Warring hacienda farmers rally round Corona

BAGUIO CITY—The Supreme Court rejected with finality a bid by the family of President Benigno Aquino III to secure at least P5 billion in compensation for its Hacienda Luisita, affirming a ruling last November basing the value of the sugar plantation at around P196 million on 1989 prices.

The court voted 8-6 with one abstention in the decision described as a “litmus test” of the government resolve to implement a Comprehensive Agrarian Reform Program launched by Mr. Aquino’s mother, Corazon Aquino, after she took power following a People Power Revolution that ousted the dictator Ferdinand Marcos in 1986.

Briefing reporters in this resort capital, where the high tribunal is holding its summer session, spokesperson Midas Marquez said the court ruling was “final and executory.” He said the court would no longer entertain further pleadings and motions for reconsideration on the dispute that had taken 27 years to resolve.

The Supreme Court, sitting en banc, also ruled that the Luisita farmers may pay amortization fees for the next 30 years, according to the 1989 land values for the 4,915-hectare estate when Hacienda Luisita Inc. (HLI) struck a deal in which management offered a stock distribution option (SDO) in lieu of outright land distribution.

In a ruling last November 22, the court rescinded the SDO and voted 14-0 to distribute the hacienda.

Chief Justice Renato Corona and Associate Justices Presbitero Velasco Jr., Arturo Brion, Teresita Leonardo-de Castro, Roberto Abad, Jose Perez, Jose Mendoza and Martin Villarama Jr. voted for the 1989 valuation, Marquez said.

Voting against were Associate Justices Lucas Bersamin, Maria Lourdes Sereno, Mariano del Castillo, Diosdado Peralta, Estela Perlas-Bernabe and Bienvenido Reyes. In the Nov. 22 decision, Sereno, Mr. Aquino’s first appointee to the high tribunal, batted for a 2006 valuation, echoing the position of the HLI management.

As in previous court deliberations on Hacienda Luisita, Associate Justice Antonio Carpio inhibited himself from the case, Marquez said.

President Aquino’s spokespersons declined comment on the decision, saying it was up to the Department of Agrarian Reform and the solicitor general to issue a reaction.

Antonio Ligon, HLI spokesperson, said: “We have always believed that the purpose of the law is ultimate justice and equal rule for everyone. The application of the law in this case is no exception. The majority of the justices have spoken. HLI shall abide and will comply with what is required by the decision.”

Ligon said the farmers who decided in 1989 to acquire stocks in HLI must accept the court’s final ruling.

Tuesday’s decision dismissed HLI’s motion to clarify and reconsider its Nov. 22 ruling, which junked the SDO and ordered the distribution of land to farm workers. It set the 1989 market price for Hacienda Luisita land as a basis for computing just compensation at P40,000 per hectare, then placed at P196 million by HLI.

HLI, however, asked the court to peg the value of the land at its fair market value in 2006, when then Agrarian Reform Secretary Nasser Pangandaman issued the “notice of coverage” for the sugarcane plantation.

HLI didn’t give estate’s price

Ligon said at that time land value in the area was around P100 per hectare. That adds up to a total of P4.9 billion. But he said there were other considerations as well—income generation, productivity, among others, and that HLI had not placed a ball park figure for the entire estate up for distribution.

Lito Bais, president of the United Luisita Workers Union (Ulwu), said the value of the property was important to farmers because it would determine how much they would need to pay the government in 30 years. Bais, who went to Baguio with around 20 Ulwu members, said the decision meant that each hectare of farmland would now cost P40,000.

Members of Ulwu and the Association of Original 1989 Farmworkers of Hacienda Luisita sent their representatives to the high court’s summer compound in Baguio on Tuesday to await the decision.

Lawyer Jobert Pahilga, counsel for the Alyansa ng mga Manggagawang Bukid sa Asyenda Luisita, said the DAR must now buckle down and process the distribution of Luisita land, saying the agency could fulfill this in six months.

Pahilga also said that, while the court’s Tuesday decision should qualify as a landmark ruling, the justices still needed to qualify whether the ruling is “nunc pro tunc,” a legal term stipulating that the ruling could not be used as basis or a precedent for similar cases.

He said various courts were addressing 13 other agrarian reform cases requiring them to determine whether farmers should avail themselves of SDO, like the Hacienda Luisita farmers, before Tuesday’s ruling, or whether they should also acquire lands instead.     That’s very encouraging but how big or small is the plot each farmer will get will determine the productivity,  viability and profitability of each farmer beneficiary. Lets hope that these works well especially with some financing and technical support or we could just count the years when these lands accumulates in the hands of the very few once again defeating the very purpose of the reform.

    On another note, Corona once again shows he is a man who has no delicadeza unlike Carpio who has the decency to inhibit himself. It would not have affected the decision had the shameless Corona inhibited himself and yet he chose to be the uncouth odd man out not worthy of the chief justice or even mere justice title, LOL….

    Of course there are idiots born each day and I am sure they are hailing their idol Corona for his dense behavior, hehehe.

    As long as the farmers of Hacienda Luisita are satisfied and happy with the Supreme Court ruling, that is all it matters to me and maybe to all decent Filipinos. I just hope that this ruling is really, really final. Changing the ruling in the future like the ruling made by the Supreme Court on the case involving Philippine Airline and its employees will show cowardice and dishonesty on the part of the Justices of the Supreme Court. Mabuhay ang mga magsasaka ng Hacienda Luisita!

        He should’ve passed it last year, but revising bills takes time.  A year or two won’t make too much difference as long as the bill passed is effective.

        I think it’ll be passed this year, personally.

      Danding “stole” the money from coconut farmers thru legal hokus pocus which he got from the former dictator.

      Cory could have the whole thing declared illegal, she also had the presidential decree power which Marcos had during her first 14 months in power.

      Unfortunately, Cory did use her PD power to annul Danding’s ownership of the coconut farmers share. She also declared all Marcos PD consitutional and operative, unless declared otherwise by herself of her Congress.

      That created a legal scam which up to know our SC is struggling with. Anyway, the SC recently declared unconstitutional two EO of Estrada, Danding’s bestfriend that were favorable to Danding.

    The bias and defiance of the SC against the President is remarkably clear. I am a landowner myself and the government forced me to sell a greater part of my property but peg the mount of payment at current average of market and assessed values. I’m glad that the SC decided for the tenants but the ridiculously ancient price reference is unjust and clearly made to slight the President and without thinking about the consequences of its decision. Will one hectare of sugar land sufficiently support a family?  The experience of tenants who were awarded three hectares each says it will not. Most agrarian reform beneficiaries in our town ultimately lost their lands to usurers and left for Manila to be part of the fast-growing squatter colonies while some joined the NPA.

      HLi should have distributed the land during Marcos time. Instead they offered SDO which goes against what the CARP stands for. The reason they are getting a 1989 valuation is because that’s the time they sold the SDOs to the farmers which is now deemed illegal. Unlike the Conjuangcos, you did not sell SDO that’s why you were paid at current market price for the land that you sold. I don’t believe the government (and taxpayers) should pay 10 Billion to a family that screwed the CARP law and the farmers. I would much rather see the budget used for more important things such as building government owned powerplants for Mindanao…

    the land had been d evaluated to much for P40k/hectare? its a trap! and this ruling would be a precedent and apply to all land applicable for agrarian. many of the current tenant might owed the owner to much than the said evaluated value. sana tatagan ng mga new owner ang kapit sa title nila.. kasi saglit lang kayang bawiin yan ng dating may ari. and be hopeful na umangat sa current year value ang lupa nila pagkatapos ng land reform. i smell fish in here…

    Carpio is just consistent to inhibit himself but if he voted against the majority, it will be 8-7. Now if Corona inhibits himself first, it will be 7-7 wherein the Chief Justice have no other recourse but to vote to break the tie then it will be 8-7. 

    Aquino Adminstration should be proud of this decision because JUSTICE has finally achieved during his term for the poor farmers. Thanks to Corona!

    Good news for the farmers. It’s about time. To be fair, those who lost their land through the comprehensive agrarian reform, should make known how much they got per acre of their property. In the absence of “nunc pro tunc” it follows that such decision can be used as a stare decisis or basis for others in a similar situation. How much money did the benefeciary pay the bank per hectare of the involuntary ceding the property? What’s good for the goose is good for the gander, eh?

    We know the greedy appetite of the Cojuangcos for years.

    (If I remember it right…the hole-y PD (Presidential Decree of Marcos) on Agrarian Reform…in his own handwriting,for dramatic effect…coincidentally, is numbered, 27. 
    That PDunderwent so many implementing rules and regulatons thatjust about every piece of land under it…that is supposed to be divided among tenants/farmers…are exempt!
    So the PD didn’t do much.) 

    And now we are supposed to thank the Chef for this dish.  

    The timing is measured to earn him his own acquittal…to boost his sagging rating…to blow up his deflated stature…to energize his defense, to bulk up his excuses, to fightback against his oppressors…to erase his illegitimacy…to cover-up all the dollars & pesos squirreled  in some nests…to send out a bold message—take that and that! you miserable Pnoy!

    Taking Mr. Corona’s words—that his situation is mainly his feud between him and Mr. Aquino—-the HL farmers got the collateral benefits. 

    If the only way for us, Filipinos, to improve our lot, or to do somethingworthwhile…is to put our leaders into some power struggle, or to put at risk their lofty positions…then we ourselves better do what is best for all of us. And not rely on the next political situation to come.or when some sleazeballs are at risk of being booted out from hisgov’t position.

    Don’t you wish you were someone wielding such enormous power like giving away lands that doesn’t belong to you and to reach such decision akin to a climax beyond divinity, you dictate the price the owner (s) of the lands must accept?  You do so without as much as a wrinkle on the skin of your face all in a day’s work capping it with a toast of champagne.  I don’t know if something like this will ever happen here in the good old United States but fair loving people of this country better hope it never will.  As it all end – everything seems to be happening in a country we all call the Philippines.

    At today’s prices, to rebuild hacienda Luisita with all it’s sugar milling equipment, sugar harvesters, threshers, tillers and fleet of various tractors, dozers, payloaders, haulers, corporate offices and other capital properties etc. etc. will the amount of P196 million be enough?

    What’s next for these suddenly and miraculously land given owners what will they want next to be given to them in a silver platter?  Why not include Hacienda Luista golf course, Hacienda Luisita shopping mall and Hacienda Luisita economic zone?  They should not just stop at grabbing the vast sugar land so they can plant kamote and kamatis.  The grass are greener on the remaining pieces of properties I am sure they all deserve a part of that history without paying a cent.

    There is an equally sizeable if not bigger hacienda in Negros called Hacienda Binalbagan.  Renato C. Corona know very well who owns this vast land where farmers are also wishing for the same miracle.  What now Corona will you hear their pleas?

         You forgot explaining some of the finer details in your reply among others – how and what was the condition of the lands when government decided for the Cojuangcos to leased it for hundreds of years?  Was it already fully developed or was it not the Cojuangcos using their expertise, money, time and effort to make it one of the major exporter of sugar worldwide in the 50′s?  Were the lands already fully developed like the way it is now including the malls, economic zones, state of the art golf course etc.?  Were all these capital improvements already in place when the Cojuangcos took over?  Ang suerte naman palang maging mahirap sa Pinas?  The mahiraps suddenly owning improved vast of lands they don’t need tp pay a cent?  Saan ba puedeng ma-apply na maging isang mahirap sa Pinas?

    Imagine, if you will, how opposite the outcome of the  Hacienda Luisita case would be if justice in the Philippines were rendered by Supreme Court  on  PNoy’s say-so?  The Supreme Court decision is a strong argument for keeping  our tripartite system of government separate and equal. It would probably prop up  PNoy’s popularity rating a point or two if he  takes advantage of the Court’s popular decision  by hailing  it  as a triumph of  justice for the farmers of Hacienda Luisita.

This decision is the reason why Abnoy is so frantic in removing Corona. Whatever happens to Corona is now moot and academic, the die is cast.       As per records sa Manila RTC, ang HLI ay nilakad ni Ninoy Aquino para ipinagbili ng gobyerno ni Magsaysay kay Cojuangco Sr noong 1958. Walang ibinayad kahit piso ang mga Cojuangcos. Nilakad nila at pinayagan sila na ang kabuunang pambayad na P16million sa HLI ay uutangin nila sa gobyerno through Central Bank and GSIS at kapalit nito ay ipapamahagi ng Cojuangcos ang HLI sa mga tenants sa taong 1968. Ng dumating ang 1968 ay hindi tumupad sa kasunduan ang mga Cojuangcos sa tulong ni Ninoy Aquino at mga legal scams nila. Halimbawa, sinabi nila na walang tenants sa loob ng HLI noong 1968 kaya di nila ito maipamahagi pero ito ay isang malaking Cojuangco lie.  Kaya mula 1958-2011 ang HLI ay nagpayaman sa mga Cojuangcos gamit ang pera ng gobyerno at pawis ng mga pilipinong magsasaka.       You are not a tenant farmer of the hacienda so you cannot purchase it based on the 1989 valuation, even if you have the means to do so.

      If you want to buy hacienda lusita, you will buy it at the current market value.

      The explanation is that the farmers of the hacienda and their familty had been working for the Aquinos and Cojuangcos all their lives, so that the Aquinos are now multi millionare while the farmers are still landless.

      The hacienda should have been distributed to the farmers based on Cory’s CARP, which according to Cory herself is the centerpiece program of her administration. Unfortunately, she exempted her own hacienda from the CARP tru the stocks option scam which did not benefit the farmers at all,

      The Aquino-Cojuangcos had benefit from the land for more than 50 yrs already, without them spending a single penny to purchase the land. The money comes from the taxpayers, which the Aquinos obtained from the government with the promise that they would give the land to the farmers. It took an SC decision for them to be compelled to accomplish what they promised.

    So I take it they will parcel the land and distribute it among the farmers.  The govt will pay the Cojuangcos P196M.  The farmers will then pay each of the parceled land for 30 years.  But, they probably now have to fend for themselves for tilling the land, buying seedlings, fertilizers, preparing the harvest for the market, etc…  The question is, what if a farmer couldn’t afford to pay for 30 years?  What then?  Does the govt still own the land or can the farmer opt to sell it?  I smell something fishy. Talk about a shady deal. I thought the govt. will pay the Couangcos and in-turn distribute the land to the farmers for free. Poor farmers, they’re getting used in the guise of deliverance and justice.  The farmers sure did get justice, but I believe this is all smoke and mirrors. I could see condos and business establishments replacing sugar canes in the future.  Another grand scheme.  What a shame.

         That’s what I’m afraid of.  It’s really a set-up.  The farmers don’t realize it that by getting the 1989 valuation of about P40,000 per hectare, how much do they think can they sell that after the 10 years have elapsed?  Yeah sure it’s cheap for them, for those farmers that could afford.  But in-terms of reselling their individual land, the baseline will be at P40,000 per hectare. In the long run they’re getting screwed.  This is why I think this is really fishy.  There are big puppeteers behind this deal, and the farmers are the puppets. I feel so sorry for them.  They were better off agreeing with the stock options.  So sad!

      I also share your foresight. But we can blame it on the Agrarian Reform Law itself which provides “just compensation” to former land owners and the de facto inability of government to provide support services to make the business case of new farmer landowners viable. I will not be surprised if many of these new farmer landowners end up selling their lands which actually happened in the past cases of Agrarian Reform beneficiaries. One of the most obvious loser of this case is the decline of productivity of sugar production in the country. This makes me entertain the idea that perhaps Agrarian reform will only be successful if the political superstructure is not under democratic state. We can learn lessons from successful agrarian reform programs of Taiwan, South Korea and China when they were implemented under totalitarian regimes where states actually “expropriated” those lands and established a system of management and tenurial arrangements to make these agricultural lands productive and viable, and addressed social equity issues. However, I also heard some best practices of implementing agrarian reform in this country in the corporate farm sector in the case of Del Monte in Bukidnon.

    200 million.  that might be relevant 20 years ago.  But now? Delaying this case for more than 20 years is just a lose-lose situation for the cojuangcos and the farmers.  The cojuangcos learned their lessons the hard way.

    soon-to-be impeached Renato Corona will last. They seem to be
    very confident they can dictate their own terms to the Hacienda
    Luisita owners, the Cojuangcos.

    This lameduck Supreme Court gang days are numbered. Definitely.

    This is not saying that the Hacienda Luisita long-delayed troubles
    shouldn’t be attended to, but surely not under the leadership of
    Renato Corona and support from the rest of the Gloria Arroyo-appointed SC
    justices.

    Impeach Corona, then the virtually new SC can review the whole
    thing one more time, hopefully for the really last time with
    fairness and justice to all concerned.

      Do your post mean that your are against the distribution of the farmland to its rightful beneficiary?  Note that when the Hacienda was acquired there was an understanding that it should be distributed to its tenant after 10 years.  Now..the question is, how the clan of our President managed not to distribute for many decades since.  Her late mom did not also fulfill her promise for actual distribution?  Because of it, they lost their moral authority to fight injustices as they are their continued ownership of the vast hacienda land has became the biggest social injustice!

      Hindi nila normally ginagawa ang mamahagi ng lupa sa mga magsasaka, halos lahat nga ng mga magsasaka sa Pilipinas ay walang sariling lupa kaya marami sa kanila ay nagiging “kasama” o tenant, ang iba nangangaingin nlang samantalang ang iba ay nagiging NPA. Ang desisyon na ito ay dulot ng factional strife within sa ruling class mismo. May maganda talagang maidudulot ang mga bangayan nila at sana rumesbak nman si Pnoy para ang mga hacienda nman ng mga Arroyo ang mabigay sa mga nagsasaka nito.

        Amazing ignorance mo sa issue. HLI was legally scheduled to be distributed to the tenants noon pang 1968. Iyon ay based sa kasunduan between the government and Cojuangco Sr. HLI was given to the Cojuangcos, through the political influence of Ninoy Aquino, in 1958 without a single centavo paid by the Cojuangcos. Therefore, HLI ownership of the Cojuangcos is just a scam and not to be compared with other privately-owned lands in the Philippines. Ganid ang Cojuangco clan at patunay hindi lang sa HLI case pati na rin sa coco levy case. Naunawaan mo na ba?

      Actually, during the time that Arroyo was in government, the Arroyos gave up their land without incident. The land was valued at 30k per hectare if I am not mistaken. So there was no need for the SC to get too involved. Now, bashers will probably say, they stole more than that anyway… well, that’s another story if ever. The point is the Arroyos followed the CARP law.

    I believe all or at least a very large majority of Filipinos want the farmers to finally own their land. There is no argument there. I don’t understand all the gloating and the chest thumping.

The main responsibility of citizens is to be vigilant but hopeful. Be observant and discerning. Kung makakatulong, tumulong. Kung pupuna, pumuna nang maayos. Makinig at magbasa, pero matutong umintindi.

    Matagal na dapat ang desisyon na ito. 1968 pa dapat natapos ang kasunduan ng gobyerno at mga Cojuangco’s.  Nakitaan lang nila na malaki ang kikitain nila kung kaya’t namanipula nila na di ipamahagi ang mga lupain ng Hacienda Luisita noon 1968.  Dapat nga ang value ng lupa ay 1968 hindi 1989.
    Wala naman mawawala sa mga Cojuangco’s dito kasi wala naman silang investment dito.  Kumita pa nga sila at napakinabangan ang kita ng Hacienda na walang puhunan except their expertise in running an Hacienda.  Lahat ng makukuha nila dito ay kita na na sobra pa sa kasunduan noon 1958 to 1968 agreement.

     Oh my dear hard working Filipino farmers, I weep for you.  You have been
    used once again in the guise of a very long hard fought deliverance and
    justice that was just handed to you.  The many years of blood, sweat,
    and tears you shed toiling the land is now valued at just P40,000 per
    hectare.  P40,000 which is now the value per hectare that will be given
    to you, and which will serve as the baseline and the starting point of
    negotiations should you decide to resell your piece of land in the
    future. It’s so sad knowing that there are probably people behind the
    scenes who planned and connived for this to happen.  Folks who pretended
    to fight your battles, but unknown to you, they are the ones who will
    reap the harvest of your sacrifices.  My advice to all of you, should
    you decide to resell your piece of land is demand the highest price. 
    For it is not just a piece of land, it is a piece of your dreams and
    aspirations.  God Bless all the hardworking Filipino farmers.

      the P40,000 is 1989 value. meaning 23 years ago.
      therefore, if a farmer sells his one hectare today, 2012, it will be so much expensive.
      many times over than just P40,000.

         They’ve twisted the farmer minds. That value in 1989 is what has been paid at present 2012, which becomes the 2012 baseline.  Sure they can probably get more than the P40K if they resell it.  But it will not be as high as what the Cojuangcos wanted for it.  If you think this was done to benefit the farmers you are so naive.  The big business folks will surely start at the P40K and negotiate up instead of starting in the millions per hectare.

        I agree with John Cross. You are twisting things. Pls don’t insult the intelligence of the farmers and their counsels. And you should rejoice because instead of Billions, the government (and taxpayers) will now just shoulder Millions for the land. I don’t think the farmer’s counsels will negotiate at such a low baseline. They will bat for Current Market 2012 rates for sure. Enough with the doom and gloom.

        Current 2012 rates you say?  How much acquisition cost do you think will appear on the title/deed of sale?  It definitely will not be the 2012 value right?  Coz if it is, then the farmers will be paying taxes on top of what they have to pay in 30 years. So you can say enough of the doom and gloom all you want, but in the end reality will set in and by the time everyone knows they got royally screwed it’s too late.  Sure after 10 years if they decide to sell it, they will probably get a few millions based on some sort of appreciation from the P40k valuation.  But you and I know, they should’ve and could’ve gotten much much more.  What the government should’ve done is pay for the land at current valuation.  Give half of the sale to the Cojuangcos and give half to the farmers plus the land. In this way, the current value was recorded, plus they have the capital to continue working the land and not sell it. They could even lower the valuation a bit, but not to the P40K valuation.  By how things work in the Philippines, I won’t be surprised that this is another grand magic show of how the poor supposedly got saved but the wealthy benefits in the end. The folks behind the scenes know that these are poor folks that at some point in time will be desperate enough to sell the land. A person who’s desperate will be much more vulnerable to accept much less than another who’s not. A person who is desperate don’t have much time to wait. That’s reality.

        Are you kidding me?! You would much rather that the government (and taxpayers) pay billions rather than millions coz there is the possibility and you are speculating that the farmers will sell their land at a low valuation? If the valuation was pegged at 2006 rates, the farmers will have to pay more in real estate taxes. They won’t be able to afford the ammortization. At 1989 valuation which is what is fair, they will be able to afford the amortization and real estate taxes. And should they decide to sell their land, they can sell it at a higher market value and the sale amount will be the one reflected in the Deed of Sale. The capital gains tax can be covered by their earnings as well. Paying billions and splitting it between HLI and farmers is wishful thinking and a disservice to Filipino taxpayers.

        Are you kidding me?! You would much rather that the government (and taxpayers) pay billions instead of millions to a family who screwed the CARP law and the farmers? At 2006 valuation which the Cojuangcos were demanding, the farmers won’t be able to pay for the amortization of the land, much more the taxes. At 1989 valuation, they can afford it more. It they want to sell the property, they can sell it at Fair Market Value at 2012 valuation even. For your info, Fair Market Value is the rate which the seller and buyer agrees to. It is not the deed of sale rate. So if the farmer wants to sell, they can look for a property appraiser who can provide a good estimate at 2012 rates. You have a weird and baliktad logic.

We have to make sure that they succeed otherwise might as well scrap the land reform program and replace it with something which will truly make the farmers succeed.

    I think the way Corona handled the Hacienda Luisita case was wrong and vindictive.
     
    Distributing the land to the farmers as per agrarian reform must happen just like what the rest of land owners in the country did including my Dad. I totally agree with that to maximize productivity and also take care of our under privilege countrymen. But the just compensation is not really justified because it was so influence by personal vengeance which is divisive and corrupt.
     
    Payment of land subjected to the government program must be based on market value or a little bit closer.  If the farmers cannot afford, then the government must subsidise the program and give it to the farmers with nothing more to pay considering that land reform are government initiative after all. And if it’s paid by the government we can add a caption in their land title that the land cannot be resold but can be transferred to the next of kin, otherwise the prospect of selling the property for a million pesos or more per hectare the next day is hard to resist (human nature).  We are all Filipinos and common sense must prevail.
     
    The implementation of the law is highly manipulated by personal issues and not by good and honest judgement. Corona, Arroyo and cohorts don’t truly look after our poor farmers but they were waging a political vendetta to get back to the late Corazon Aquino who went against the political band wagon of Gloria Arroyo and was at the forefront of the movement seeking for Arroyo’s resignation. That’s a common knowledge amongst us Filipinos. Renato Corona with the power bestowed on him by the people carry out the plot and extract revenge. He could have done better by making it fair to both parties so everybody can move on happy and help improve the country.

      First of all, Corona is not the only one who voted. He is but one vote. Secondly, the valuation was pegged at 1989 rates because that was the time HLI sold SDOs to the farmers, instead of land, which has now been deemed as an illegal act. Did your dad sell SDOs instead of land? He got to sell at current market price coz he most likely didn’t screw the CARP law. But the Conjuangcos did and now it’s payback time.

      Anybody who will believe you is definitely stupid. HLI belongs to the tenants since year 1968. It is stupidly ignorant to write a long post on the issue yet not knowing that the Cojuangcos never owned the land in the first place. In 1958, HLI was given by the Magsaysay government, thhrough the influence of Ninoy Aquino, to Cojuangco Sr with no money paid by the Cojuangcos. The Central Bank and GSIS paid the government but on the condition that the Cojuangcos would distribute HLI to the tenants after 10 years (year 1968). But in 1968, hindi ibinigay ng Cojuangcos ang lupa sa magsasaka using legal maneuvers and political influences sa tulong ni Ninoy Aquino.  Ang hinihinging social justice laban sa panloloko ng angkan ni Pnoy as regards sa HLI case ay hindi nag-ugat kay Arroyo o Corona. Kaya walang relevance ang opinion mo.

    I am happy with the SC decision because the Hacienda Luisita was never owned by the Cojuangco in the first place. IT was bought using government money and was supposed to be turned over to the farmers after 10 years. While my vote is for the decision, IT DOESN’T MEAN I AM A CORONA FAN. I still believe Corona should be jailed along with GMA for plundering the country and appointing Corona to ensure that she and her family gets away with their crimes.

    He hehe! This is a triamp between good and evil. Good prevailed. How I wish that SC also favored the Federation  of Coconut Farmers who were cheated on their Coco Levy Funds. Imagine, you are the manager of the corporation, then you took advantage of the funds which were entrusted to you and invest it in your personal capacity. This is morally wrong. You have no right to take advantage of your position to divert the funds as personal loan because there is conflict of interest. “Kung baga, bantay salakay ang nganyari ” In the same token those board members of SSS who got direct benefit in the investment of member’s funds and reap the gain for your personal benefit is wrong. This happened in SSS. 

    It is always the Filipino people who are in the loosing end when ever this Chinese in our government who takes hold of funds  entrusted to them or under their custody violated their role as caretaker and profit in these investments. Chinese should never have been allowed any role in our government as their loyalty and honesty is under question.

      BGEI has nothing to do with the impeachment.
      FASAP claims the decision favoring them was reversed when the issue they are tackling is just about whether to accept another motion for reconsideration. There was no flip flopping of any sort.All of these are baseless and impertinent accusation from an impertinent president.

      HLI has already announced that they will attempt to get more than the 196 million by filing contentions at the RTC level. That will still be brought up to the Supreme Court when the time comes and Corona will still be there to make sure the Law is implemented.

    i’m with everybody whose stand is to distribute Luisita land to all farmers…it’s because of the existence of the CARP law that mandates this.

    buti na lang, walang ganito sa labor laws natin…kasi, following the same logic and analysis, it would mean a worker would have a certian percentage of ownership in the company for serving more than 20 years..labor union would be enough…

    however, i find it really odd that SC set the price at 1989 (P40K per hectare), reasoning out that it’s the year when SDO plan was implemented…

    it’s a direct violation of the basic principles of real estate…no wonder, many foreign investors would now be hesitant to invest in land dev’t projects upon knowing this…poor Philippines…

    sana, ganito ang ginawa ng SC:

    a. we recognize the current (or say 2006) valuation of the land at P1 Million per hectare.. however, in the spirit of CARP law, and to grant social justice to all the farmers to own the land they till from the time they learn how to read and write, we hereby set the valuation at 4% of the current value, given the aforementioned statement.

    OR,

    b. simply set the price at P100K, which is 10% of the 2006 land valuation, again using the aforementioned statement (social justice).

      Very well said Sir, nevertheless the mentality of investors investing in whatever industry here is quite different from farmers getting their share of the land through the provisions  under the CARL.

      Secondly, those 8 justices are right in interpreting the provision of CARL considering that when HLI was placed under CARP in 1989, Cory’s friends insert an SDO provision in CARL, which the SC finds unlawful in a vote of 14-0. So effectively the compensation should be reckoned in 1989 when the land was placed under the coverage of CARP and not 2006 as proposed by AJ Sereno et al…..

      Finally, our labor conditions and existing labor laws are far different form the farm tenants and agrarian laws. So you don’t have to worry about employees owning the companies they worked for 20 years, unless the company is magnanimous enough to provide an stock option program for their workers…

    Since the GSIS loan contract manifests that the land should be distributed at “affordable price” ten years after buying Luisita, the real value should be pegged at the land value in the sixties, not 30 years later. And correctly, the farmers should maybe be compensated for the profits HLI made during the decades of using their land. Moreover, since reportedly the GSIS loan was never repaid, Luisita anyeay belongs to the government.

    Now is the time for the HLI farmer beneficiaries to form a SINGLE coop for
    all them, to make the production output of the distributed land as one.

    They should learn the lessons from the Roxas sugarland in Batangas and the other sugar land haciendas in Negros, where the FBs go on their own way, making piece-meal production adversely affecting the sugar industry.

    Do not be enticed by greedy land developers into converting your lands into other uses….because at the end, you FBs are going to suffer not those land developers…

    The farmers should decide in advance if they want to be part of an coop or just use their land for their own living. With over 8000 sqm per family, it is easy possible, have own veggies, raising pigs and chicken for sale etc. Depending on that, they should choose the location because most of them would not like to stay anymore ta their small hoses. And fo a plantation which is kilometers big, they need machinery which hardly they can afford and a professional management which they  do not have. Even HLI ended up with needed credits of 2 billion to survive, which they wanted to be put over to the farmers, even they just take land and not the HLI company. But due to the usual habit, very likely the sugar will soon no be a matter anymore there.

      First, the family NEVER demanded 10 billion Pesos. It was just arounf Php 5B because the land was valued at Php1M per hectare in 2006. Gahd, people, pauli-ulit. ALAMIN NIYO NGA MUNA KUNG ANO YUNG MGA SINASABI NINYO. 

      Second, when you said “safe na ang mga magsasaka” dahil nag decide na ang SC ng ganito, did it not cross your measly little brain that it still will be a very long and tedious process before the lands really get distributed to the FWB? Dati nang problema ng gobyerno natin ang tamang implementation. What makes you think this would be any different?

      Third, after the lands get distributed, did you not ever think about the obstacles the farmers would encounter with regard to funding their own farms, such as fertilizers, farming equipment, irrigation, etc. knowing that most, if not all of them do not have the financial capability for those?  

      Think about it. May utak ka naman siguro, why don’t you try using it for once?

For 2012 PH will only register a 4.2% growth and for 2013 it will only be 4.7% making these the lowest in the region, and lower than the median growth in the region which will be at 5.6%.

      So many reasons, aside from corruption…
      Countries like Indonesia, Malaysia and Brunei, even Vietnam, enjoy healthy oil producing industries.  We can’t control our oil resources – if we do, we only retain 10% of the oil revenues from the wells.Countries like HK, Singapore and Taiwan have strong exports.China and Thailand have cheaper rates so more foreign investments go there.We also lack the political will to do what we need to do because we are a democracy compared to China and Singapore. Basically, we lack competitiveness when it comes to high-value goods and services.  We only assemble components wherein other countries sell consumer goods, we import so we our balance of payments are at a disadvantage.  Even the call center industry it mostly low value, low skilled while India gets the high-value, high skilled jobs.   We have no manufacturing or steel industry to speak of except if its owned by foreign companies.  Our trade unions make us uncompetitive to other labor markets.Our high-rates of power, fuel and water are the highest in the region, if we have the power at all to handle expansion.

      But do not worry because slow development is sometimes better than too fast development.  At least we still have beautiful islands and waters.

    Did the original agreement stipulate a payment to the Cojuangcos when the land was to be distributed 10 years later?  No.  But they even were able to extend the distribution several decades later, in violation of the agreement.  Why should they get paid now and be rewarded for reneging on an agreement,  on top of the great benefits the Cojuangcos unduly reaped over the past decades?

The State shall apply the principles of agrarian reform or stewardship, whenever applicable in accordance with law, in the disposition or utilization of other natural resources, including lands of the public domain under lease or concession suitable to agriculture, subject to prior rights, homestead rights of small settlers, and the rights of indigenous communities to their ancestral lands.
        The State may resettle landless farmers and farmworkers in its own agricultural estates which shall be distributed to them in the manner provided by law.
        Section 7. The State shall protect the rights of subsistence fishermen, especially of local communities, to the preferential use of the communal marine and fishing resources, both inland and offshore. It shall provide support to such fishermen through appropriate technology and research, adequate financial, production, and marketing assistance, and other services. The State shall also protect, develop, and conserve such resources. The protection shall extend to offshore fishing grounds of subsistence fishermen against foreign intrusion. Fishworkers shall receive a just share from their labor in the utilization of marine and fishing resources.
        Section 8. The State shall provide incentives to landowners to invest the proceeds of the agrarian reform program to promote industrialization, employment creation, and privatization of public sector enterprises. Financial instruments used as payment for their lands shall be honored as equity in enterprises of their choice.

Technically, by 1968 the Cojuangco’s ceased to be owners of the land, mga tenants/farmers na dapat. Pumayag sila sa agreement e. Now, balik tayo sa analogy mo. Bibili ka ng bahay, mangugutang ka sa gobyerno para mabili ito but on a condition na ibibigay mo to sa kasambahay mo after 10 years. Kung ayaw mo ng terms, di wag mo. Now, kung pumayag ka then you should live with the fact that the house you bought on loan is just temporarily yours. Yun ang katotohanan sa usapin ng HLI.

    40,000 pesos per hectare of land? Cemetery lot cost even much more than that! To be fair, at least it should calculate the present value using the 40,000 1989 value.

    P40,000 in 1989 should cost about future value of P270,270 per hectare in 20 years which is 2009.

    Yes, so that Filipinos will eat the fruit of the  truth. 

    Now, SC decision on HL should also be applied to all agrarian cases particularly on large haciendas in Negros, Iloilo, Laguna, and some parts in Mindanao. 

    I believe the “valuation formula” has no justice for the Cojuangcos. The SC decision is tainted with “personal touch.”  Corona is five moves ahead. Immediately after the promulgation, Corona issued a statement of possible immediate retaliation from P-Noy. 

    While P-Noy was saying his interest in HL is only 1%, Corona’s camp is trying to project a full blown issue as denomination for the impeachment cases against him. 

    It all started with the midnight appointment. Had P-Noy did not honor Gloria’s appointment of Corona we won’t have this kind of problem. Corona’s midnight appointment was like “a thief in the night.”

    P-Noy should have had appointed a new SC Chief Justice immediately upon assuming the presidency if he thinks it is legal and if he thinks Corona’s appointment was illegal.

      You are absolutely right. The thing is everyone knows including Aquino himself that the appointment of Corona is legal.

      With the ruling of 8 – 6, the vote of one justice is crucial. IF CJ Corona voted for the Aquinos, it would have been 7 – 7 which mean no decision.

      My prediction is that Noynoy would do everything to impeach Corona and appoint his own SC justice.

      He will use the impeachment issue to reopen the case.

      With a newly added pro aquino magistrate, the voting would be 7 – 7

      This might require Justice Carpio, Aquino’s former lawyer who inhibited himself to vote to break the tie.

      The result is that the Aquino Cojuangcos will keep the hacienda forever

    Sa mga panginoong may-lupa ng hasyenda luisita: wag mawalan ng pag-asa, mahahabol pa yan. Kunin nyo si titong mendoza bilang abugado. Walang final-final o executory dun. ;-) 

    Sa mga magsasaka: ito ang tinatawag na law of unintended consequences. Nagsabong ang mga may kapangyarihan, masa ang nakinabang.

    UNFAIR po yata ang price. for the simple reason,,, noon po walang halaga ang lupa at pinapamigay lang. to give you an example,,1989 beach selling here in our province was 20,000 pesos per 1000 sq. meter ngayon po selling price is 1 million pesos per 1000 sq. meter.

      It is because the hacienda was purched by the Aquinos using taxpayers money.

      They should have given the land to the farmers 40 years ago, but because of their political influence, they managed to keep the land and make money from the land for 40 yrs.

      The Aquinos should not received even a single cent for the land that does not belong to them – the problem is that UNDER CORY’S  COMPREHSIVE AGRARIAN REFORM, THEY ARE ENTITLED FOR A JUST COMPENSATION.

      What is a just compensation for a land that you do not own?

        I think, technically, they own it kasi I’ve read somewhere (I’m sorry I forget the title of the article but I’ll search for it for the purpose of credibility) that they’ve already paid decades ago what they owed from GSIS and Central Bank and other government offices when they borrowed money to purchase the azucarera.

        So, is it not fair that they get paid for selling their property? I mean, yeah, they may give a sort of discount since it’s the farmers (through the financial assistance of the government) who’s “buying” it from them, but I think P40K per hectare is just too little.

        Hacienda Luisita was purchased using a behest loan under the agreement that the land will be distributed to the tenants after 10 years. So even if the Cojuangcos paid off their debt, they still don’t own the land because they should abide with the agreement with the government.

        it was not enough that the cojuancos have paid…THERE IS ANOTHER CONDITION THAT THE COJUANCOS MUST RETURN IT AFTER 10 YEARS…HENCE, IT MUST RETURN TO THE FARMERS LAST 1968…which, unfortunately hindi nila ginawa….

        i want to ask you a question,, are you born 50 plus years ago? if your age now is more than 50, maybe you have heard that land in the 1950s or 40s has no or lttle value. if then, 50 0r 70 years ago land has no value, and your forefathers did not buy any land because it has no value, but the conjancos coming from china knew in the future, in 100 years land will be valuable and buy that land, what is the problem?
        maybe you have heard that some spanish conquestadores relinguish their land when the americans came to imposed heavy taxes,, because they do not want to pay real taxes although these conquestadores knew from spain that in the future land will be valuable.
        my point is they acquire the land while it is no value, and now when the land is at high price everybody is interested to buy the land at low price,, so where is fairness?

    It’s the price. It comes down to about P4 per square meter! That is exceedingly unfair. Even a landfill is priced higher than that.

         It makes perfect sense to base it on 1989 prices which is P40,000. That is the year Cory thought up the unconstitutional sdo program. The Cojuangcos should be happy that it wasn’t based on 1967 prices, which is the year they were supposed to give up the land based on the original agreement.

    pinatakbo ka ng angkan para mapanatili ninyo ang hacienda, pero talo na kayo…sumbat at sipa ang aabutin nmo kay peping at danding…

    remember, MALAKI ang ginastos ng angkan mo nuong eleksyon para manalo ka….umabot ng isang bilyon…so, ung puhunan nila, nawala na parang bula…they were expecting a 10 billion payment…but now it is just 196 million…malaking kalugihan ikaw sa kanila…hindi man lang napantay ung gastos nila sayo…so, resign na….nag nononoynoying lang ikaw diyan sa palasyo…tapos ka na ba mag playstation kasama si JASH???

    dapat saysayin ng maigi saan ba talaga nanggaling ang lupa. ibig kong sabihin sino sino ang mayari. 100 years ago palagay ko karamihan diyan ay public land. i think it is UNFAIR to pegged the price at 1989 valuation. why? because during that time, land is of no value. now, because of the money of the OFW the price of land becomes high. the way i see it, the price of today is multiply by 50 times.
