The reported plan to file 16 new charges against suspended Cebu Gov. Gwendolyn Garcia is the ruling party’s tack to “strangle” political rivals in the May elections, the opposition’s United Nationalist Alliance (UNA) said Tuesday.

Blasting the Liberal Party, UNA, a coalition of parties led by deposed President Joseph Estrada and Vice President Jejomar Binay, said the ruling party was using “high-handed” and “repressive tactics” to force Garcia out of the Cebu capitol in an effort to take control of the vote-rich province.

“Why the sudden downpour of cases against Gov. Garcia? We can only assume that a creeping crackdown on the LP’s political rivals is now in full swing,” UNA Secretary General Tobias Tiangco said in a statement.

“The Liberal Party is now plagued with political bullies and has become a despotic, repressive political machine,” he added.

UNA senatorial bet Margarita “Tingting” Cojuangco, President Aquino’s aunt, also criticized Garcia’s suspension, claiming  the filing of other cases against Garcia “is obviously not in line with her nephew’s “Tuwid na Daan” motto.

Suspicious timing

“The timing and motivation in the belated filing of these supposed cases are simply highly suspect,” Cojuangco said.

Malacañang suspended Garcia last December, upholding a recommendation by the late Interior and Local Government Secretary Jesse Robredo that cited Garcia for grave abuse of authority when she usurped part of the budget of the office of the vice governor to hire her chosen consultants.  She restored the budget after the death of Vice Gov. Gregorio Sanchez Jr., her policial rival.

The administration was reported to be preparing other cases against Garcia, who has since holed up in her office at the Cebu provincial capitol, refusing to heed the six-month suspension order.

UNA insisted that the suspension was a form of “harassment” against the popular governor.

Last week, the Court of Appeals heard oral arguments on Garcia’s case but did not issue a temporary restraining order (TRO) on her suspension order.

Garcia’s lawyers had argued that Garcia was not properly served the suspension order because she was not in her office when the order was served and what was served were just photocopies of the order. Garcia’s camp also claimed a TRO was needed “so as not to cause serious and irreparable injury to his client and that of people of Cebu.”

Garcia’s petition noted that the suspension order was issued more than a year after Sanchez complained about the budget issue, and three weeks before the ban on the suspension of public officials would take effect on Jan. 13. Elections are only four months away.

Veloso, said the three-member court would weigh the arguments and issue a resolution on Garcia’s petition shortly.

Vice Gov. Agnes Magpale has been designated as acting Cebu governor.

It is no surprise that the Una people would rather forget the real issue behind the suspension, because of two reasons: One, the would like to ride on the Filipinos penchant to side with the underdog and hope to hoodwink their precious votes. Second, they are clearly playing the ‘old boys club’ game with the suspended governor – after all (again, you are right) “birds of the same feather fly together.” It doesn’t require one a brain of a rocket scientist nor a bottle of “Memory Plus” pills to realize and remember the cases – anomalous and scandalous the persons you mentioned have been tainted with and or mired in. Their cries now may be their feeble attempt to deflect the attention of the electorates from seeing the skeletons they have been zealously guarding, by throwing dirt and or painting black on others’ faces so that their own ghostly appearance may be forgotten. Height of callousness! Certainly as the sun will rise in the east, thes grafters, oppressors, criminals and badings, will have their comeuppance comes election day. The Filipino voters are now generally educated, sensible and smart. Woe to UNA!

       After Ondoy, a friend of my son was a volunteer in Red Cross, they want to distribute the relief goods intended for the typhoon victims but Gordon said no, only after the media arrived that Gordon finally distributed the relief goods…… the UNA group is really something, don’t be fooled by them!

     the next batch of winners in the 2013 election must learn the lesson of the past. play it fair, do not steal and serve the people to avoid getting charges and accusations. UNA, knowing its corrupt nature, tries to evade the issue by making all accountables make filed cases against them as political harrasment. let us not vote the liars, thieves and corrupt families and dynasties. we have so many good personalities who are able to serve us better.

    the UNA lacks moral standing to accuse the administration of political harassment. it should be noted that is was gwen who was found guity for what she did to late vice gov. for no other logical reason but political harassment or vendetta. the time honored principle of he who comes to equity must come with cleaned hands is too relevant to be ignored in this case. instead of blaming the LP, UNA should have faced the music squarely and argue their case on the merits instead of branding the after-effect of gwen’s act as harassment. the peoles of cebu are wisers than what they think. they know how to distinguish the chop from the grain. what they are tring to do is make everything a political question which the reality speeks otherwise. if the situation is reversed, there this no iota of doubt that their stand would not be the same. clearly, they are the one playing politics at the expense of good governance. their minds are clouded with their uncontrollable urge to gain power even to the extend of disturbing peace and order.

It was Gwen herself who defied suspension order and dared the police to get her over her dead body, It was Gwen’s brother who challenge the police chief General Garbo to a fist fight and it was Gwen’s brother Paolo na nanapak ng pulis on duty tapos sasabihin ng taga UNA na bully ang LP. Utot nyo Tionggo nababaliw ka na ba….Kung bully pa ang UNA matagal ng kinaladkad si Gwen palabas sa capitolyo hayan tingnan ninyo mag-iisang buwan na sa capitolyo free board and lodging pa….

    Hindi na lang kasi, sagutin ang mga cases, kaysa kung anu-anong political excuses and gimmicky pa ang pinalalabas.  Magpa-file ba ng ganyang karaming kaso kung walang pinagbabatayan?  Unang-una, ayaw sumunod sa suspension order.  Kung public service talaga ang nais niya, bakit hindi siya umalis sa kinaroroonan niya ngayon, para masilbihan nang mas maayos ang mga mamamayan niya.  Sa isang public servant, mas importante ang mamamayan, kaysa personal interests.   Sa attitude pa lamang na ipinakikita ng suspendido at ng partidong kaniyang kinabibilangan, puro politics pa rin ang mahalaga sa kanila, hindi ang taongbayan.

    The upcoming election will be crucial. If majority of UNA candidates win then the needed reforms will not move forward. It’s already hard now to institute the reforms but it will surely be harder if they all win.

    Andaming dindahilan sa Press kung bakit di sya dapat tanggalin, pagdating sa Supreme Court manner of issuing the suspension order lang ang justification ng lawyer for the request for TRO? May pa-people, people of Cebu ka pa. Kapit tuko lang talag dahil may tinatago.

      Because that’s the best defense an accused can do specially if the case is strong against the accused. If you find difficulty in disproving an allegation, use TECHNICALITY as defense.

    Gawas na diha Gwen uy, mauwaw naman ka!!!

    Last term na pala ni Gov Garcia. With 4 months remaining in her term, bakit pinipilit pa rin niyang kumapit sa kapitolyo instead of concentrating in answering her charges in court. By May, obligadong mag step down na siya so I don’t see her point trying to stay in the capitol for her last 4 months in office. Hindi ba niya kayang ipanalo ang mga candidates ng UNA pag hindi siya ang may hawak ng kaperahan ng kapitolyo?

        Sana nga, at sana hindi sa pondo ng kapitolyo. Pero kung prinsipyo ang inilalaban niya, hindi ba mas lalong tataas ang respeto sa kanya ang mga cebuano kung susunod muna siya sa Rule of Law/Court at pagkatapos saka niya patunayan sa korte na wala siyang kasalanan kesa ilaban niya ang prinsipyo niya sa sarili niyang kaparaanan na salungat sa utos ng korte?

    Yun ang style ng government ngayon.  File a lot of unimportant cases to those against this government. Let them sort out their nuisance case problems until PNoy steps down.  Hopefully, with the number of cases filed, one will stick. But in the mean time, harass them just the same so they would not be as effective (in opposing the administration) as they should be.

    A few questions….
    Why did she leave the NUP last May to join UNA? NUP are considered in coalition with the LP.

    Why is it that her father (Pablo P) and brother (Pablo John) did not follow her into the UNA? They are (I think still are) still there.

    Except for the occasional statement; the both seem to be wiping their hands of her.

    Their move against Gwen will backfire most against Mar Roxas come 2016. Cebuanos will all the more not vote for Roxas as President. It is clear he engineered this political maneuver to knock out Gwen.

    Din’t UNA know that the case of Gwen Garcia arose out of her bullying the late vice guv Greg Sanchez? Gwen is suspended because she bullied not just even Greg but the whole office of the vice governor, taking the budget and used it to her office.  Then she would say that it was approved by the provincial board.  Of course, Greg had not been able even to take his privilege speech as presiding officer because he was outnumbered. The provincial board was subservient to the gov.

    Gwen refused to receive the suspension order, that she even instructed her secretary not to receive, so the order was just posted on the door of her office. Is this not proof of service? Then this is their justification before the CA? WTF!
