Police officer tags Gwen’s son in direct assault complaint


A police officer who was hit in the back of the head during a commotion with supporters of Gov. Gwendolyn Garcia named her son Paolo as one of two  attackers.

The scene, caught on TV cameras and replayed on   GMA 7 Balitang Bisdak, took place at the entrance of the Capitol compound in the evening of Dec. 19, the first tense evening after the six-month suspension was served on Garcia.

The other alleged assailant was identified as Joey Cal, said to be a confidential agent of the National Bureau of Investigation 7.

Insp. Alvino Enguito of the Regional Public Safety Battalion, with two police officers as witnesses in the incident, went to the Cebu City Prosecutor’s Office yesterday to file the complain for direct assault against a person in authority.

However, they were told to come back on Wednesday, Dec. 26.

Assistant Prosecutor Dixon Fuentes told them that the filing of charges against suspects “at large” should be done between Monday to Friday only.

Fuentes said filing cases on Saturday only applies  to arrested suspects.

Enguito, a police team leader, was supervising his men in dismantling three tents put up in front of the Capitol building. The police also secured  the entrance gate  near the governor’s office, letting visitors through only if they showed ID cards.

The video showed Paolo Codilla  confronting policemen at the gate, demanding to know on whose  authority they were acting.  Several supporters crowded around the police officer. Another man wearing a cap reached out and hit Enguita in the nape, knocking off his police cap while berating the officer.

Cebu Daily News asked Codilla for his comment later, but he declined, saying he would let his sister, lawyer Christina Frasco  respond.

Enguito, brought with him two witnesses, P01 Jessie Yap and P01 Paulino Borja, to the fiscal’s office.

Enguito, in an interview, said  he was able to later identify Codilla and Cal based on TV news footage taken at the Capitol.

Enguito was supervising his men as they were pulling out from the Capitol when the governor’s supporters confronted them and demanded to know who ordered them to dismantle the tents.

The policemen –  on orders to observe maximum tolerance – did not retaliate and left the Capitol compound.

Enguito said he decided to pursue the case after getting support from his superiors. The PNP, he added, will provide him with a lawyer.

Since Wednesday, security has been tightened at the Capitol compound with police trucks blocking the lone entrance gate.

Steel barriers were initially put up by the Capitol security force as supporters of Garcia arrived by bus to assemble at the open quadrangle.

By evening, the PNP acting on a directive from Acting Gov. Agnes Magpale, removed the tents and chairs,  and assigned policemen to keep watch overnight at the Capitol gates.

The presence of uniformed policemen and visitor checks prompted Rep. Pablo Garcia Jr. to complain that  the Capitol compound looked like a “garrison” under a state of “Martial Law.” /with a report from Ador Vincent Mayol

    Sometimes people are drowned with power. The Garcias is a case of a political dynasty in Cebu. Look at them, the father and the siblings are congressmen. And because of these power they have they now think Cebu as their own. They now think that what they do and say is the law of Cebu. She should also look at themselves and evaluate if they are in the right track. Not at all times they are correct. A colleague in law enforcement is assaulted and this 1D10T is showing no urgency at all and spewing out unbelievable and laughable excuses and reasons not to do it. The DOJ should look into the excuses of this court official and determine if they are indeed true. If they are true, the individual who thought of this stupidity should be fired and barred from any government position. Crime does not wait and stop on weekends and holidays, the law enforcement and judicial process should be 24/7, and 365 days non-stop. De Lima should visit this branch and start educating her lazy employees in putting priority on their job instead of their weekend and holidays.

      i thought this Monday to Friday rule is only applicable to the arrest of a person not to file charges because if they are arrested they are put in jail and no judge is to hear a case in weekends. he should process the complain… sack that dumb police officer…

    The authorities should start additional charges to Gov. Garcia who is defying a legal order and occupying a government facility illegally. She should also be fined for every day she and her cohorts are illegally occupying a government facility and defying an order for suspension and also an order to vacate. Make them pay for their insubordination and illegal actions. Hit them where it hurts! their wallets and their credibility as law abiding citizens.

She used Garcia so that the people in Cebu shall be reminded of Garcia’s greater Dynasty power. That’s what you get for voting people of the same family. And because Gwen was pampered during the time of GMA, she still thinks she is “untouchable.” I wonder if there is something she is deeply interested to stay inside the Capitol despite being under suspension. Baka may itinatago siyang “pandora’s box” na gusto niyang hindi makita sa iba kaya “very desperate” siya. And she said, “Over my dead body!”

    This grave abuse of a Garcia scion is one good reason why political dynasties should be eradicated in many areas in the Philippines otherwise, another case like the aAmpatuans will surely develop in Cebu with the Garcia clan lording it over the people in Cebu.

    Suspension of Gov. Gwen Garcia should be carrid on to show that the abuses of the Garcia clan will not be tolerated by the government.

    Maximum tolerance is not working here so classic police siege tactics must be employed:
    -cut off all utility supplies ie water, electricity, gas
    -bright search lights shone wherever these people are holed up
    -loud music to be directed to this place

    All the above on a 24/7 basis until the people holed up see sense …

    simply reasoned that there was no order as she was late going to the capitol
    and that the order was not handed to her personally! . . . what a lame excuse,

    it reasonable enough to say that there was no ruling because she has no copy of

     She committed a
    violation, she should have challenge the court that did the ruling, not that we
    can see a show of force of her party related politicians that only makes things
    more complicated. At pupunta-punta pa roon ang mga kunwaring taga suporta.

    Nakikisimpatya pa ang mga magpag-“kakatiwalaang” sina Erap,
    Binay at JPE. . .hahah . . .”Wat da’ !”

    Try to remove the TRAPOs in power, the bishops who act as if DAMASOs of spanish era, those celebrities-turned-politicians whose only qualification is popularity, and the POLITICAL DYNASTIES then bring in younger politicians who have shown with integrity, honesty, with DELICADEZA and well respected by the society for his/her exemplary records of serving the people. Maybe we will end up only with few good men standing but the reward will create a great impact on younger generations, and a first world country.

    Maybe a wishful thinking but I believe still possible..

    If Pnoy able to support the RH and Sin Tax bills which are sleeping in congress for decades, and continue supporting the FoI bill, the Anti-Dynasty bill, the Anti-Epal bill then he deserves to continue serving the people beyond 2016..
