‘Wah’ happened! Miriam Santiago goes ballistic

EARFUL An irate Sen. Private prosecutor Vitaliano Aguirre had had enough of Senator Miriam Defensor-Santiago and had the guts to stand up to her.

In a hearing marked by high drama, Aguirre covered his ears with his hands while the prosecution panel was receiving yet another a tongue-lashing from Santiago, this time for its sudden decision on Tuesday to rest its case against Chief Justice Renato Corona.

For that “contemptuous” behavior, Aguirre earned the ire of not just Santiago but the entire Senate impeachment court, which cited him in contempt on Day 26 of the impeachment trial, ironically a day after the prosecution had rested its case.

“I charge this private prosecutor with contempt of this impeachment court! I have evidence right here taken by Senator Alan Peter Cayetano, and to say that nasaktan ang tenga ko (my ears hurt) should have been (a cause) for you to walk out of this impeachment court. But you cannot make those contemptuous gestures in front of a judge, and get away with it,” Santiago declared.

Cayetano himself took the picture using his cellular phone camera.

Santiago made the motion to cite Aguirre in contempt soon after the volunteer lawyer candidly admitted to the impeachment court that he did cover his ears.

“That’s true because my ears already hurt,” Aguirre said, while being questioned by Senate President Pro Tempore Jose “Jinggoy” Estrada.

Estrada had inquired into Aguirre’s motive for publicly displaying his disdain for Santiago.

“It seemed that you don’t want to listen to her,” Estrada said. “That’s disrespect for a member of this court.”

Aguirre argued that he had to cover his ears because he did not agree with Santiago’s position that it was not usual for lawyers to withdraw, or amend their complaints.

“This happens every day. The fact is that this is the first time that I experienced in my 40 years of practice that a judge would lecture his lawyers. That’s not proper,” Aguirre said.

All about respect

Told by Estrada that he should have objected to Santiago’s manifestation, Aguirre retorted that he had “no right to object.”

Under the Senate rules, private prosecutors are under the supervision of the prosecution panel and can not debate with the senators.

Aguirre said: “May I say something? If my actuation has hurt somebody, I really did it purposely because my ears were hurting from her shrill voice. My point here is that even if we’re mere lawyers, we also deserve respect. If you demand respect, respect also these lawyers because human dignity has no equal.”

After the hearing, Santiago, whose blood pressure shot up to 190/90, said it was Aguirre’s problem how to deal with the citation. Citing her colleagues, she said Aguirre had been calling attention to himself during the hearing.

“I’m too old to take this thing personally. I think he has just a mental disorder. A lawyer will never, never aggravate the judge,” she said. “Maybe he just wanted the prosecution to lose, or to publicize himself.”

She said she was “happy” that the senator-judges were unanimous in citing Aguirre for contempt.

Part of ‘dirty tricks’

In a statement later, Santiago said it appeared that Aguirre might have been “planted” to provoke her and raise her hypertension to a higher level, “precipitating either a stroke or a heart attack.”

Quoting her staff, she said that Aguirre had always been seated in the gallery until Wednesday, and “would always sneer at me very loudly.”

“All of a sudden, he sat smack dab in the middle of the front row of the prosecution panel,” she said.

“With these tactics, the usual suspects are up to their dirty tricks,” she said.

At the trial, Santiago twice took the rostrum to blast the prosecution over the withdrawal of five of eight articles of impeachment and their manifestation to make their formal offer of evidence within three days. In both instances, Aguirre, who was seated in the row of the prosecution table, was seen covering his ears with both hands.

“I should be recognized first by this honorable impeachment court to state what I feel. But since I’m already here, I will say what I feel.”

At this point, an angry Santiago reiterated her motion for contempt.

“Imagine if all the lawyers did that in front of the impeachment court, if all of the senator-judges took the (floor) to express his opinions … (if) you don’t agree with (us) then don’t listen to us, get out of the courtroom!” said Santiago, a former trial judge known for berating lawyers who did not measure up to her courtroom expectations.

Aguirre swiftly replied: “I was about to leave but …”

“Granted!” Santiago roared. “If that is in the form of a motion, go ahead! You’re challenging me!”

Penalty: Miriam’s speeches

Senate President Juan Ponce Enrile pleaded for the parties to remain “calm in this proceeding and deal with one another in a fashion that will not a create an impression before the people that we are not following the rules.”

Before things got out of hand, Enrile banged the gavel to suspend the session.

But seething with anger, Santiago strode toward Aguirre and confronted him.

“What?” Santiago taunted him, her eyes fixed on Aguirre for a few minutes.

At this point, prosecutors and senators restrained the two.

Aguirre was ushered out of the courtroom by House staff members, while Santiago stayed in her seat during the long suspension in the trial, alternately talking with Senators Alan Peter and Pia Cayetano, Loren Legarda, Vicente Sotto III and Estrada.

Sotto, the majority leader, later told the Philippine Daily Inquirer that the senators would take up the penalty to be imposed on Aguirre in a caucus on Tuesday.

“I don’t know if this is serious or not but it is being suggested by Senators Francis Escudero and Panfilo Lacson that we place attorney Aguirre in a room in front of a television set playing the videotape of one of Miriam’s privilege speeches.”

Sotto said he was not kidding because “it’s being suggested, with a request that Aguirre would not be allowed to cover his ears.”

Frivolous and sham

Before the face-off with Aguirre, Santiago slammed the prosecutors for airing charges that they now refuse to prove, saying that they had compromised Corona’s “moral position.”

“I am terribly concerned that this might constitute unethical behavior in this trial court,” she said.

“We have a term of art—‘frivolous and sham’—that can be taken in its technical meaning. A frivolous claim refers to a motion or lawsuit motivated by intent merely to harass, delay or embarrass the opposition. The claim must have no arguable basis in law or in fact,” she explained.

Santiago wondered whether prosecutors “acted in good faith” when they told the impeachment court in a legal compliance submitted in January that they would present evidence and witnesses for eight articles.

“Because now you turn around and say you don’t want to do that,” she noted.

Santiago said some colleagues had read and studied all eight articles in fulfillment of their functions as senator-judges.

“That’s what the law calls frivolous when you say ‘I don’t want to present evidence on eight, I only want to present evidence on five.’ Let me remind you gentlemen, the lawyer’s oath: I will do no falsehood, not promote or sue any groundless, false or unlawful suit or aid or consent to the same,” she said.

Continuing habit

Santiago said that her suspicion was bolstered by the prosecution panel’s continuing habit of announcing to media that its evidence can already prove Corona’s guilt.

“I am very concerned that the prosecution has been acting in bad faith all along because you tell so many things to media when you can file an official manifestation in this court. You insist you are already winning the court battle because you have proof beyond reasonable doubt. Good grief, that is contempt of court,” she said.

Santiago reiterated an earlier charge that the prosecution’s discussion in press conferences of charges they planned to prove was a case of trial by publicity and was a clear prejudgment of Corona’s case.

‘Gago’

Wednesday’s action-packed hearing was heralded by Santiago’s manifestation virulently attacking the prosecution for dropping five of the eight articles of impeachment against Corona.

She spewed out highly unpleasant remarks, but the House lead prosecutor, Iloilo Representative Niel Tupas Jr., meekly held his peace throughout the tense trial.

“I felt like creeping back into bed and adopting a fetal position, which is the normal reaction of any sane person when he’s faced with a world that is crumbling around him. I no longer know what universe I’m in … because I’ve never seen this done to a judge before,” Santiago said.

She blasted the prosecution, calling it names such as the offensive word, “gago.”

How do you spell ‘wah?’

Upon a motion from the House deputy lead prosecutor, Ilocos Norte Representative Rodolfo Fariñas, this unparliamentary remark was later stricken from the record, with no objection from Santiago herself.

Scolding the prosecution, the senator said the prosecution was “playing games” with senator-judges in dropping the five articles after promising earlier to present about 100 witnesses.

“I was not born yesterday. We will be studied generations from now. This is a travesty. I request the secretariat to record in the journal that I said, ‘Wah!’” she said.

Santiago repeated this expression three times.

After the blast, Sotto said that Senator Serge Osmeña had asked, “What’s the spelling of ‘Wah?’”

No one asked Santiago what that term of endearment was all about.

I’m not a fan of the president but I know a wrong when I see it, and I condemn Miriam and the rest of this disgusting senate based on their behavior, not about who they’re aligned with or if they support the president or not.

    The senators, particularly Senate President Enrile, are evidently afraid to tangle with Santiago as demonstrated by their continued silence over her rantings and odious behavior in the trial. They were quick in citing Atty. Aguirre in contempt for simply refusing to listen to her tirades. But the senators have not acted on a pending resolution to cite in contempt the defense lawyers for alleging that they were bribed P100 million each to side with the prosecution. Talk about fairness! I’m so disappointed and disheartened by the behavior of our so-called distinguished senators.

    I agree with Senator Santiago. The court should not allow the
    prosecutors to drop the rest of the case. I will not even allow them to
    amend the complaint as what Senator Escudero was saying, not now in the
    middle of the trial. They had already made so much publicity out of
    it. The prosecution started this, they should finish it. If they can’t
    be diligent to the task that they themselves created and assigned to
    themselves (and with the help of 60 private prosecutors all paid by tax
    payers money) and can’t even finish what they started, do you think they
    can do and finish something for their constituents?

    188 prosecutor-congressmen and their staff being paid by taxpayers money can not do their job diligently and cannot finish it.

    60 private prosecutors also being paid by tax payers money cannot even
    produce credible evidences and witnesses. What are they doing? What are
    they’re being paid for? Were they hired to help the prosecution or they
    were appointed by Aquino because these 60 private prosecutors are his
    friends and schoolmates at Ateneo? Like Erap, who gave P1 million
    “balato” to Noynoy’s aunt Tessie Aquino-Oreta and Osmena that later on
    Cardinal Sin lamented by saying “Why give 1 million to those who don’t
    need it?”

Nobody dare cross your path dahil ugali mong sumigaw at manghiya ng tao. You have to learn to control your temper. Anger Management is what you need. You did the same thing with Betina Aboitiz during the Erap Impeachment. you often said you blood pressure shoots up when you are angry.. sino ba ang doctor mo? bakit hindi ka bigyan ng kalmadura to calm you down. ganyan ba ka importante ang position mo sa senado to disregard your health. Ingat ka Madame… you might meet the Lord faster than you think. relax ka lang.

    This is the same court that wanted the 100 witnesses of the prosecutors to be presented?  Yet, when they do, as soon as engineer Cuevas speak to object as to the relevance of the witness sitting in court i.e., PAL’s executives, they are dismissed?  Engineer Cuevas had been criticizing the impeachment petitions filed by the prosecutors from day 1.  Now that they have decided to drop other charges mainly due to their witnesses being barred or their charges questioned continuously by senator judges, they are also being berated?  It has reached a point whatever they do they get it from both sides.

    My only regret is, in what could be the practical protest coming from these prosecutors in the manner they are constantly getting insulted is walking out leaving the matter of Renato C. Corona’s fate in the hands of the senators and defense team who are into acquitting him anyway?

    Kasalanan lahat yan ni Enrile dahil pinapayagan niyang bastusin ng pinakabastos na senadora ang prosecution.  Makikita mo sa Video tape na tumatawa pa si Enrile nang nagmumura si Brenda.  Moro moro na ang prosesong ito.  Matagal na nilang ginagawa ang demolition job na ito para mawala ang tingin ng bansa sa mga ebidensiya ng prosekusyon.  Nasa sa taong bayan ang huling desisyon.  Ipagdasal natin na ang katotohanan ang magwagi.

    Senator Judge Miriam Santiago has all the rights to criticize, lecture and lambast whoever she wants in the court room.  Sa lahat ng senador na nakaupo ngayon, si Sen Miriam ang may pinaka malawak na experience sa trial court at di hamak naman na may karapatan sya mag lecture lalo na sa mga blunders ng prosecution or kahit defense.  Again kahit na Congressmen ang mga prosecutors bottom line, pag nasa impeachment court ka na prosecutors ka na lang din.  kaya all you have to do is listen to the senator judges and para di ka masabon ay palakasin nyo at ayusin ung kaso nyo para mapakita nyo na ung lecture ay di nararapat.  eh all this time puro mali naman talaga since day one. its all about fishing expedition and trial by publicity. lalo na ung mga spokesperson ng prosecution na puro angas lang pero pag dating sa loob ung mga prosecution puro blunders lang. Tska planted naman talaga ung si aguirre may basbas ng mga prosecutors un na umasta si aguirre para malihis ung pag lecture sa kanila.

        As far as I know, lecturing happens inside classrooms and not on formal hearings. Should the judge lecture anybody, it should be done professionally and with respect to the honor of person being lectured. But Meriam showed no respect at anybody at all. She reaped what she sow.

      Had her fellow senator judges think about this? Here in the US matagal nang pinaimbestigahan ang utak niyan. She has that symptoms, even my 15 year old grandson knows that a bipolar person have a sudden change of personality, in one moment from sad to happy & also from mad to normal. I saw it from the trial yesterday, from her blast of anger then suddenly smilling on her seat. She should behave properly, in order for people not to misinterpret her as bipolar ( sa tagalog loka loka )

    I have been attending court hearings in different regional trial courts in Metro Manila and Region IV for more than 10 years.  Judges would lecture lawyers.  I have seen actions and heard tongue-lashing worse than Sen. Santiago but I have never seen a lawyer insulted a judge inside the courtroom. 

    True, we are all human beings with equal rights but we all play different roles in our civil society for a specific situation and time.  The judge will always have the higher authority over the lawyers.  Then lawyer have no choice but to give due respect to the judge (even if he’s undeserving) while inside the courtroom.  

    Walang pinagkaiba sa loob ng isang tahanan, kung saan ang magulang ang judge at ang mga anak ay ang lawyer.  Walang karapatang ang isang anak na bastusin ang kanyang magulang habang nagsesermon ito, kahit pa sa tingin ng anak ay mali ang sinasabi ng kanyang magulang.

        In “Atty. Ricon vs. Judge Marquez of the RTC Br. 40, Manila” (A.M. No. RTJ-10-2253.  December 8, 2010)—-

        “. . . .Judge Marquez set a meeting with the staff of Branch 39 and Judge Sablan. The first thing Judge Marquez asked at the meeting was who among the staff had already rendered five (5) years of service in the government. Most of the staff proudly raised their hands, but they felt insulted when Judge Marquez said that employees who have been in the public service for five years are “corrupt, G A G O, tamad at makakapal ang mga mukha.”

        The Supreme Court imposed a FINE of One Thousand Pesos (P1,000.00) on Judge Placido C. Marquez of the Regional Trial Court, Branch 40, Manila, for using vulgar, inappropriate and improper language.

        And that was not even in a court hearing. Only in a meeting of the Judge with his staff.

        The point is that a Judge courts graver penalties if he resorts to the kind of language that Madam Sen. Santiago used if the same is directed at a lawyer in open court or in the presence of the public.

    Atty. Aguirre action is respectable, rather that stand-up, walk-out and attract attention from the public. He didn’t distract Mirriam insulting and derogatory speech, it was Jingoy. They should held Jingoy of comtemp, he was the main culprit who created comotion and chaos in the investigation (not trial). Jinggoy should just let Mirriam finish his speech, before bringing out his observation…but, better he just keep quiet. They all senatong want “epals” including Mirriam D’Bastos.

    It is also good this happen, Mirriam got her medicine…”Do unto others, if you want others do unto you”…Kaya lang mas disente yung ginawa ni Aguirre (very honorable).

    On the one hand, I understand the private prosecutor.  The shrilling voice, superiority complex and grandstanding of the senator judge is almost an unbearable combination, not to mention the cussing.  But nevertheless, the court room should be respected and so I fully agree with the senate on its contempt citation.  Hooray for the presiding officer.

    The contemptuous action of private prosecutor Vitallano Aguirre was uncalled for to say the least. His disrespect was not toward senator-judge Miriam Santiago Defensor alone but to the impeachment court as a whole. If high respect is accorded to a municipal judge in a sala, how much more respect should be shown toward an impeachment court. The court is not in equal footing with an individual lawyer or group of lawyers appearing before it.

    The prosecution in the CJ Corona impeachment has flip flopped again and again. It presented to the public in national TV 45 property acquired by CJ Corona but said it can present only 21. It submitted 8 articles of impeachment but said it will settle for 3. It said it has 100 plus witnesses to present, but said it has only about 25. The thing they accused  CJ Corona is the very same thing they are doing. Consistency, what a jewel!

        The court is not in the same pedestal with litigants. In the military, a superior officer has the right to bark orders to his subordinates. The officer can either effect oral or physical discipline which may not be to the liking of the subordinate. In the courts, the judges may sermonize, lecture the litigants (of course, short of spewing bad-taste words). In such a case, the least the litigants should do is to graciously proffer to strike out hideous remarks by the judge, just like what Cong. Farinas did with the impeachment court.

    If Miriam can be allowed to disrespect every person that crosses or disagrees with her, i see no reason why Aguirre should not be allowed to express his feelings regarding it. Respect begets respect. Disrespect begets disrespect.

    I’d feel for Miriam only if she has shown respect towards others, even if she knows that she is right. Otherwise, she can’t be onion-skinned about it.

    Also, I don’t agree that judges should be accorded a ‘more-than-usual respect,’ similar with the other public officers. This mentality that they are better than the others, or deserve privileges more than that enjoyed by the general population due to their position in the government perpetuates and reinforces abuse by government officials over their position.

    Congressman Tupaz should also be charged with contempt for snickering while Sen. Judge Miriam Santiago was delivering her speech! While I agree that uttering the word g-g- is unstately for a judge, lawyers do have a code of conduct to follow. They can’t openly, in this case on national TV, show their disapproval.

    What Senator Miriam did everyday was to lambaste the Prosecution for all the things they did. I cannot fault Atty. Aguirre for his reaction. It is really degrading to hear a Senator of the country lecturing you on how to do your job, the job that Atty. Aguirre has been doing for the past 40 years! 

    After her tirade, she hides behind her hypertension, so that people will shift their support to her? I hope that those who voted for Sen. Miriam will now wake up and not give in to the “entertainment” factor that she displays every time in the august hall of the Senate. 

    We all know there are other entertainers there that do not malign or humiliate people. Such behavior belongs to “stand-up comedians” that are paid to do that, which I think is not included in the Job Description of a Senator, the last time I looked.

      If the prosecutors only did their job (i.e, preparation), they wouldn’t have been getting all these flak from not just Sen. Miriam, i think even Enrile, and many senator judges have had their turns in lecturing the prosecution! Now try to compare this impeachment with the one with Erap in 2000. Santiago and many other senators were also there but none of these had to happen back then. And thats because the Prosecution led by then Cong. Joker knew exactly what they were doing and they did a superb job.

    Too much drama in the senate. Unfortunately, it’s making me sick. What is happening in there is so disgusting. Pretending to have a rule of court but seems there is none. To be respectful seems to be out of the blue! The problem is its from one of our senator judges. Insulting and offensive words are  part of her litany. Senator Enrile, kung pagsasabihan po ninyo ang prosekusyon, pakisama na rin ang kapwa ninyo senador na ang pag galang ay para sa lahat at ang pag iinsulto ng kapwa ay walang puwang sa senado.

    From Day 1 of the Impeachment trial, I have a bad feeling that the House prosecution team is fighting an uphill battle against a well rooted, well entrenched group of corrupt and immoral people who still hold huge resources and residual power within the government and are taking the last stand  against the Clean Government Movement of President Aquino.

    The House prosecution is fighting in the front of the battle but the enemies are protected by the old remnants of the previous administration and its party members who are scattered within the Congress and the Supreme Court. Nevertheless, the courageous prosecution team under the leadership of Congressman Tupas shall be highly commented for their fearless effort in bringing to open the evidences of the Article II Violation.

    There will be hope for the Philippines if the roadblock of the anti-corruption movement were removed from the offices. However, it is not a surprise if the Senate Impeachment Court dismissed the case.

    What follows the dismissal is something we really have to be watchful. It could be the turning point of the history of our country. And those who still are not awaken shall pay dearly.

    i enjoyed watching the drama as it unfolds on our TV screens. both are at fault in what happened yesterday. first is sen.santiago, her conduct yesterday was unbecoming of a senator-judge. why use such words even if you’re frustrated in front of the nation? why was she allowed to do that in the first place? even if she’s a strict judge and was always lecturing lawyers in her courtroom i think what she did was a bit out of bounds already. it would be fine to say those things if the trial is not being broadcasted. she is already stepping on the dignity of the prosecutors. also atty. aguirre is at fault too. what he did was really disrespectful. he should have asked permission to leave if he doesn’t like to listen to her.

    i think what happened yesterday was an emotional outburst on the part of the private prosecutor. he might not be able to take in what was being said and being reduced as incompetent lawyers in front of the nation and maybe the world.

    here are the twists of the impeachment trial – 
    (1) many wants CJ Corona out but we cannot dislike the defense cousel for his wisdom and charm. In contrast to Atty Cuevas, the prosecution panel had erred many times all throughout the trial. 
    (2) many dislike Sen. Miriam (or at least the way she delivers her line) but most of the time, she makes sense.

    Thanks to Senate President Enrile…a “trapo” no more.

      Just a question, how many Fil do you know who ascended to such position in ICC? NONE!

      If she makes a good impression there, the Fil will benefit from it. IF she doesn’t , it will reflect on her and the Fil people. Like what Mr Tupas said, all for one – one for all.

      But until then, it will be safe to say that she did made lots of hard work why she deserve to be a judge in ICC. 

      How about you, are you an embarrassment of the country or another ‘unwanted’ citizen or a citizen that will make the Phil proud?

      Nakita ko si Atty. Agueri nagtakip nang tenga nang mag simulang mang alipusta si senadora sa prosecution, sobra talaga siya everytime mag salita akala mo nakikipag away lagi. Very un proffesional, tenotolerate naman nang presiding officer. Kung nananood ako sa internet pina fast forward ko rin pag se Miriam na ang nag sasalita,nakakasira sa grupo nang mga senado parang siya ang may ari nang impeachment trial, siya walang limit na 2 minutes compared to the other senator. Nakakawalang gana nang manood.

    If aguire is stranded in an island with only miriam as companion, it wouldn’t take long for the hapless guy to find a gun, point it to his temple and without an ounce of regret, squeeze the trigger. That way, miriam can go ballistic by herself. 

    Placing Aguire in a room in front of a television set playing the videotape of one of Miriam’s privilege speeches as a form of punishment is inhumane. I believe the guy would prefer to be locked up if given a choice.

    Why would she need to lecture the prosecution and calling them names? Is she trying to portray to the audience that she is helping the prosecution by pointing out their shortcomings? Does her lectures and tirades been helpful to the impeachment court to find out the truth, to ferret out justice? or is he just trying to impress us over and over again of her eloquence, knowledge of the law and unbridled arrogance?

    Miriam will not decide on the merits of the case. She’ll just blame the prosecution when she casts her vote to acquit. That’s what her gameplan is all along and we are all just taken for a loud, noisy ride.

    abroad,  we demand for ICC urgent review ( or re-call) 
    of her appointment. The senator even concealed the circumstances on the suicide
    of her son/daughter ( ?), her unexplained wealth, her health, her attitude
    toward this on-going impeachment trial, political inclination  etc.

    ICC should investigate that cases prior to her appointment.

    I support the removal of the chief justice but I also acknowledge that Sen. Santiago makes sense. She has an opinion and whether it is acceptable or not, people in the court need to listen.

    I pity private prosecutor Vitaliano Aguirre because he will now have a reputation of being a selective listener and ‘arrogant’ lawyer. Regardless, of how and what the judge say in the court, it is his/her prerogative. He can demand a clarification later or even manifestation from the judge (like what Ferinas did). But the next time, he will enter a courtroom, judges will now be ‘alerted’ of his presence. In short, not good for business for him or whatever law firm he belongs to. 

    Aguirre served as the lead counsel for Hubert Webb’s defense team. Webb was found guilty in the controversial Vizconde massacre.

    He served as legal counsel for now Supreme Court Chief Justice Bienvenido Reyes in an administrative investigation over a GSIS vs Meralco case.

    According to his profile provided by the prosecution, Aguirre was also a legal counsel for Senator Panfilo Lacson and Vice Mayor Rodrigo Duterte of Davao City.

    Aguirre, 65, graduated valedictorian at San Beda College. He passed the 1971 bar examinations with a rating of 85.25 percent.

    Aguirre was a managing partner for Aguirre Cacho & Tuazon Law Firm, Acosta Aguirre & Fernandez Law Firm, Ricafrente Aguirre Sanvicente & Cacho Law Firm, and Robles Ricafrente Nachura & Aguirre Law Firm.

    1. The defense said in a presscon that the Senators were bribed P100M ea. 
    2. The SC issued a TRO subverting the Senate authority over the impeachment.
    3. The defense filed a motion to quash the ongoing impeachment.

    The impeachment court has been too hostile to the prosecution.

If you want people to respect you, you ought to be respectful. She may be intelligent but she does not have that as a monopoly.     siguro gusto niya pumapel since they rested their case and he didn’t had a chance para magpa-cute. he should have known better to act like that in front of television watched by the entire nation, probably by even some in the world.  and to do it inside the senate halls, is just stupid. again is he even a lawyer?

    there’s no excuse for this act, as proven by the unanimous decision to cite him for contempt.

    you can say all you want, the fact of the matter is, senators have the right and privelege to say whatever they want while in session, something that is a privilege and is even guaranteed and protected by the constitution. they are immune to any slander or libel. so this antics by aguirre, is plain ignorance on his part, is he even a lawyer?

    senators were voted by millions, so for someone of a non-factor lawyer in the prosecution to do that is a very grave disrespect. a serious one that he would regret for the rest of his life.

    While I do not agree with the Sen. Miriam’s name-calling and manner in delivering her remarks, I still believe that she has a valid point.

    The prosecution is indeed resorting to extra-legal tactics to try CJ Corona by publicity and mislead the impeachment court with the number of witnesses, articles, and evidence they have.

    While the prosecution is made of the best lawyers that pork barrel can buy, they are ultimately just an inutile bunch of greedy politicians.

    Its kinda sad when I read comments saying what Atty. Aguirre did was disrespectful and deserves the mouthful that he got from Senator Miriam. I’m glad he stood up, both for the health of his ears and against the feisty Senator who has repeatedly put down the prosecution with her equally sharp, disrespecting tongue. 

    We seem to forget that we are fighting for some part of our soul as a nation and as Filipinos who deserve better Supreme Court Justices who help rather than hinder. In what universe does “Net Worth” mean declaring 2 million pesos for a Fort Condo when you paid for 9M for it and the developer has official BIR receipts and a deed of sale for it? 

    For all his Harvard education, he can’t do math. Corona needs to go. Miriam, open your eyes instead.

    What meriam did during the trial was very uncivilized if not barbaric. She was talking as if she is addressing to robots. I thought she has studied theology at Maryhill Seminary. Did’nt she realized that the one she is scolding are PEOPLE? A people with feelings. Meriam it’s better for you to wake up!! You are a very bright woman but you put all your legal knowledge solely in your head. I think you yourself is more of a WHAAH than the prosecutors you are scolding. I thanks very much atty. Aguirre for what he did. What he did was very consoling. It was a strong reminder of meriam that there are feelings who are affected for what she did.

    I salute Atty. Aguirre. It is not uncommon for a judge to castigate lawyers. What is uncommon is the disrespectful and obviously unbecoming language of the Senator. Somebody must be brave enough to stand up to her. The Senator presents herself as all-knowing while the rest are stupid. This has always been her behavior even outside the Senate. (She once berated a journalist who asked her about her grade in the Bar exams.)
    At the beginning of the trial, Santiago said that the court should not block the truth, adding that she has learned her lessons from the Estrada impeachment. But what made her change mind? There is more here than just her sanity.

With that decision to site aguirre court contempt, it was a strong reminder to lawyers that the impeachment court is a sacred venue for people who are seeking justice.     I am betting the reason Ms. Miriam Defensor Santiago continued berating and describing members of the prosecution team as incompetent is, she is attempting to condition the minds of the Filipino people why she voted acquittal for Renato C. Corona.  She will vote for his acquittal not because she does not find his dishonesty over his fraudulent S A L N’s nor not disclosing his money in the banks highly immoral.  She will acquit him because the prosecutors were incompetent.  Not every Filipino can be fooled Madam Santiago.

        no one bragged na magaling ang mga prosecutors, but the case isn’t the grading standards of these lawyers, it is about the moral fitness of the CJ to still continue in office or not, and if this only, the prosecution has proven that the CJ failed. only those in denial keep on diverting the issue on  the prosecutors weakness.

With due respect to our lawyers (at least respectful ako ha, hindi ako contemptous), I studied in Japan as a scholar on quality management, and they have very very high regard to their scientists and engineers, even much much higher than their lawyers and politicians. They even have this very prestigious Deming Award for individuals and companies who excel in the field of quality management.
      I believe it is because of their culture which gives primacy on quality, honor, science,  pursuit of excellence and respect for humanity. These values were all inculcated in our reading materials throughout my studies and validated when I observed and interacted with them in factories, schools and communities.Sad to say, dito sa atin ibang iba talaga. At nakakalunglot talaga isipin.
      Pero sa tingin ko meron pa naman siguro tayong pag-asa.

    The prosecutors conditions the mind of the viewers by presenting their evidence somewhat illegally obtained but the figures are not void of reality of which the bank officials is in difficulty of denying.  The defense is conditioning the mind of the viewers that they have a very competent chief defense council and majority agrees.  The Senator Judges also is conditioning the minds of the viewers that the respondent might be acquitted due to the shortcomings of the prosecutors.  So everyone ends conditioning the minds of the viewers.  In conclusion, really the media is a very effective tool in conditioning the minds of the viewers.  But, are the viewers of today still immature?  Let’s find out.  Abangan ang susunod na kabanata!

    i think sen miriam is just right, if one had watch a regular trial court
    hearing, there are some judges who lecture and castigate counsels if
    they are not performing it right, in the case at bar, definitely, the
    prosecution is bluffing with all their articles of impeachment, hence,
    sen judge miriam is with her outburst, d po senate lang un, Impeachment Court, we are removing a Chief Justice, eh kung puro fruit of poisonous tree ang evidence, no matter how true eh magiging inadmissible … the prosecution might not even have any
    evidence at all, kaya po may Batas tau na sinusunod, kuro kuro lamang po, peace

    Verbal abuse, insult, belittlement and personal attacks should have no place in a courtroom where supposedly honorable men and women reside. 

    No adjective or word has been coined yet to describe Miriam’s, if I may use one, foulest-of-the foul-mouthed persona. It is so mind infectious and powerful that once subjected to it one could be driven into a “dangerous” challenge of his own gentleness and sanity.

    Times have really changed some people for the worse.There is ought to be an “anti-Miriam behaviour” law.

    Yesterday was the best performance of Santiago living up to her name as BRENDA! BUANG na talaga! Si Estrada naman umepal rin akala niya parang pelikula lang, kung makatanong at makasalita action star ang dating. Nagrereklamo na binastos ang Senado..Buksan kaya nila ang mata nila at makinig ng mabuti..Si Santiago ang walang ginawa kundi mang-BASTOS sa duration ng impeachment case! Nag-mura pa..ang problema kasi sa kay Santiago di niya muna tinitingnan ang sarili niya. Nung sinasagot siya ni Aguirre TAMEME din siya at parang humihingi ng tulong sa kapwa senador niya. Si Enrile naman presiding officer hindi man lang sinsita si Santiago..Para sa akin tama lang yung nangyari, Santiago just got a taste of her own medicine. WAH!

    With over 2 millions pesos spent everyday by our government from our own taxes just for this impeachment, all lawyers who wasted the time of the court should not only be condemned but must be disbarred.    

    That money could have saved lives of children in government hospitals like PGH who died simply because they are poor.

    I will smack the heads of these two clowns (Aguirre and Santiago) for disrespecting their oaths and duties as a lawyer and a judge. More so to the latter who is acting as a judge.

    What she did was disdainful and condescending, and I’m sorry for Aguirre, he should have maintain his professional composure despite Miriam’s tantrum, it comes with the job. You cannot repay evil with evil, nothing good will come out. 

    You cannot demand respect from somebody who blindly see’s it one way for she cannot give away what she perceive doesn’t have.  Wait… the impeachment court see’s it one way too. They can be undignified and uncourteous to you, but you just cannot do it the other way. And they make that perfectly clear.

    Is this the kind of an attorney our youth would emulate? I thought trial lawyers have a sworn oath never to confront a judge and maintain their dignity under whatever extreme pressure the court exert on them?

    I would prefer seeing Cong. Tupaz with his dog sneer while Sen.Santiago is talking but I do not expect this form of disrespect from a learned and supposedly noble attorney.

    But looking at what happened a little bit deeper, I am curious to ask, is this an initial ploy of the prosecution towards a “walk out?”

        I believe all those berating and sermons could have been avoided, if the prosecution came to the court prepared.

        Sir, put yourself in the shoes of a judge, here comes a prosecutor with poorly drafted allegations but because you are so mabait you allow it be presented.

        And every time he attended the trial, he uses you in his fishing expedition to gather evidences and witnesses to support his allegations. Would you shower this prosecutor with praises?

        Sir, my observation of the unfolding events during the impeachment trial, reminds me of a classic classroom scenario where a student comes to class with ill prepared assignments, and the temerity in asking his teacher to do the assignment for him. Then blamed the teacher for the sermons he got and the failing grades he received.

        Sir, with regard to the actuation of Sen.Santiago [I do not know her personally and I am not one of her fans], I believe it is within her prerogatives as a senator-judge to do what she is doing. And I think, she has done the same thing during her days as a trial judge and professor. And maybe these attributes are what interest the International Criminal Court to elect her as one of its judges.

Using bulgar words during her manifestation, scolding, shouting and insulting the prosecution is a shame to the impeachment court…how can this senate judges just ignore this kind of behavior by this Miriam? The presiding judge Enrile should blow his whistle and tell this woman to behave and talk like an educated professional manner….she is acting like she is lecturing kids in the high school….Waaaah!!!!!!! Sa halip na mga aboga#o ang iluklok natin bilang mga namumuno napapanahon na upang tayoy maghalal ng mga engineers,inventors,scientist at mga technical people. Tignan natin ang kaso ng China kung saan ang mga naging at kasalukuyang pinuno ng kanilang bansa ay pawang mga nagtapos ng mga engineering courses na syang kabaligtaran sa ating bansa na halos lahat mga abogado ang namumuno at nakaluklok sa mga sangay ng gobyerno kasama na dyan ang mga politiko. Makikita naman na ang China sa ngayon ay nangunguna ng bansa lalo na sa larangan ng ekonomiya. Para naman tayo ay makaagapay sa pag unlad kailangan na natin alisin sa ating kultura ang pagiging mapag mayabang at pagka ipokrito.

Other Asian countries, not only China, have lower numbers of lawyers relative to their populations, as compared to the Philippines, and have had higher economic growth. At least one international study shows that the number of lawyers per capita is negatively correlated with economic growth (i.e., the more lawyers a country has, the lower its economic growth).

      If we want our country to accelerate the growth of our economy, we need to encourage our young people to avoid law and instead study math, science and engineering. It is time to glamorize these fields of study and deglamorize law.

      yes that’s true, when I was in college way back 1964 I have a lot of Thailand & Chinese ( from mainland China ) classmates who took engineering & agricultural courses. They applied what they learned from us & look at them now. Thailand is no. 1  on their rice exports ( they learned these technology from Los Banos ) and with China, Korea, Japan they concentrated on technology. We are way way far behind from them although we have all the resources & brilliant minds. The main reason for this is because corruption is so rampant in our gov’t, sad to say from barangay tanod to the president. In order to survive in the Philippines you have to go abroad & sacrifice family ties. Why can’t our politicians see this, wala na bang talagang pagasa ang Pilipinas ?

    In fairness to Miriam, she knows the law, and she has been a trial judge for a long time, any lawyer here would know that if they come to court unprepared they will likely get a dressing down from the judge.  The Prosecutors were behaving like monkeys in mimic to their Master Imp in Malcanang. They deserved it. Kudos to Miriam.

    I would like to congratulate the Philippine Daily Inquirer for publishing in its front page the photos of Senator Santiago and Atty. Vitaliano Aguirre III. The photo should garner the “Photo of the Year Award.” No words in the English language can describe the photo and do it justice.

    A futile attempt to describe it would be -“The photo depicts a man who has had enough of the mouth but rather than stoop to her level, simply smiles and covers his ears. This way he retains his dignity and makes a very strong point.”

    Kudos to the Philippine Daily Inquirer who always calls a spade a spade within the bounds of decency and the law!

      On the contrary, if you will watch the video again, Enrile was chuckling when Brenda was saying the gag0 word. This IC can be compared to the olden times Jews who were jeering and cheering when the half naked Jesus was being made to walk and bear the weight of the cross till He reached Mt Calvary. Such a fraternal display of arrogance, bigotry and self-centeredness from this supposedly honorable people from the august halls of the Senate.     I totally agree with Atty Aquirre; even defense Cuevas
    sympathizes Atty Aguirre and prosecution. It is true that this lady of
    Iloilo is brilliant when it comes to legal terms considering a former
    judge as well. This is her normal diet everyday.
    However, the manner she delivered her dissenting opinion ;) to the
    prosecution is not acceptable sa MADLANG PIPOL. The delivery, gesture,
    shrilling voice that caused her BP shoot up, that caused an attorney to
    close his ears, that caused the bulb in the senate room busted are
    disgusting in the ears of the public! It
    will be acceptable if she talked like Sen Joker Arroyo even he is not
    also chided with prosecution but then again Sen Arroyo talked calmly.
    Her ballistic character and unstoppable BRATATAT! will surely subject
    to CHARACTER ASSASINATION, she knews that. If she will not change her approach she will be twitted negatively.
    Now, she is into ICC for sure she can not apply what she is doing now
    in the Impeachment Court or else she will be in danger there. ICC is an
    international court that attending cases for prominent individual i.e.
    powerful person or group. She is doing this manner only to the
    Philippine Court, i remember she even spoken like “you pilipino!” like
    she is not a Pilipino. Well, there was a joke, a foreinjer asking 3
    Visayan citizens “Are you Pilipino?”, Waray said “YES! i am a Filipino”,

    The very thing that I really didn’t like in this entire episode when I saw and heard everything live on national television was Hon. Sen. Miriam Santiago’s use of foul language or profanity.  
    What is even more appalling and really revolting are the comments of people justifying and supporting such use of gutter language.The use of profane language for whatever its rationale can never be justified. It is the language of the devil and it destroys people rather than correcting them.No wonder Jesus himself reserved the highest possible condemnation for people who insults others with the use of the term “G – – 0″,  the very word that Hon. Sen. Miriam Santiago used. You can see that in Matthew 5:22. In that verse, according to Jesus, those who resort to this kind of profanity are liable to be burn in “impiern0.”

    The inside story

    Calling our distinguished Congressman ga go openly on a nationally televised live TV does not fit well with our culture. 

    I had been to slum areas, fish markets and other areas of lower class community but never seen or heard a lady calling ga go to a group of men.

    Here comes a soon to be international judge in robes without any shame, openly calling names and piercing the ears of the viewing public with no regard to human dignity.

    She made such scenes during Erap impeachment.  She even said she would jump off from a plane. Few years after her son commit suicide, no one knows the real reason but everyone thought she would change and reform for the good. Unfortunately it got worse. 

    If she can be such terror in public what would be the case at home? Oh my waaahhh…

    Manong Johnny lost the trust of the people yesterday when he kept laughing uncontrollably without saying a word to the lady to mind her language. She started the tirade as usual and went on ballistic. She was really upset the Prosecution rest their case for the reason she wont get the chance again to persecute the prosecution and free airtime exposure.

    All those critical of the cutting short of the trial was after of free TV exposure for their political gain. The Filipino people are wiser than them, they chose this opportunity to identify those crook politicians who are against TRUTH and fighting corruption. It is their political suicide. Remember all those who stayed with Gloria lost terribly in the subsequent elections?

    Our Counrty need to be FREED FROM THE CLUTCHES OF CORRUPTION from Barangay level upto the Judiciary. Can we trust Noynoy? Yes. I am sure he got the will to make the real  change. No corruption allegation ever said of him OR of his family.  Let us all give him our wholehearted support to make the necessary changes so this country can be eradicated from poverty and march towards prosperity and righteousness. 

    Let us keep our partisan politics and affiliations aside for the sake and success of our beloved nation. We have trusted many leaders before but they cheated us, Why don’t we give a chance to our Ninoy and Cory’s (our democracy icons) son a chance to make that filipino dream come true?

    So in the case of this lady senator, wla pong halaga ang inyong pagsisigaw at pangangalandakan ng karunungan kasi po para sa mga karaniwang tao at pilipino, hindi po yan ang nakikita kundi ang inyong pambabastos at walang pakialam na pagyurak po sa pagkatao sa mga taong propesyonal din naman maituturing at may kaalaman na sa palagay ko sigurado ako na may nalalaman din sila na hindi nyo po alam.

      Imagine the burden that Miriam Santiago may be carrying : the death of her son. The circumstances of his death are not very clear. Some allege that it was not a suicide, but that the son tried to intervene in a quarrel between Miriam and her husband , and that Miriam was holding a gun aimed at her husband , and in the ensuing melee, she shot her son accidentally and killed him. Whether or not her son died by his own hand or hers, his death  is the cross she will bear for  the rest of her life. She must be such a miserable, bitter and, angry person, as bitterness and anger is all that comes out of her . I am sure all these negative emotions will literally eat up her insides. For all her appalling behavior towards others , I am sure that the depths of her misery are far greater than ours. That is her punishment.

    Enrile at times, was even amused of Miriam’s tirade of abuse directed to the prosecutors. I can’t wait to see these two senators go away…they bring ruins to the Philippines. 

    Enrile and Mirriam have been in politics for decades now and yet, I have not seen them ever initiated a senate hearing to alleviate poverty  due to corruptions.

    One of the symptoms of hearing loss among old people is the tendency to raise their voice even within an arms length.  This is easily noticed by other people around but not by the person itself.     Miriam should be dismissed from the Senate Court for inappropriate behavior unbecoming to a Senator of the Philippines.  Her tantrums are no longer entertaining and she should be disciplined.  Her parents clearly indulged her as a child and did not correct her bad behavior.

    Her husband should also be nominated for Sainthood, or hospitalized for stupidity and deafness..

    MANILA, Philippines — President  Benigno Aquino III bared on Thursday
    what he called a plot to oust him for being the biggest stumbling block
    to the return of “the old system” of graft and corruption.

    I think it is a good and valid reason for President Aquino to proclaim Emergency Rule now. I am sure there are many in the Senate who prefer to have old system so they can suck more. In fact, the way they treat the House prosecutors speaks it all.

      Well, to be fair to the vile creature, the noble volunteer lawyer did try and KILL her with his disrespectful (alleged) “loud sneers”. Hah. Then he sat in front of her! 

      OMG these “dirty tricks” from the “usual suspects”. It says a lot about the Prosecution that it has to stop so low as to try and ASSASSINATE an old lady, with loud(?) sneers and ‘disrespect’ when being disrespected and daring to disagree when an ICC judge is claiming prosecution lawyers NEVER rest their cases after having proved a thing beyond all doubt. 

      Clearly he must be INSANE and trying to force her to rule in favour of the defence; which hasn’t made any arguments in response to the evidence. It’s the only possible explanation for such DISRESPECT of her corruption!

    Making him listen to Brenda’s speach for hours as punishment constitute “CRUEL AND UNUSUAL PUNISHMENT”. It is defined as punishment as would amount to torture or barbarity, any cruel and degrading punishment not known to the common law. It is prohibited by law in the states, I don’t know in the Philippines. Aguirre should be put on suicide watch as I don’t see him making it for a couple of hours without hurting himself.

    I ‘ve watched all the hearings. Enrile and the other judges strongly tend to be liberal to Cuevs ( Enrile’s lawyer at one time). The ugly cuevas exploited and abused that liberality. In fact, the defense team members who were present during their controversial conference attacking both the Legislature and the Executive, should have been cited for contempt.

    That is more contemptuous than what the prosecution lawyer did. MIRRIAM is not a respectable person much more a judge and senator. She is sick, isn’t she? She must go on
    Leave.

    Senator Santiago should go back to the grade school and learn about Good Manners and Right Conduct. This trial is televised. She cannot just scold and embarrass people publicly as if she is in the privacy of her living room.

      although i disagree a little to her demeanor, she is somehow right for the prosecutions had a different purpose at the onset of the impeachment. tupaz et al wanted to shame the CJ such that they came to the court with ill prepared complaints, thinking that he would just resign. and i learned that she has been that way since her judging years as a trial judge.

    As a foreigner visiting the Philippines, may I just point out how embarrassing this sort of thing is for the Philippines? 

    This corrupt imbecile should be the laughing-stock of the nation for her attempts to distract from the case; which seems – quite plainly – to be going horribly bad for the Defence. Which is expected, I guess; when you refuse to mount a Defence against charges. Or is this vile behaviour supposed to be Corona’s ‘defence’ argument? If I was a citizen of the Philippines, I would be so embarrassed I would be livid with fury. 

    No offence, but then I think the Philippines has been offended enough by this Senator’s insults. Time to clean house, and get some respect back; don’t you agree?
