Priest suspended on 20-year-old child abuse raps

CEBU CITY, Philippines— Msgr. Cristobal Garcia has been suspended and stripped of his positions in the archdiocese of Cebu on orders of the Vatican while the Holy See investigates accusations he molested altar boys more than 20 years ago in the United States.

Msgr. Achilles Dakay, the archdiocese’s media liaison officer, said Garcia’s suspension came months before the priest was implicated by a National Geographic article in illegal trade of ivory in the Philippines.

Dakay said Garcia was suspended by Cebu Archbishop Jose Palma in June on instructions of the Vatican because of the ongoing investigation of the child abuse case filed against him.

As part of the penalties, Garcia is not allowed to say Mass in public and hear confessions and has been stripped of his positions in the archdiocese, including his chairmanship of the committee on worship.

Palma informed Garcia about his suspension, which might have affected his health, said Dakay.

Garcia, a diabetic and hypertensive, has been on sick leave. He was confined at a private hospital in Manila. Before that, he had been staying with a sibling in Manila while he sought medical treatment.

Palma confirmed at a news conference at the Archbishop’s Palace on Wednesday morning that Garcia had been removed from his positions in the Archdiocese.

“You might notice you have not seen Monsignor Cris since June because he’s out of Cebu,” he said. “He is no longer connected with any of the posts he occupied before.”

He stressed that the investigation into Garcia’s child abuse case came long before the monsignor was embroiled in controversy involving ivory trade.

“In regard to the matter of Monsignor Garcia’s past, the case has been elevated to the Holy See and it has initiated the investigation into it long before the present controversy erupted,” Palma in a prepared statement.

“I have also fulfilled the Holy See’s instructions regarding the submission of documents and acting upon related consequences,” he added.

Garcia was a Dominican priest working in the Catholic Archdiocese of Los Angeles in the 1980s when he was accused of child abuse. He was later expelled after a nun reported to the police that an altar boy had been found in his bed in a Los Angeles rectory.

An article by the Los Angeles Times reported that Garcia was accused of molesting two youths in 1980 and 1984.

A Dallas Morning News item reported Garcia as saying he did have sex with the two altar boys but claimed that he was the one who was “seduced and raped.” His accusers, however, found his claims absurd.

Dakay told the Inquirer that Garcia was the last priest ordained by Cebu Archbishop Julio Cardinal Rosales before he died in 1980s.

When Garcia was expelled by the Dominican order, he added, Rosales brought him back to Cebu and took him as a diocesan priest.

But Dakay said Garcia could no longer go back to the US following a conviction in the civil aspect of the case. He could not say, however,  if Garcia was ordered to pay damages.

It was during the time of Cebu Archbishop Ricardo Cardinal Vidal, Rosales’ successor, that Garcia was conferred the title of monsignor.

Garcia subsequently became a high-profile priest in Cebu and has been known for his vast collections of religious icons and paintings. His collections are usually displayed in exhibits every January as part of the festivities leading to the annual fiesta of Cebu’s patron, the Señor Sto. Niño.

He was also given various positions, including the chairmanship of the Commission on Worship. He was also business manager of Bag-ong Lungsoranon, the official publication of the Cebu Archdiocese; and spiritual director of Bukas Loob ng Dios and the World Apostolate of Fatima.

He is also a founder of the Society of the Angels of Peace in Talisay City, Cebu, and rector of the Archdiocesan Shrine of Jesus Nazareno, also in Talisay.

Dakay said he thought that the child abuse case against Garcia had been considered closed until Palma was informed by the Vatican about the ongoing investigation.

“He must have repented and felt sorry for what he did because it was a sin. But the crime remained. Vatican went on investigating it,” said Dakay. “What happened in the States could be a crime. If it was also a sin on his part, it was forgiven. It was repented for.”

Dakay said the criminal case was elevated to the Vatican and is now the subject of an investigation.

Dakay said he didn’t know when the case was revived. “I don’t know why it reached the Vatican as a church case.”

“We have been communicating with the Vatican.  We didn’t know that there was an investigation. We didn’t know that it was revived,” he said.

Dakay said Palma was appealing to the Vatican to soften the penalties apparently due to Garcia’s health as well as his contributions to the Cebu Archdiocese.

Garcia left for Manila several weeks ago to seek medical treatment. He had been in and out of hospital because of his hypertension and heart ailment.

Dakay said some Cebu priests saw Garcia in Makati last week with his bodyguard and private nurse, “looking very sick.

“He is now in a hospital,” he added.

He said Garcia, an expert in liturgy, has been printing their prayers. Garcia also founded a congregation and ran a shrine in Cebu.

    Fact is worldwide 2% of Catholic priests face child abuse convictions or charges. Yet we have yet to see any major cases here as victims are highly intimidated to come forward in this predominantly catholic country…. Yet once this fuse is lit we can expect to see a very large bomb devastate this last vestige of this archaic religion….

      The Dominicans are not out of this cover-up quagmire.  They should not just dismissed Garcia and dump him into our lap.  The crime happened in their jurisdiction.  They should have prosecuted him under Vatican’s ecclesiastical court (kuno) and pursued his defrocking. Now, the Dominican sh*t exploded into our faces.

      This is a symptom of the RCC culture of pass-the-rock. 

      Btw, how many could have been abused by Garcia in this country? While he was tellingly quoted as saying that “in the Third World country, if something happened it happens and we just have to live with it” in justifying the tolerant atmosphere here. So how many were officially abused? Zero. There is total silence in “Third World” Cebu.

    this is ridiculous this man is a criminal and should be dealt with as one, saying that it was a sin and should be forgiven is hypocritical in the  part of the church because when other controversies occur and the ones involved are not tied with their institution they quickly call for justice and practically order people to do the same, where is the justice here? i cant believe he was still accepted as a diocesan priest after raping kids in LA, in what universe is that even acceptable.

    This news article really is a let down on how the CBCP handles child molestation, pedophilia and homosexual cases among priests. How come an Archbishop, already knowing the priest had been expelled by another religious order due to scandalous acts, reinstate him in a diocesian position and later on promoted to a monsignor is a real mind boggler.
    His crime was done in the 80s, the Vaticans investigation was concluded…. in the next century. Is this how long justice is handled in our church?
    I wouldnt even go to the RH bill issue but if the church have severe internal issues, I suggest they handle them first, lest lose any credibility left. They should not wait for the day wherein priest would not be respected anymore by parishioners.

    Fr. Thomas Smolich was a two-year roommate of Fr. Angel Mariano. Smolich is now the top USA Jesuit with an office in Washington, DC. Fr. Mariano likes to cook.

    Fr. Angel Crisostomo Mariano may have returned to the Philippines. Since sex offenders rarely have only one victim, the Jesuit Order needs to disclose where Fr. Mariano is now and whether Mariano is still a priest.

    I’m terribly sorry and sad for this guy. In the early sixties, I worked in a shipping company in Cebu City and I knew his father was one of the owners of that company. I have not seen that guy Cris Garcia when he was still a kid but only a brother of his we fondly called ‘Nyorito Egay and I thought no pedophile will ever emerge from their family siblings because all of them are normal-looking human beings. His father was a Spanish mestizo and he was very “macho looking” and very refined in his dealings with us that up to this day I cannot forget his benevolent gestures shown to us – employees of his company. I was greatly stunned to learn it from the news that his son Cris who became a priest ended up with “unsavory details” of committing “pedophile” acts with two altar boys while in Los Angeles in early eighties. All I knew from what came out in Cebu papers before was that he was doing well with his chosen vocation as a priest and that when I learned he was elevated to become “monsignor” in the priest hierarchy I felt so proud of him and for his family. But there are things we don’t know that just “came out of the blue” and learning all about this sad news about “Cris” really saddens me. I felt sorry and sad for him.

    Now is a trying time for the Catholic Church with regard to the incidents of sexual abuse that were committed by some of its priests. These incidents happened long time ago, but the Catholic Church kept mum about it and protected the “offending shepherds” instead of the injured flocks. Payback time is happening now; the Catholic Church can no longer afford huge out-of-court settlements it used to arrange with the victims to preclude open scandals. These abuses & large financial settlements are the causes for many Catholics to veer away from the Catholic Church either by being non-practicing Catholics or by joining other religious congregation. The Catholic Church has no choice but act accordingly on the sexual abuse issue or continue the decline in its membership and the resultant decline in financial contributions. In US, legal cases against priests who committed sexual abuse have been so many; the former and their superiors who attempted to cover up the abuse are convicted and they are serving time for the crime. To be constructively transparent, to be not too passive, to be not too communal are only few paradigm shifts which the Catholic Church should initiate to keep its flocks. Our current era is dynamically changing wherein liberalism is a commodity versus the olden days’ focus on traditional and conservatism. The Catholic Church-while being the oldest religion, can no longer claim exclusivity in religious world.
