Ombudsman thrashes bribery, graft cases vs Arroyos

It’s not all defeats and losses for the beleaguered former President Gloria Macapagal-Arroyo.

Ombudsman Conchita Carpio-Morales has dismissed the bribery and corruption complaint filed against Arroyo, her husband, Jose Miguel Arroyo, former elections commissioner Virgilio Garcillano and four others for allegedly handing out envelopes with cash and providing transportation, including the use of a helicopter, in Mindanao during the 2004 election campaign.

Also cleared were former Civil Aviation Authority of the Philippines Director General Alfonso Cusi, former Justice Secretary Agnes Devanadera, Philippine Ports Authority manager Efren Ballozos, and former Shariah Circuit Court Judge Nagamura Moner.

The complaint was dismissed because of insufficient evidence, the Office of the Ombudsman said in a statement.

“The complaint contains bare allegations and pieces of evidence that are unsubscribed, unauthenticated and recanted affidavits or statements,” Morales said in the resolution approved last May 25.

The complainants alleged that the Arroyos and the other officials had distributed envelopes containing money to unidentified election officers in Lanao del Norte, Lanao del Sur, Tawi-Tawi, Sultan Kudarat and Cotabato City during the May 2004 polls.

The complainants also said the Arroyos and the other officials had granted 12 multi-cab vehicles to the area and had made a helicopter available for use.

All these were allegedly intended for electoral fraud, they said.

The complaint was filed in August 2011 by Pacasirang Batidor, Ahmare Balt Lucman, Hadji Rashid Limbona and Hadji Abdullah Dalidig.

In dismissing the case, the Ombudsman said the complainants’ allegations could not stand in court. The allegations fail to sustain a well-founded belief that crimes were committed and the accused were probably guilty, Morales said.

She also found the bribery allegations to be insufficient because the recipients of the money were not identified or named as public officers.

“In bribery, it is essential that the recipient of the bribe is a public officer. Hence before a prosecutor can declare that there is probable cause for said felony, there should be proof or showing that the recipient is indeed a public officer,” she said.

    It is public knowledge but it does not stand up in court of laws that GMA and Mike Aroyo manipulated the 2004 election. Although there is a hello garci tape, it is not also acceptable in court due to the process of obtaining it. All the people can get is the “I am sorry” apology only. At the end she is still rewarded a six year presidency term. GMA is not just wily but also very lucky. With so much brilliant lawmakers in the congress and senate, they are still idiots compared to the cunningness of GMA and Mike Arroyo. Its just like admitting that we are a country of fools.Seems that the last laugh still belong to GMA and Mike Arroyo.

    Kudos to her! She’s being careful for she is somehow in the public spotlight. But I think this is just a way of saying “we have to be better with evidence, people learned a lot in the impeachment”. The Arroyos should not rejoice, It will come back equipped.

    Mga anti-Pnoy at pro-Gloria nagbunyi naman kaagad dahil sa pangyayaring ito. Nakalimutan na isang kaso lang  naman a kailangang ipanalo para makulong ang isang tao at hindi lang naman iisa ang magiging kaso nina Gloria at Mike. Parang yong mga alipores ni Corona na nangangantiyaw noong iwiddraw ng Prosecution ang ilang articles of impeachment. Di nila naisip na isang article lang naman kailangan para  mapatalsik si Corona at yon nga ang nagyari. Mga tanga.

    This is proof that it is very hard to legally held responsible those corrupt government officials kasi they know how to hide evidence.  Kahit may admission pa dati at nag say “Sorry” pas sa “Hello Garci”, hindi pa rin yon ibedensiya para ma convic.

    Tax evasion and check SALN, there’s more chances of finding something on this part.  Anyway, ma identify lang sana lahat at maalis at banned to hold public position is good enough.

    This is good news nonetheless.  A temporary setback perhaps, but a blessing in disguise nevertheless.  This proves the independence and impartiality of Ombudsman Morales. This will strengthen her credibility and might as well serve as an “in your face” slap against her detractors.  This will help her in good stead in the fight against corruption. Now we can be assured that we have an Ombudsman that means business.

    So best beware Corona twins and clones!  And Little Girl, hold your horses,  hide the party balloons and call the celebrations off just yet. The ghosts of your past kleptocracy will be back to hound you once again and this time prepare to meet your doom as your Crown have fallen and nobody is going to protect you no more!

    it only proves that ombudsman morales is a right person to hold this title because she has an undoubted credibility. she doesn’t care whether the cases she is in-charge with to hear belongs to pro or anti-PNoy.

    that is a right decision madam! give verdict to cases based on solid evidence and testimony not by a mere hearsay or testimony that cannot be supported by clear documents and just filed to pin down an adversary.

        Yup. based on the complaints filed before the DoJ by Pacasirang Batidor, Ahmare Balt Lucman, Hadji Rashid Limbona and Hadji Abdullah D. Dalidig in August 2011. The affidavits of the complainants were the basis of the DoJ to file the case against the respondents before the Office of the Ombudsman. walang case build up but still they proceeded with the filing of the case. Hayan tuloy, olats!

Alam namin na pinaglalaruan nyo lang ang batas ng ating bansa dahil kulang daw ng ebidensya pero sa kaalaman ng maraming pilipino – ang mga kasalanan nyo sa bayan ay hindi na kelangan ng ebidensya.. dapat ikulong kaagad kayo mga basura sa bayan.
