Philippines set to quit Marcos wealth chase

MANILA, Philippines–The Philippines is to wind down a near-30-year hunt for the embezzled wealth of late dictator Ferdinand Marcos, with more than half the supposed $10 billion fortune still missing, the man in charge of the search said.

With Marcos’ widow and children back in positions of political power, and the government tightening its belt, the cost of the pursuit has become prohibitive, said Andres Bautista, head of the Presidential Commission on Good Government.

“It has become a law of diminishing returns at this point,” Bautista told Agence France-Presse in an interview at the commission’s offices, a now rundown building where Marcos’ oldest daughter Imee used to hold office.

“It’s been 26 years and people you are after are back in power. At some point, you just have to say, ‘We’ve done our best’, and that’s that. It is really difficult.

“In order now to be able to get these monies back, you need to spend a lot.”

Bautista, 48, left a high-paying corporate job two years ago to answer a call to help the government of President Benigno Aquino, who promised to end corruption and uplift the lives of millions of poor Filipinos.

He and like-minded young lawyers who joined the agency soon found out that reforming the under-funded commission — itself prone to corruption — while at the same time going after powerful people, was no easy task.

Despite numerous criminal and civil cases being filed against them, none of the Marcos heirs or their cronies, who have been accused of plundering government coffers, have so far been successfully prosecuted, while high-powered lawyers have been used to tie up the judicial process for years on end.

Long-term chronic mishandling of the commission led to an unmanageable paper trail and evidence went missing that led to bitter losses in litigation, Bautista said.

“These accusations (against the commission officials) are not without basis. They were the ones in charge of guarding the chicken coop and some of them helped themselves to the eggs,” he said, refusing to name names.

The president’s late mother and democracy icon, Corazon Aquino, replaced Marcos after a bloodless people power revolt ended his 20-year regime in 1986 and sent him and his family into US exile.

She made it her first priority to create the commission, tasked with recovering all of Marcos’s wealth. Conservative estimates put the worth of assets and funds looted from government coffers at $10 billion.

But before she left office she allowed Marcos’s flamboyant widow, Imelda — known for her thousands of pairs of shoes — and their son and two daughters to return home.

And over the past two decades the Marcoses have regained and consolidated their political base.

Marcos’s son and namesake, Ferdinand Marcos Junior, is a senator who has hinted at contesting the presidency in the 2016 elections.

Imelda is expected to run for a second term in the House of Representatives in May 2013, while her daughter Imee, governor of the family’s Ilocos Norte provincial bailiwick, is also widely thought to want a second term.

“There is still a lot of mystery surrounding the fabled wealth, and my sense is there is still much more out there,” Bautista said.

“Our problem now is that everyone is back in power. That does not in any way make our job any simpler.”

Since its creation, the agency has recovered 164 billion pesos (about $4 billion), some invested in prime New York real estate, jewellery, and about $600 million stashed in secret numbered Swiss bank accounts.

The jewellery, including a 150 carat giant Burmese ruby and diamond tiara, is locked in a vault at the central bank, and at one point the international auction house Christie’s estimated it could fetch up to $8.5 million.

More recently Bautista worked closely with the New York district attorney’s office to charge a former personal secretary of Imelda and two others over a conspiracy to sell a Monet painting that had been bought by the family.

Marcos, an astute art buyer, distributed the priceless collection of at least 300 artworks to cronies when his regime was about to crumble. Only half have been recovered so far and the rest are missing, Bautista said.

The official said he had recommended to President Benigno Aquino that the commission wind down its operations, and transfer its work to the justice department.

If Aquino agrees he would have to get parliament to pass a law abolishing the agency.

“They (the Marcos family) have the resources to go head-to-head with us in respect to litigation. Why do you think forfeiture cases are still languishing 26 years after?” Bautista said.

The agency’s annual budget of less than 100 million pesos was only enough to pay its staff of about 200, many of them young lawyers who turned down high paying jobs elsewhere, he added.

“It’s a lonely job. It doesn’t win you any friends.”

    Pieces of evidence went missing because of conspiracy somewhere.  Why no charges filed against those responsible makes an ideal atmosphere for impunity for sellouts.  that is the biggest problem of the philippines.  There is no sense of accountability.  We create agencies to pursue programs of the government, and when they fail, we simply rename or repackage them, or as suggested by someone who cannot do the job, close them.  Why not close all agencies not up to the job then? What a way to start the year!!!

    As long as the likes of Enrile, Estrada, Marcos, and Arroyos still sit in the Senate, it is far from likely that any substantial headway will be made in recovering the Marcos loot, at least for now.
    But, if there is a WILL, there is a WAY. Unless the voting machines are rigged again to favor these corrupt bunch, hopefully the next round of elections will balance the Senate and the House with more people who are concerned about the Nation’s welfare first, and not their clans and cronies. This kind of injustice will breed the hate and anger that fuels the growth of the NPA. The Marcoses should be glad that the NPA has not found a leader with a vision and guts to gain the popular support of the people by kidnapping one of their corrupt kinds and have them return the loot as ransom.

    Negative. Whatever is the government’s take on this, I say do not quit on searching for it and hunting down the thieves who stole it.Quit the search and it will mean that, even to a simple-minded would-be criminal, crime does pay here in the Philippines. 

    There are lots of economic geniuses out there who can manage the cost of maintaining this office. If the gov’t. can let Napocor be as it is, why not this one. Anyway, it is the people, the dedicated ones, that is critical and is of paramount consideration.This office should go on with the mandated tasks. It may take the government and the courts an eternity to arrive at a decision on a single case, but the important thing is we don’t quit. Prosecute everyone who might have gained from the loot, everyone including the next generation, if they will profit from it. We should let the Marcoses know and let us squeeze it into  their brains, that a Damocles’ sword is still there hanging above their heads, and we’re willing to wait until it falls. 

    While at it, we should let the quitters go. Better still, fire ‘em right now.

    One last question, is the Philippine government including the 11 billion dollars (55 billion at todays gold prices) worth of Yamashita’s gold which was smuggled out of the country as being part of the Marcos loot? 
    If they are, they will never see that, for it is ‘war booty’, rightfully claimed by the U.S. and U.K.

    How utterly disappointing!

    Just a moment though. If half of the $10B loot is still missing, and the PCGG head cites “diminishing returns” as the reason for quitting, does that mean it would take around $5B itself to search for the rest of the ill-gotten hoard? Something does not compute.

    A lot of the monies has been spent by the Marcoses buying back their power base, cronies, campaigns etc., with another hefty portion a windfall for lawyers like Estelito Mendoza. There has to be a way to trace a money trail this big.

    However, the settlement won by the human rights cictims is not premised on finding any more of the Marcos loot. They HAVE to cough up the money.

    Those complicit in this failure, ex-PCGG heads included, have to be charged in court. I hope the Ombudsman is looking at this with eagle eyes. The IBP should also try to weed out out corruption among lawyers, although their contemptible conduct regarding the Arroyos indicates this is wishful thinking. Seems almost the entire legal profession has swallowed by crocs hook, line, and sinker.

    More than twenty years after EDSA 1, the Marcoses still represent a serious loss of face for the country. The shame will never end as long as they keep getting elected. Filipinos, especially in this regard, Ilocanos, should wake up.

    It’s a sad day when the corrupt escape justice.  I wish they would continue, but if it really would just be wasting resources I’d rather it be spent on current problems.

    To be honest though, given past history on these forums, if P-Noy did focus more resources on going after the Marcos wealth, the usual idiots on here would be up in arms about political persecution.

    First of all, they should not be allowed in politics at all, because they have the hidden money and are just laughing at all of the people.. They enjoy the rich life of the richest, with a buffer money to help them survive without working more then 200 years for all of them.
    Hey people, we are talking more then 400 billion Peso and that is not counting what they have already, we are maybe talking over a trillion peso? maybe 2 trillion.
    Are we feeling sorry.
    Aquino and Danding are related, So?
    Nothing will happen.
    Lot of people die of hunger as they not even get a 1000 peso a month.

    This is story of Crime does Pay. Not a good lesson for our children. After milking the country dry, they are back in politics with Bongbong eyeing on the Presidency. What happened to all the administration? So inept, you cannot even prosecute this family that almost drove the country to the ground. Pinagtatawanan lang tayo.

    Nakakalungkot na pangyayari ito kung sakali, pero para sa tamang administrasyon ng pera, dapat talaga i-abolish na ang PCGG… madami din kasi corrupt dun. imagine, 26 years, hindi nakapag-gather ng enough resources ang mga administration para makuha at least 80% ng mga nakulimbat.
    nevertheless, I am thankful na nakarecover tayo ng at least 40% o $4B sa hidden wealth nila.
    I agree na dapat na lang ibalik yan sa DOJ at gumawa na lang ng special task force para dun. mas matipid ang pagtuloy ng kaso at walang additional commissioner or justice na kelangan bayaran. Nakakapagtataka kasi na bakit gumawa pa ng PCGG… sobrang gastos nun. Dapat gumawa na lang ng task force ang DOJ na maglalagay ng mga tao dun para ihandle ang job. at least nakatipid sana sa resources ang government.

    talking about PNOY, hindi nya kasalanan kung walang magagawa ang PCGG ngayon, palyado ang mga dating administration ng PCGG kaya eto lang ang kaya gawin ng current.

    administration is not bad,,, we are heading on a right direction more or less. Quitting the
    PCCG, is the best move,, it is a waste of Filipino taxpayers money dahil mahirap e penetrate
    ang Marcosses ill gotten wealth dahil napaligiran sila ng mga Mafia na pulitiko.

    Not included of course is Lucio Tan whom Imelda called Magbobote who’s still control most businesses.

    Real property in New York in the name of govt and Imelda’s antique collection and the prized rotten Imelda shoes.
    Other than that, nothing more was recovered.

    It means to say Marcos wealth is a myth, just like Marcos war medals as fiction.
    The amount is bloated and exaggerated.
    Even PCGG lawyers gave up the Marcos Chase, as it is better to be Ambulance Chaser, for sure liability and injury is covered by Insurance.

    It’s a Lonely Job there, says the lawyer, of course, if you are searching Marcos wealth in Lonely Planet.

    corrupt siguro kaso hindi naman lahat ng pera nakuha sa kaban ng government, ung iba mula sa mga lagay ng mga negosyante na gusto mamuhunan, kaso mautak lang si marcos kc instead na pera, ang hiningi shares ng company, un nga lang malas at inangkin ng mga crony nya ang mga shares.
    dapat lang naman siguro hihinto na ang paghahanap kc gastos lang government sa mga nakaupo sa pcgg, mga lawyer na pinapatagal ang process para mas malaki makuha na pera at kung sakali man may mabawi, ipapamigay sa mga victims kunwari kaso sa mga abogado lang at mga lider nga mga grupo ang makikinabang ng pera at hindi talaga sa mga tao. 
    ok lang sana kung lahat ng pera makukuha para sa kaban ng bayan mapupunta or magamit pampatayo ng expressway para naman hindi abusado sa toll fee.
