPLUS that JPE gave to the 16 Senators as a Christmas Bonus and this is not his personal money.

    The question: Why was this FUND SURPLUS given as a Christmas Bonus when this could have been used to help people who was hit by calamities like one example: Typhoon : Pablo

    This is Peoples Money ( Taxpayer Money ) should have been given to them first and formost to the people who was hit by the calamities and who need help and assistance.

    Justification is not needed for this is PLAIN AND SIMPLE BRIBERY.

    And why the MOOE liquidation report has no receipt as a supporting paper so therefore its a temptation for anomalies and corruption they can just create a bogus report and pocket the money – Isn’t it ?

    That is the reason Madame Miriam Defensor Santiago will do a hearing they can amend the provision and that will help to alleviate corruption anomalies in the government which is still rampant to this day.

      because that would be breaking the law.

      if the senate as a whole wants to give their funds to the people, it must act as one body and declare it so. If the house is divided, it must be split according to that specified under law of which is administered by the Senate president, and given to individual end user recipient senators.  From there, it can be donated by the recipient senator, following strict guidelines. (Di pwede mag donate sa isang tao, o kapamilya, o ka partido, etc)

      It would also be illegal transfer such funds directly to the DSWD or other government agencies, liban ibalik ang funds sa treasury.

        when the senate prepare their budget they do not have provisions for donations in case of calamity because this is not part of their function.

        many also castigate the COA chairperson, but she cited provisions in the GAA which gave enrile the power to re-align anytime during the fiscal year (sec. 53), definition of savings (sec. 54), she also showed what expenses are valid and legal under Maintenance and Other Operating Expense and that it is not a discretionary fund.

      Pocket the money it is! The Gen Appropriation act that the senators themselves crafted and approved made sure that the lawmakers will be able to re-align savings for their offices “other” expenses. Giving this so called “savings” to say, Pablo victims, as you infer will fall to “other” expenses category but actually doing so is at each lawmakers’ discretion. Travel abroad for family members and maintenance cost of their fleet of vehicles also falls under “other” expenses. Do I need to say more which are the priorities of our “honorable” lawmakers?

    The query of Santiago is deeply rooted to the impropriety of Enrile to use the savings of the Senate for cash gifts which Tan as the COA chief should reply directly pertinent to the Accounting and Auditing Rules and Procedures but to my dismay, he just narrated the normal usage of the MOOE which isn’t what Santiago is asking. Tan’s reply evokes into my mind a notion that he’s afraid of Enrile so to play safe, he replied in ambiguity. The likes of Tan must be removed from the government for they are parasitic employees just waiting for the end of the month to draw their salaries what the Pnoy gov’t needs as workers are action people, ever ready to defend the gov’t fund from unscrupulous officials and employees. The route of the matuwid na daan is uprightness and Enrile by his apparent majestic reign at the senate is a wayward wind.

      i believe the COA chairperson said that this power was authorized under sec. 53 of the GAA,

      what we should be asking the COA chairperson is how they can check if this MOOE is being judiciously used by the senators and congressmen considering that they only need a certification and the disbursement voucher to liquidate it.

    Para magkaalaman na, bakit di irelease ng COA ang total amount na natanggap ng bawat senador para sa taong 2012. Baka suma-total e parepareho lang ang natanggap ng lahat ng senador. Bottom line is, malalaman na ng sambayanang pilipino kung magkano ang pinagpapartihan ng mga buwayang senador. 15M+ para sa “other” operating expenses? Ibig sabihin hindi defined kung saan talaga gagamitin kaya pwede ring ibulsa. Kaya pala naman pati sweldo ng katulong sa bahay senado nagbabayad.

    If the senators used it to augment the money for personnal used, you are in no way able to tell cause you dont ask for a receipt. Legal plunder at it finest. Senators maybe having a big fun about this auditing by COA. It is a joke.

      COA Chair omitted some other more important information:

      Senate MOOE budget for 2012 = 1,500,000,000 pesos (1.5 billion pesos)*

      Miriam Santiago received = 15,000,000 pesos (15 million pesos)

      What happened to the remaining 1,485,000,000 pesos?

      If MOOE total budget for 2012 is 1.5 billion pesos, each of the 23 senators should get 65 million pesos if distributed equally.

      Let’s give COA Chair Grace Pulido-Tan the benefit of the doubt. She’s just following orders.

      I would like to give COA Chair Grace Pulido-Tan the benefit of the doubt. But it’s also likely that she’s under some pressure from higher ups to release the MOOE piecemeal. Anyway, COA will be hard pressed to release the MOOE of the other 22 senators due to public pressure now that some of the toothpaste is out of the tube.

      I’d like to give COA Chair Grace Pulido-Tan the benefit of the doubt. She’s probably under presure from higher ups to release the MOOE figure of Senator Santiago first, just to damage the lady senator’s credibility. P15 million is very very big and stands out since the other MOOEs of other senators were not disclosed. I also have to say that Senator Santiago had an axe to grind.

    This is becoming scandalous! What did Sen. Miriam (or any other senator) need more than P1 Million a month in ADDITIONAL (just for emphasis) MOOE for? Remember, this is on top of the regular MOOE monthly budget. What are these maintenance and operating expenses? Are these properly documented? This is where we need the FOI badly.

        The point is Enrile and the other senators who received the money are all guilty of theft of taxpayers’ money that should have reverted to the national treasury. All savings must be returned to the general fund.

    Wala na bang pwedeng gawin ng mga senator na ito kundi pag-awayan ang perang hindi naman sa kanila? Nagka-onsehan kaya may pumiyok. Sayang na sayang talaga ang mga pork barrel na hindi naman natin malaman kung saan napunta o saan ginamit. Kawawang mga Filipino sa pagkakaroon ng mga corrupt at magnanakaw na mga pulitiko at taong gobyerno.

      Unfortunately, it is legal and a very bad practice. Giving an agency the discretion to realign or distribute excess funds reeks of corruption particularly for a country that has a terrible track record in audit. COA, even with the best auditors have failed to account for a simple allocation from A to B. How much more if B starts distributing/realigning funds to C, D, E, and F? Eh ‘di nga-nga ang COA….LOL.

    COA  chairperson  Maria Gracia Pulido Tan ……….obserba ko po nakikisawsaw ang taong ito sa sigalat ng sa senado. Ang sa akin lang po kung ang isang ahensiya ng gobyerno na mag disclose sa mga pera dapat po lahat hindi lang isang tao. Senate is a chamber a group of elected senators…..COA  chairperson  Maria Gracia Pulido Tan  must disclose all the chamber members at once not only for sen. Miriam….. we knew that as taxpayer they receive millions of pesos each every year but what we don’t know where those millions of pesos from taxpayers go. COA  chairperson  Maria Gracia Pulido Tan …. code of conduct is wrong at this point…. its unfair to sen. miriam.

      COA Chair Grace Pulido-Tan is under a lot of pressure, which is why she omitted some other more important information:

      Senate MOOE budget for 2012 = 1,500,000,000 pesos (1.5 billion pesos)*

      Miriam Santiago received = 15,000,000 pesos (15 million pesos)

      What happened to the remaining 1,485,000,000 pesos?

      If MOOE total budget for 2012 is 1.5 billion pesos, each of the 23 senators should get 65 million pesos if distributed equally.

      Let’s give COA Chair Grace Pulido-Tan the benefit of the doubt. She’s just following orders.

The other generals took home millions in bonuses as head of the Armed Forces. Eurogenerals had millions in dollars to hide. The Arroyos’ pocketed tens of billions maybe more, then add Corona with his “pocket change;” and, these are only a few. That’s hundred of billions of pesos in the pockets of a few. Now, that’s not fair…

    01. But how much did the other senators receive?

    02. How much was total MOOE budget of senate in 2012? — 1,500,000,000,000 (1.5 billion)

    03. Why is COA Grace Pulido-Tan keeping the MOOE of other senators secret?

    04. What happened to the 500 million MOOE (out of the total budget) under JPE’s discretion?

    Tan is being malicious.  Malay nyo naman sa tamang kinapuntahan ang 15million.

    Remember that a landmark law was passed by Miriam last year (RH law)

    In my honest opinion if a Senator is honest and is truly working it reflects on the expenses of his/her office and the output. In terms of bills and measures passed Miriam is #1.  So I guess talagang nag tratrabaho sya.

    Hindi tulad nung dating mamang pulis na halos 1 taon nagtago sa Hongkong.

      I think Senator Santiago should look into why COA is singling her out and not revealing the MOOE of the other senators. I would like to believe that COA Chair Grace Pulido-Tan is not malicious. She may be under pressure from higher ups to single out Miriam and damage her through the disclosure which obviously does not provide the broader context of the 1,500,000,000 pesos (1.5 billion pesos) total of MOOE budget of the senate in 2012.

        the reporter based her article on the COA chairperson’s letter-reply to sen. santiago. therefore, the content thereof is for sen. santiago. i do not profess to know the full content of the senator’s letter to the COA chairperson but it is my understanding that she questioned the timing of the release in November and December of the additional MOOE, among other things.  i do not see the point of COA mentioning that she received additional MOOE totalling 15 M for the year 2012.

        but my point is if there is malice it is done by PDI in the choice of its title and not COA. why did PDI highlight the additional fund received over the answers of COA to the issues raised by sen. santiago?

        Ed, both GMA, ABS-CBN and Rappler reported similarly. It appears that COA Chair Grace Pulido-Tan’s disclosure singles out Miriam Santiago. I would still like to believe Grace but she seems to be under a lot of pressure from her higher ups to follow their orders. Speaking of silencing the whistle blower Miriam Santiago ….

      if i’m not mistaken, senators and congressmen are given additional MOOE when they head or are members of committees since they would be incurring more expense aside from their regular duties.

      so, it should not be an issue if they receive additional MOOE during the year. what i find disturbing in this article is the lack of clarity. why did sen. santiago receive this additonal amount? how much did the other senators receive as additional MOOE? and most importantly HOW did they spend their MOOE?

      if the reporter says that the COA letter did not mention anything about these, why did she not do additional research for purposes of fairness.

      let’s face it, sen. enrile has the power to re-align senate savings.

      what we all want to know is how much did they get and how did they use their MOOE. now we know why our “honorable” senators and congressmen are lukewarm to passing the FOI bill.

     But in her letter, Tan pointed out that under Section 53 of the General
    Appropriations Act (GAA), “the President of the Philippines, the Senate
    President, the Speaker of the House of Representatives, the Chief
    Justice of the Supreme Court, the Heads of the Constitutional 
    Commissions enjoying fiscal autonomy, and the Ombudsman are…authorized
    to augment any item in (the GAA) from savings in other items of their
    respective appropriations.”

    So very clear that the senate president authority to give additional MOOE is provided for in GAA. I guess napalaki lang ang issue. The point is bakit di binigyan ni Enrile ang apat na senador. Yun ang mali niya dahil dapat lahat ay mabigyan. 1.6 M is a big amount and a certification can be issued by the congress on the expenses made without the need of attaching any official receipts. Without receipts pweding ibulsa nang mga senador at kongresista ang pera.

      That’s right. It’s rather curious how COA Chair Grace Pulido-Tan only disclosed Santiago’s MOOE without revealing the MOOE of other senators.

      Considering that the total MOOE senate budget for 2012 is 1.5 billion pesos. If Santiago only got 15 millon pesos, where did the remaining 1.48 billion pesos go to?

      I hope COA is not stonewalling and singling out Santiago.

      Why dont you just admit you are so pro-Enrile.  Santiago got P15 million. So what ? She has an entire staff of legal consultants and legal staff and they work very hard.  She holds the record for the highest number of bills filed year after year and has authored many laws. Plus, she doesnt have a paramour unlike Enrile.  I’ll fight for Santiago. She means what she says.

      Wheres the corruption ? If it was wrong, Enrile’s office wouldnt grant it.  She is author of so many laws and HOLDS THE RECORD FOR THE HIGHEST NUMBER OF BILLS FILED.  Enrile cannot match that ! Not with his mistress being his Chief of STaff. He is only sourgraping because he lost the RH bill debate. Public opinion will forever be against Enrile thats for sure. Santiago didnt kill or torture thousands of peple. Live with that.

    So what if a senator gets P15 million ?! Thats not even one World Bank project.  I dont understand the COA opinion legally. She was sponsor and defender of the RH bill and traveled all over to explain it, have dialogues in campuses, etc. We saw her being  active during the impeachment trial and SHE DIDNT pocket that money.  Her legal consultants are all from the UP College of Law Faculty and key government departments. Whats wrong with that ?!

    Remember bonus is illegal under the law. Realignment of funds is not.
    The question is if there is deliberate non-spending so that it can be
    realigned and given away to favorite senators…..this is fraudulent
    realignment because the intent is to discriminate and to give cash gifts
    for political favors. Lahat ng senators ay tumanggap ng MOOE…ang issue ay ang extra “christmas bonus” na pinamigay ni Sen.     15 million divided by 1.5 billion * 100% = Percent Santiago Got from Total MOOE of Senate.

    In short.

    15M/1.5B = 0.01 * 100 = 1%

    So san napunta yung 99%

    It seems to me that Santiago’s share of the Senate’s total MOOE is rather very small.
