SC affirms dismissal of charges vs Lacson in Kuratong ‘rubout’

MANILA, Philippines— The Supreme Court upheld the November, 2003 decision of the Quezon City Regional Trial Court Branch 81 that dismissed the multiple murder case against Senator Panfilo Lacson and 33 others.

In a 24-page decision, the high court through Associate Justice Roberto Abad, said QC RTC Branch 81 Judge Ma. Theresa Yadao did not abuse her discretion when she dismissed the case against Lacson and several others for lack of probable cause.

Probable cause are facts discovered through investigation that would lead a reasonably intelligent and prudent person to believe that a person has committed a crime and deserves to be prosecuted.

“The Court agrees with Judge Yadao that the above affidavits and reports, taken together with the other documents of record, fail to establish probable cause against the respondents,” the high court said.

Prosecutors have submitted to the lower court five affidavits from witnesses and reports from the Philippine National Police.

Still, the prosecutors said Judge Yadao should have ordered them to present additional evidence as stated under Rule 112 of the Rules of Court if she still has doubts in determining if there is probable cause to order the arrest of the accused or not.

But the high court pointed that requiring the prosecutors to present additional evidence is not mandatory.

“The court’s first option is for it to immediately dismiss the case if the evidence on record clearly fails to establish probable cause. That is the situation here: the evidence on record clearly fails to establish probable cause against the respondents,” the high court said.

“It is only ‘in case of doubt on the existence of probable cause’ that the judge may order the prosecutor to present additional evidence within five days from notice. But that is not the case here. Discounting the affidavits [submitted by the prosecution], nothing is left in the record that presents some doubtful probability that respondents committed the crime charged,” the high court added.

“In the absence of probable cause to indict respondents for the crime of multiple murder, they should be insulated from the tribulations, expenses and anxiety of a public trial,” the high court said.

Yadao, in her ruling said the evidence submitted by the prosecution as well as the testimonies of the new witnesses — Senior Inspectors Ismael Yu and Abelardo Ramos, Senior Police Officer 1 Wilmor Medes, SPO2 Noel Seno and civilian agent Mario Enad — were “full of loopholes making the accusations less credible and bereft of merit.”

Lacson, along with Chief Superintendents Jewel Canson, Romeo Acop and Francisco Zubia, Senior Superintendents Michael Ray Aquino, Cesar Mancao III and Glenn Dumlao and 31 other police officers were indicted for the murder of the alleged members of Kuratong Baleleng robbery gang on May 18, 1995.

Lacson used to lead Task Force Habagat of the defunct Presidential Anti-Crime Commission headed by then Vice President Joseph Estrada.

    Isipin mo $25Million (DOLLARS PO YON) ang nakuha nina Lacson at Erap sa rubout. If you guys wonder where did $25M came from, yan po galing sa Kuratong Baleleng group na nanghold-up ng 3 bangko bago sila nahuli. Alam nina Lacson at Erap na malaking pera kaya ni-rubout nila ang grupo. Just in case you folks ask where I got my story, kase po kinuwento eto ng isang pulis na kasama sa rubout at siya rin ang nagsabi na si Lacson ang lider sa rubout. If Lacson becomes DILG secretary Philippines no longer need contraceptives because the population will go down.. dahil papatyin niya ang mga kalaban niya. Pabadeng-badeng lang yan pero murderer ang pagkatao.. yan ang utak sa Dacer-Corbito slayings.

      Oks na un kaysa madami pa silang mabiktima. Madaming kriminal ngaun ay handang pumatay kaya kung mapatay man sila ay oks lng kaysa pulis, guard o sibilyan ang mapatay ng mga mokong na yun. Mas mganda kung si lacson ung DILG, mababawasan ng mga kriminal ag pinas.

      Hindi na biro ang mga kriminal ngaun, pumapatay sila. Oks lng kung si “@akoypinoi” ang titirahin, walang problema dun, eh pano nman ung mga inosente na nagkataon lng na nadun sa pinangyarihan ng krimen.

    In retrospect, star witness SPO4 Eduardo de los Reyes was right to flee the Philippines in 1997 and seek asylum in Canada more than 15 years ago. Had he stayed on, he would have squandered away 15 years of his life and his family’s all for nothing. Thanks partly to the help of INC for getting him and his family out of the country, away from any threat to life or limb. So with the bemedaled SPO2 Corazon de la Cruz, who was later forced to recant and has since moved on to Canada. Justice may not always prevail in this world, but karmic retribution ultimately will.

    While Panfilo Lacson may have once decried the DOJ and PNoy’s administration for not treating him as an ally upon his return from a yearlong hide and seek, it can now be said that a tit for tat has transpired paving the way for SC’s affirmation of this dismissal. Someday, somehow, some way, when public pressure is brought to bear and FOI bill becomes law, we will know from the archives how PNoy’s administration rubbed out this heinous crime a second time around in exchange for anti-Arroyo favors from the respondents et al. If PNoy can abandon the search for truth and for his father’s killers just to kiss and make up with Tito Danding, he can betray just about anyone

    remember that task force habagat were able to neutralized organized crime. what if they allowed these criminals to roam the street? for sure some of you can no longer bashed on Sen Lacson because you’re already killed by those criminals. you should instead thank Lacson and his group for protecting the innocent citizens from falling victims to this criminals.

      who cares who ordered to kill those criminals…the big question is why they were killed in the first place ? there is reported 2 million dollars- loot with them when they were killed and that money cannot be found.     Something sucks in the justice system. The Kuratong Baleleng case was about the extrajudicial murders of several people. Just like the Maguindanao (Ampatuan-masterminded) ambush massacre case, these should have been given to a special tribunal where at least three justices will hear the case.

    A single judge can be intimidated, cajoled, or simply make an error in judgment. But, with a tribunal, the eventuality of being threatened or making a haphazard decision will be avoided.

    If it were a simple civil case arising between two “still alive” parties, a single judge court system may do. But, cases such as those involving high profile personalities should never be left with the regional trial court judge who most always will dismiss a case from his or her training that only evidence presented in court should be the basis of the decision by the court.

    A case involving men in uniform also requires careful study of facts and circumstances so that the accused and the witnesses are not unfairly judged. However, the accused in the Kuratong Baleleng case were merely dismissed for lack of evidence where the circumstances of the rubout were not thoroughly examined. Witnesses disappearing and being killed would have been enough ground for the RTC judge to call for more evidence. But, perhaps, her training in law school was to stick to procedure and not to instincts that an inquisitive judge should possess.

    I have nothing against Judge Yadao but her decision does not give any closure to the case because, like other dismissed cases as in the gruesome rape-murder Vizconde case, the question begging an answer will remain in the consciousness of many Filipinos to be  this – “Who  did the crime?”

    That’s how big fish gets away with any case thrown at them. Bribed prosecutors will present bogus evidence and unreliable witnesses, so therefore the Court will find it as it was laid. Presto, case dismissed…what more if the judge is corrupt, which is true most of the time.

    as long as ozamis exists, kuratong lives. that is the main industry in that place; if the syndicate is still active that’s probably because police, military and politicians are behind it; 

    the rubout in 1995 happened because kb became too hot for comfort for the protectors; 
    it was a nice live show scripted by the protectors designed for damage control; 
    erap and pinky were suspected protectors of kb at the time;

    as in the past, when election time comes fund raising by the syndicate becomes more frequent; 
    expect kb operations to intensify in the next few months;

      the tentacles of kb are so widespread because this group is well organized they even have infiltrated almost all elite law enforcement units in the the country. once involved, nobody can ever disengage from them because death is the only way out. in the 90’s i saw for myself how this group operates and i was amazed how well prepared they are financially and logistically plus the patience because they waited for a year before they were able to take a hit on a fellow cop.
