Gov’t officials challenged to sign waiver on bank funds


MANILA, Philippines – Senate minority floor leader Alan Peter Cayetano on Wednesday challenged all government officials to sign a waiver opening up their bank accounts.

Cayetano said that the waiver should be amended into the Statements of Assets, Liabilities and Net worth (SALN) Law.

“I have appealed and I am appealing to [President Benigno Aquino III], ask your Cabinet members to start by signing a waiver opening up their bank accounts to the Ombudsman, for example,” Cayetano said.

Chief Justice Renato Corona, in his testimony Tuesday, signed a waiver allowing the Anti-Money Laundering Council (AMLC), Bureau of Internal Revenue (BIR) and the Securities and Exchange Commission (SEC) to probe his bank accounts and business interest. But he said he will only submit it if the 188 lawmakers who signed the impeachment complaint against him and Senator Franklin Drilon will sign a similar waiver.

Prosecutors and Drilon said Tuesday that they have no intention of signing a waiver because it was not related to the impeachment trial.
“I believe it’s a valid issue, but the timing was not right,” Cayetano said.

“Perhaps after [the impeachment court renders] a decision, all government officials should sign a waiver to show that it’s not true [the government] was only going after the enemies of [President Benigno Aquino III],” Cayetano added.

‘Tuwid na daan’

He said that the waiver for government officials to open all bank accounts was “the next logical step in the “tuwid na daan” (straight path) campaign of President Aquino, since there was already the Anti-Red Tape Law, the Freedom of Information bill, and the impeachment trial of the Chief Justice.

Cayetano agreed that the waiver would “muddle the issue” if it was done during the impeachment trial “but right after this impeachment case, if [government officials] are not hiding anything, what is wrong with signing a waiver?”

Cayetano said that when he challenged former First Gentleman Jose Miguel Arroyo to open up his bank accounts, he did it first and without condition, unlike Corona who would only sign his waiver with the condition that the 189 others would do it first.

Part of his proposed amendment to the SALN law was to include bank account records in the waiver of the SALN.

“The banking system will not be ruined if a small elite group, let’s say from the Office of the Ombudsman or it can be a composite group in [the Anti-Money Laundering Council], that will also look into these bank accounts,” Cayetano said.

Meanwhile, a Catholic school official and some bishops also supported the challenge to government officials to open up their bank account records.

Fr. Ranhilio C. Aquino, chair of Jurisprudence and Legal Philosophy of the Philippine Judicial Academy (PHILJA) and Dean, Graduate School of law, San Beda College , said those who accused Corona of not disclosing bank records must also show that they are not guilty of committing the same offense, otherwise it is hypocritical, said.

“There is a condition, those who accused him (the Chief Justice) of not disclosing his bank records should come to court with clean hands,” Aquino said.

“That’s a principle of equity. He who comes into equity must come with clean hands. They have to make sure that they are not guilty of non-disclosure, otherwise it is hypocritical,” he added.

During Wednesday’s impeachment trial, lead prosecutor Niel Tupas said they will not sign the waiver. The prosecutors added that they have nothing to hide and their Statement of Assets, Liabilities and Networth will be available after the impeachment trial.

Manila Auxiliary Bishop Broderick Pabillo said government officials should take Corona’s challenge and sign a waiver .

“Those accusing him should also set the example by disclosing their dollar accounts,” Pabillo told church-run Radio Veritas Wednesday. “That’s why the challenge of the Chief Justice is good for other lawmakers to show their assets.”

“There is really something wrong when they want a person to disclose his dollar accounts but his accusers refuse to do the same or don’t want to be transparent,” he said.

Lipa Archbishop Ramon Arguelles said government officials accepting Corona’s challenge would erase doubt on every public servant’s credibility.

“The nation will benefit a lot if they will sign a waiver,” Arguelles told the CBCP news.

Retired Archbishop Oscar Cruz said Corona’s dare “is but a statement that those accusing him of dishonesty in making his SALN are dishonest themselves.”

“That’s why the basis of this is let us know who have no sin and throw the first stone. That’s the message,” Cruz said.

    Even if it’s not related to impeachment in signing the waiver, show us in good faith that you hide nothing. I like this move by Sen. Cayetano. I hope it will be supported by other politicians. Huwag ‘nyong gamitin ang rason na hindi kayo ang nasasakdal kundi si Corona. We are your boss and we want to see your bank accounts. At this moment, it’s not only about CJ but TRANSPARENCY and ACCOUNTABILITY.

    Hinamon siya ni FG Mike Arroyo na sabay silang sumakay ng eroplano papuntang Germany, pupuntahan yung bangko, para malaman kung totoo nga yung bintang niya.

      ano ba ang ninakaw niya eh ang kaso yata eh hindi paglalagay sa saln yung dollar na matagal na palang ini-ponipon. inamin niya na me dollar siya at hindi niya inilagay sa saln dahil jsa confidentiality ng dollar deposit. kung ilalagay mo sa saln ehwala ng confidentiality dahil kayang kunin ni morales ang inpormasyon di ba? mga taong me dignidad ang humihiling ngayon na pumirma sila ng waiver kung talagang sila ay walang itinatago eh papayag, pero sabi ko nga 99% sa mga politico me hidden dollars.

    One of the 188 tongressman signed the waiver he is a party list representattive from kalinga-apayao, 187 and drillon, please take the lead.

    This is a step in the right direction. 

    The number of individuals involved are around 500, namely, Supreme Court Justices, all legislators and the president with his Cabinet members.

    The number is so small that it will not affect the banking system unless they hold billions of dollars altogether.

    Another step in the right direction is for the Ombudsman to initiate investigations on Drilon and Tupas. Those two legislators publicly expressed their refusals to sign the waivers and should be consider prime suspects.

    Like Corona, the Ombudsman can use the waivers of those two legislators’ SALN to get the AMLC reports.

    Since all legislators are receiving pork from the government, the Ombudsman must also secure search warrants to see if any of them are hiding the pork under their beds.

      I think to initiate preliminary investigation from the Ombudsman, one must file a case first against a government employee or official.  I know a friend who filed a case with a government official, complete with evidences and findings from COA.  Sad to note the case is yet to commence after seven years without further action from OMB. The last action done by the OMB was after required the respondents to file an answer to the allegation. (Wala na after that, despite several follow ups)  The mighty hands of the politicians and high ranking officials known to the accused are stalling the progress of the case.  It’s frustrating and expensive if you file a case against government officials.  Meanwhile, the accused enjoyed all the perks such as free legal assistance, supplies and clerical supports, transportation allowance in traveling to and from the court, etc.

        Anybody can investigate anybody as long there is no violation of rights. That is why people employ private investigators.
        The Ombudsman is powerful, she can investigate whenever there is suspicion that a crime is committed by a government officials. Theoretically, there is no necessity for a complaint.

        Well, you are correct on this score.  But, in practice its different. In my narration above, a private citizen prepared and filed a case with OMB.  And yet, OMB would not do its job.  How much more, OMB initiating a move.  Their usual problem is the lack of personnel to attend to the cases at hand.  The ideal is, let the ordinary citizen participate in the build up of cases.  Provide support to the complainant and for OMB to do timely action.

    First things first. Si TJ ang nasasakdal sa impeachment because of betrayal of public trust for not disclosing all his assets in his SALN. His call to have all the 189 others to sign a waiver before he gives his own waiver is very much misplaced and void of right reasoning. Para bang sinasabi nya na tutal marami namang magnanakaw sa gobyerno, wag nyong pakialaman ang pagnanakaw ko.if TJ is really sincere and believes that he has nothign to hide, then he should give the waiver without any condition. Siguro kun ginawa nya yun, mas makuha pa nya simpatya ng tao at mapatunayan na wala talagang tinatago. But i think sincerity is not part of TJ’s vocabulary. So his conditional waiver is just a big joke.
    On the other hand, i agree that on separate issue and independent of the impeachment proceedings, public officials should have unconditional waivers to accompany their SALN for full transparency.

    Okey let’s put this in context, Padre Damaso. You do not know your Bible. It was not the accused woman who said that. It was Christ. Here it’s the accused who is making a demand which does not approximate the Biblical situation.  

    Furthermore, if you want to apply the Biblical story to actual life, then we might as well abolish the courts because according to the Bible, every man including you is a sinner so who is qualified to go to court?

    Finally, Oscar, what is the legal basis for the preposterous demand of Corona? The time has not yet come for the ideals of Christianity to resolve secular issues. Wait until your dream of wielding political and spiritual powers is attained.

      You missed the point and context. The Bible is for Christians to follow the message of Christ. The message is about sinners throwing stones to accused sinners.

      I agree with with Bishop Cruz. The accusers should also open up their SALN and sign waivers on their deposits. 

      However since Corona is the accused in this impeachment trial, he should do it first.

      After the trial, I am one with Bishop Cruz to dare not only the accusers but all officials in the Executive, Legislative, and Judicial branches.

      In his statement, Corona already instructed the SC to disclose his SALNs from 2001 to 2011.

    This TJ Corona is the one on trial here. Not Drillon, not the 188 congressmen who signed his the article of impeachment. Dragging others is like a Robber on trial saying ok you can search my house for stolen properties on the condition that you have to search the house my victim/accuser and the Judge on this trial. What’s this? A joke? I dont know about you all but I do not have a symphaty to this scumbag regardless of his health conditions who would resort to all kind of B.S. so not to confront the judges and prosecutors. Why? Because he has nothing  in evidence to prove that he’s innocent..Simple as that. His next scripted drama will be treatment abroad because filipino doctors are incompetent and could not do what abroad doctors could..An insult to the PMA.

        yes. have you asked them? hahaha. they do not and would not need to take collections for themselves. there have allowances and kind hearted catholics are happy to provide for their priests separately. if you have proof that they take from the collection, go provide it to the media. it will be a sensational story to read.

    kahit kulayan mo man ng puti ang uwak, uwak pa rin yan…  ang magnanakaw, magnanakaw pa rin kahit anong rason meron pa sya, kung sinungaling, busalan mo man ang bibig sinungalin pa rin yan.  kung gustong buksan, bubuksan at hindi marami pang rason na wala namang katuturan.

    Papogi nanaman itong trapong senador. Bakit hihintaying pa kung sino ang mauuna? Ginagaya niya si Corona. Bakit niya tinutoro ang administrasyon na mauna? Co-equal branches sila. Dapat pagkatapos ng impeachment trial, mag set sila ng deadline na lahat sila sabay-sabay mag-sign ng waiver.

    If he is sincere, he should set an example by initiating the waiver and not initiating the pointing to someone else. Bad senator!

    Tayong mga botante, dapat ang pag sign ng waiver ang isa sa ating batayan sa susunod na election kung sino ang iboboto.

      Tama… bakit puro salita. Gawin na. Let him become the first example — o kung sino man ang opisyal na walang itinatago (o tinging nila e hindi sila mahuhuli) dapat ang magumpisa nito. Pero hindi sa salita kundi sa gawa!

    Why Niel Tupas won’t sign the waiver? lol. AS an Ilonggo  we knew what this family are been hiding. If he’s not guilty of corruption then let him sign the waiver. The Tupas family is one the most corrupt family in Iloilo and asked him too about his dad.

    OK yan. Pero yung hamon ni CJ, naghahanap nalang sya ng damay. Simulan nya muna at may reason na ang taong bayan para sumpain yung ibang hindi mag si-sign ng waiver. First thing first, si CJ muna. Then yung malilinis na mambabatas hangang kay panot.
