SC issues TRO vs cyber law

MANILA, Philippines–The Supreme Court stopped for 120 days the implementation of the Cybercrime Prevention Act of 2012.

At the same time, the high court has set an oral argument on January 15 to hear both parties for and against the law.

In a 13-page ruling, the high court consolidated all the 15 petitions against the Cybercrime Law.

“Now, therefore, effective immediately and for a period of 120 days, you, respondents, your agents, representatives or persons acting in your place or stead are hereby enjoined from implementing and/on enforcing Republic Act 10175 (Cybercrime Prevention Act of 2012),” the high court resolution dated Oct. 9 stated.

At the same time, it ordered the government’s lawyer, the Solicitor General to comment within 10 days on the petitions filed against the law.

The high court also set the case for oral argument on Jan. 15 at 2pm.

In the 15 separate petitions, these are the provisions of the Cybercrime Prevention Law that are being questioned before the high court;

Sec. 4(c)(4), which criminalizes libel, not only on the internet, but also on “any other similar means which may be devised in the future;”

Sec. 5 (b), which punishes those who attempt, aide or abet the commission of a cyber offense;

Sec. 6, which  raises by one degree higher the penalties provided for by the Revised Penal Code for all crimes committed through and with the use of information and communications;

Sec. 7, which provides that, apart from prosecution under the law, any person charged for the alleged offense covered will not be spared from violations of the Revised Penal Code and other special laws;

Sec. 8, penalties corresponding Section 5 (b)

Sec. 11 which lists duties of law enforcement authorities, including the submissions of “timely and regular reports including pre-operation, post-operation and investigation results and such other documents as may be required to the DoJ;

Sec. 12, which authorizes the real-time collection of traffic data;

Sec. 13, authorizes law enforcement authorities to collect or record, by technical or electronic means, traffic data in real-time;

Sec. 15, authorizes law enforcement authorities to search, seize and examine computer data;

Sec. 17, which authorizes service providers and law enforcement agencies to “completely destroy the computer data subject of a preservation and examination” order;

Sec. 19, which authorizes the DOJ to block access to computer data when such data “is prima facie found to be in violation of the provisions of this Act;” and

Sec. 20, which states that those who fail to comply with provisions of Chapter IV (Enforcement and Implementation), specifically orders from law enforcement agencies, shall face imprisonment of prision correctional (6 months and 1 day to 6 years) in its maximum period or a fine of P100,000 or both, for each noncompliance;

Sec. 21, which states the jurisdiction of Regional Trial Courts (RTC) and designated cybercrime courts over violations of any of the provisions of the law; and
Sec. 22 pertaining to international cooperation from all relevant international instruments, international arrangements, and domestic laws in the implementation of RA 10175.

Petitioners said the law violates the public’s constitutional rights including right to due process, equal protection, freedom of speech, right to privacy, protection against unreasonable searches and seizures, protection against double jeopardy, among others.

“Indeed, the Internet is not evil per se, but the statute in question views cyberspace as inherently evil and treats those who use it in violation of a rule with unjust discrimination by providing a penalty higher than an act committed without the use of an internet,” one of the petition stated.

The law is envisioned as a measure against hacking, identity theft, spamming, cybersex and online child pornography. But citizens and groups who protested on social networking sites, blogs and out in the streets fear politicians will use it to silence critics.

The law contains a provision that says libel — which is already punishable by up to six years in prison — is also a cybercrime. It doubles cumulative penalties for online offenses and allows government agencies to search, seize and destroy computer data deemed libelous.

Human rights and media groups have unsuccessfully campaigned for years to downgrade libel from a criminal to a civil offense, saying politicians often use the law to harass journalists and other critics.

Many Facebook and Twitter users in the Philippines and the portals of the main media organizations have replaced their profile pictures with black screens as a protest against the law. With Associated Press

    TRO is not enough.  This law has to be repealed.

    The internet is deeply integrated in the life of OFWs as it takes away some of the loneliness and worries of being away from family when they are able to voice out their feelings and opinions.  It is the only way they can take part in the issues at home even when they’re not on Philippine soil.

    Public officials who have no sincere desire to serve the public honestly are the only ones who should be concerned.  Robredo’s death brought out all the goodness of the man.  If a public official is doing his best to serve then just like Robredo he has nothing to fear.

    The supreme Court appears to be more sensible and responsive by promptly making decision to important issue like the Cyber Law.

     In reality, we already have so many enacted laws that cover even offenses included in this new Cyber Law. The real problem is, we don’t use most of them.

    Instead of putting a law like this, we should start from education in school about good citizenship on the internet from elementary years. 

    The Hayden Kho-Halili scandal taught us a real lesson and opened our eyes.  We all knew what he did was wrong.  That’s because Hayden never received education and training on how to be a good citizen on the internet.  Nobody told him about the consequence of his actions.  The man lost his medical license in the end.

    Hindi naman. I think that most believe that we should have a cybercrime law in place. All we’re saying is to put the “right one” in place. In its current form, RA10175 is just too vague and will most likely be open to abuse. 

    The abuse, I believe, won’t come from government. It will come from our next door neighbors. I should know. A similar type of abuse has already happened to me.

    In 2009, my late father hung a protest banner at our gate. He was protesting the legitimacy of our village association’s new set of officers. On the banner was a simple question, “Where are the proxies, Mr. Secretary?” Since I agreed with him, I didn’t take the banner down. 

    Later that same year, I received a warrant of arrest… The case was LIBEL. Though I had nothing to do with the banner or its contents, I was charged with this crime. They couldn’t charge my dad because he was already 78 years old at that time… so they charged me. 

    I spent a day in a detention cell before I was able to raise the bail bond. Had I not been able to raise the money, I would have spent the entire trial period (2.5 years) in a detention cell. By April of this year, the case was thrown out because there was really no basis for it in the first place. 

    My point is this… 

    Don’t take this law lightly! If the original Libel Law can be abused, this new Cybercrime Law makes it much easier to abuse it even further. Furthermore, the corresponding sentence for this new form of libel is much more vicious than that of original libel. 

    I just don’t see how this will not be abused.

    The Government says that the solution is to simply “watch what we say”. Knowing first hand how our justice system works, I can tell you with conviction that it isn’t as simple as watching our words… because the abuse won’t necessarily come from Government. It will come (mostly) from the people around us who will find a way to use this law to hurt us.

    In my case, I got thrown in a detention cell (could have been 2.5 years) for no reason at all. Someone simply pointed a finger at me and (viola) I’m a criminal. If I couldn’t afford to post bail, my life would have been destroyed. It’s that easy. 

    This could happen to anyone.

      We don’t want to go through the same experience you’ve been. You yourself pointed out libel wasn’t proven. But the harassment was real.  Just because I speak against one politician whether there was ground or not, libel would be their favorite choice of democratic weapon.  Of course It will be disprove later, but the harassments(financial and psychological) and the time I would be spending time on court would make my false accuser smiling kahit talo siya.

        At ‘eto pa… 8 to 12 years ang sentensya ng e-libel. Plus 1 yun sa batas. If I recall correctly (please correct me if I’m wrong), hindi bailable ang setensyang more than 6 years. 

        E paano na kung nangyari ito sayo at e-libel ang ginamit?

        You’re a victim of libel. You feel your reputation has been shattered. Have you ever considered being accused of libel and detained for a day or two? How much more would your reputation be shattered then? 

        The cybercrime law will probably never be perfect… but our lawmakers have to try to make it as close to perfect as they can. True barbarism will only come about if we allow our laws to be half-baked and vague.

        You’ll get your day in court, my friend… but, hopefully, not with a law that can bring you down as easily as it can be used to your advantage.

      THat is exactly the reason why netizens are at war against this law. Knowing how creative our neighbors and our politicians are, they will find a way to harass their critics. 

      This cybercrime is the best tool to do that. I envision this law to become the most abused law of the land for sure. 

      I remember Tito bukol escalera Y sotto said in one of his privilege speeches that he will retaliate at his critics after the cybercrime law is passed.

      Unfortunately for him, he was totally shamed by SC. It’s a pity, the valid provisions of the law suffered collateral damage because of clown AKA escalera’s stupid antics.

       Escalera is now the “primus inter pares” in senate when it comes to stupidity. First by being a plagiarist, now the “inserter” of libel provisions in cybercrime law.

      One thing is sure. People will not forget. Escalera’s career as a senator is a goner.

      Boom San Agustin’s experience can be viewed in a different way, like:

      If any one can sue someone whom he thought maligned him and the sued person can protect himself like payment of bail etc. using the existing law,  then why do we need this  crazy idea about the new cyber law?

      I think this law is designed to protect stupid politicians and person like a senator who earned huge criticism due to his stupidity and some corrupt officials who hate to be exposed in the social media.

      If the former first Gentleman can sue most the media people who exposed his activities and if the sued media men were able to counter and  beat this person in power using the present law, so what do we need this new cyber law for?

      So Mr. President Aquino, members of the congress and senate, please leave us, netizens, alone to maintain a healthy exchange of opinions where you can base your best judgement in making your decisions.

    This is the first round of the fight of the highest IQs of the land versus the lowestly microscopic IQs and it is already apparent that this anti cybercrime law will be archived or garbaged not for lack of merit but it is a tool surely to super clog our myopic, inefficient and low budget  judiciary. Ostensibly this is the goal of the 13 senators facing election in 2013 and 2016 where their names received monikers they can hadly accept and hugely adversarial to their chance of winning the coming election. This law is derived from low IQ politics not from the basic human rights principles in our 1987 constitution.Time to change these oxymorons and cut-to-paste senators.

    In fairness though, there may have been a good point or 2 in the law but as a whole it was fairly absurd. The PI is now a democracy therefore freedom of speech is part of that right for each citizen within that democracy.

        That law was really half-baked – notwithstanding its rightful intentions, but defective formulation. This perceived ‘worst enemy’ has always been present and only stays dormant in the background, hiding from the eyes of the law or from its victims, if you will.
        The Legislative, Executive and Judicial branches of the government are all existing, each for a purpose. It is the Judicial Branch who must see to it that the errors committed by Legislative & Executive, intentional or otherwise, are addressed accordingly. The SC decision shows that it is doing its job, and one cannot just conclude that aquino (executive) and sotto (legislative) “LOST”. If you say they made a MISTAKE, then I would totally agree.

    The high court justices unanimously issued temporary restraining order vs the Cyber crime law is welcome and timely news.  120 days should give all sides some breathing room.  
    A couple of things we can learn from this development:
    1) All the supreme court justices are at work and stepped up the plate and relegating the non attendance at flag ceremonies to a sideshow.
    2) There is hell to pay for lawmakers who openly trample on basic rights of expression guaranteed in the Philippine constitution.
    3) Damage control is in full swing among Senators who voted for the cyber crime law.

    The Supreme Court seems to be okay.   Filipinos should be on the look out for people who magnify and make a big fuss out of very small issues in the internal affairs of the Supreme Court.  These people seem intent on destroying and damaging the reputation, credibility and integrity of its members as well as that of the Supreme Court as an institution.   If these people who are creating havoc in the SC were successful, we will not be having this TRO.         Yes we are protected. RA 10175 or the “Cybercrime Prevention Act of 2012″ DOES NOT BEAR ANY PROVISION THAT IT HAS RETROACTIVE EFFECT for any cyber actions in the past which are defined under this law as cybercrime (read Chapter VIII Final Provisions). Any cyber offenses under RA 10175 are still not punishable as this law is not yet in effect by virtue of the Supreme Court TRO.

        Based only on google resources and time I have right now I can only find the following to answer about ex post facto (retroactive)

        SC: G.R. No. 162777

        Frank Chavez vs. Comelec

        particularly on Section 32 of Comelec Resolution No. 6520, dated January 6, 2004.

        This is about removing of propaganda materials, ad materials I guess prior proper election campaign start.

        Apparently Frank became an endorser of clothing company, who made ads with his name and image. And so it was put up on or about Aug 2003.

        Then he applied for candidacy on Dec. 2003.

        Comelec upon promulgation of Resolution 6520 said it was unfair to use print/ad materials before the prescribed period, and so Frank must take it down. Feb 2004.

        So then, Frank argues that since the deed was done before the law, ex post facto applies.

        SC doesn’t seem to think so. Franks petition was denied.

        *albeit example is not criminal in nature.

    Court in its present composition headed by Sereno is responsive
    to complaints from the people, and hopefully will repeal this
    cyber law and pare it down to the minimum, if not altogether

    I agree with Sen. Santiago that the cyber crime prevention law should be totally struck down by the Supreme Court. Yet, I disagree with her that this is a minor victory. Indeed, this is a major victory for the people, no matter how PNoy’s supporters dismiss it as trivial. I am certain that the Supreme Court will finally resolve to strike it down. The fundamental reason is that, even if they will remove the “libel clause” the law cannot stand questions of constitutionality by the use of the words, “computerized data in any form.” These words are vague, all encompassing, and necessarily includes online libel even if it is not provided in the law. It is indeed a major victory for all the people because we are able to prove to PNoy and his administration that he can not just impose his will, whims, and caprices upon the people, not even with his manufactured trust rating.

    This is the fruit of our vigilance and perseverance kababayans. Congratulate yourselves. Together we can make a lot of difference against tyrants in our society. Keep it up!

    My take is that we really need a Cybercrime Prevention Act… Marami-rami na rin naman ang nabibiktima ng identity theft, email hacking, email scams, pagkakalat ng sex videos, etc.  Dapat naman maparusahan din yang mga promotor nyan… Pero dahil sa ilang senador na nagsingit ng “libel” sa mga punishable violations, ayan tuloy, nasayang na naman ang oras at pera na inubos ng mga kongresista at senador para maipasa ang batas na yan!

    Kaya sa mga senador na utak ng kapalpakan na yan, mahiya naman kayo!

    I am very disappointed with Pnoy. He supported and defended the E-Libel law. Someday, when he is not president anymore, this Internet libel law will bite him in the butt or his families might get sued for internet libel (especially Kris since she is very controversial and writes whats on her mind). Makarma din yan si Pnoy.

    Remember, when Gloria Arroyo was still president, she gave an Executive Order giving the DOJ secretary super powers on Hold-Departure Orders with citizens charged with some crimes. And she used this Executive ORder to harass her political opponents. Di ba, na karma si Gloria. She never thought the Executive Order she signed would be the very same law used against her when Sec. De lima prevented her from flying abroad. Gloria’s camp even argued that preventing her from travelling was a violation of her constitutional rights but then she forgot she was the ONE who signed the Executive Order.

    Now, Pnoy will surely suffer the same fate. Balang araw, yan si KRis Aquino ay masasampahan din ng INternet libel kapag hindi na presidente yung kapatid nya at wala ng power at impluwensiya sa batas.

    Sec. 4(c)(4), which criminalizes libel, not only on the internet, but also on “any other similar means which may be devised in the future;” – so that we want to have all the FREEDOM to lambast, insult, gossip who ever we want. This is our freedom of speech

    Sec. 15, authorizes law enforcement authorities to search, seize and examine computer data;  and Sec. 17, which authorizes service providers and law enforcement agencies to “completely destroy the computer data subject of a preservation and examination” order; – so that we can keep and upload all the pictures of your girlfriend who refuse to have sex with you. This is our right to privacy, protection against unreasonable searches and seizures   

    Then seeing Bayan Secretary General Renato Reyes on the frontline – WOW so what’s new? wla nang pera siguro kaya humihirit nanaman.

    okay lang sana itong cybercrime law kung pinag-aralang mabuti ang provisions. some of the provisions of this current law are very repressive. obviously, politicians who doesn’t want to be criticized through the cyberspace for their stupidity and wrong doings advocated those provisions.

       the provisions of this current law are very repressive and for the most
      part aims to protect the interest of those politicians who doesn’t want
      to be criticized through the cyberspace for their stupidity and wrong
      doings.

    Makakabuti seguro na itong Cyber Law ay isama sa dapat pagbutohan ng mga tao ngayong darating na halalan ng taong 2013. At nararapat na ito ay isalin sa wikang Pilipino upang maunawaan ng mga Pilipino ang kahulugan nito.

    At panahon na rin marahil na ang ating mga BATAS ay nakasulat na rin sa wikang Pilipino upang maunawaang lubos nating mga Pilipino.
