Ex-NBI chief saw kidnap victim, says DOJ

Magtanggol Gatdula, then National Bureau of Investigation director, checked on undocumented alien Noriyo Ohara a few hours after she was abducted in Pangasinan by unauthorized NBI agents on Oct. 29, 2010, according to a report of a Department of Justice fact-finding panel headed by Undersecretary Francisco Baraan III.

The report said the kidnapping was hatched right inside the NBI main office in Manila and that Gatdula had participated in the planning and cover-up.

President Benigno Aquino III recently dismissed Gatdula for failing to turn over Ohara, a Japanese, to the Bureau of Immigration (BI). He said he had lost trust in Gatdula.

The Baraan panel said NBI officials and agents held Ohara without charge and collected P6 million out of the P15 million they had demanded from the Marzan family, who were threatened with criminal charges for harboring an illegal alien. The haggling for the ransom took place in the NBI office.

Before Inquirer columnist Ramon Tulfo’s exposé on December 3 last year, Ohara was kept in various NBI offices and safe houses, and accompanied by Chona Esplana. In one of her appearances before the panel, Esplana claimed to be a confidential agent of the NBI but was later found to be lying.

Gatdula said he heard about the Ohara case on November 15 from NBI Deputy Director Reynaldo Esmeralda, who was asked by Tulfo about Ohara’s plight.

However, Ohara testified before the panel that Gatdula had gone to the office of special investigator Mario Garcia, chief of the NBI-Security Management Division (SMD), where she was brought by NBI agents who forcibly took her from the house of the Marzan family at around 8 a.m. on October 29.

A picture of Gatdula hanging on the wall of Garcia’s office helped Ohara identify the NBI chief. “Director Gatdula came in the room and looked at me. He talked to Garcia for a short time then he left. I recognized him because he has a picture in Garcia’s office,” Ohara was quoted as saying in the report.

The Marzan patriarch, Romulo, who was also brought to the SMD by the NBI agents, said Gatdula dropped by on the afternoon of October 29. He said Esplana, who was with the team that participated in the Bugallon operation, had identified Gatdula for him.

“When the man left, Chona told him (Romulo) that the man was no less than the NBI director himself, who had to go down from his office as Ohara’s case was a very important one,” the report said.

Romulo’s daughters—Jacqueline and Glenda—also identified Gatdula through the office picture.

Garcia, who led the operation to “rescue” Ohara, confirmed that Gatdula had gone to the SMD between 5 and 6 p.m. to look at Ohara. “OK, help her with what she needs,” Garcia quoted Gatdula as saying.

Gatdula admitted to the panel that he went to the SMD office as part of his “routine inspection” but he said he did not remember meeting or even noticing Ohara.

The panel noted that Garcia did not have any authority to order an operation. He said he formed the NBI team to “rescue” Ohara after someone brought him a letter from her, written in Nihongo, asking for help because she was allegedly being abused by the Marzans.

The letter turned out to be Ohara’s request for help about her properties. Moreover, Ohara and the panel’s star witness, Garcia’s executive officer Jose Odelon Cabillan, claimed that she was made to write it much later as part of the cover-up.

Through Cabillan, who led the operation in Bugallon, the panel was able to learn about Virgelito Gutierrez, alias Labsky, a lackey of Gatdula back in the director’s days as a Quezon City policeman.

Cabillan said that in the first week of October, Gutierrez relayed to him that an informant, Jun Perez, also known as Rolando, had told him that a rich Japanese woman—Ohara—was living with the Marzans in Pangasinan and might be a target of kidnappers.

“The informant allegedly revealed that if the NBI would be able to get the Japanese woman, the Marzans would cough up money to settle with them. Labsky told him that the information was also relayed to Garcia and Gatdula,” the report said.

On their way back to Manila, Cabillan said that he overheard Gutierrez speaking to Gatdula and that the NBI director “appeared to be monitoring [our] return.”

Cabillan also confirmed that Gatdula had gone to the SMD office on the same day to check on Ohara and that the director even said, “Document her.”

Motive, inheritance

The Baraan panel was able to establish a motive behind the abduction. Its report quoted Chief Consul Keiki Endo of the Japanese Embassy as saying that Ohara’s father had left her a huge inheritance and that the creditors of her father and the Japanese government, wanting to collect inheritance tax, were after her, thus explaining her flight to the Philippines.

Reports that Ohara’s father was killed by the criminal syndicate Yakuza appears to be not true, according to the report.

Ohara arrived in Manila in June 2009 and did not pass through immigration authorities. She bought a house in Las Piñas City which was registered in the name of her friend, Romulo’s sister Rosemarie. Ohara, who had assumed the identity of Marefe Laganas, went to live with the Marzans in Bugallon early last year.

Portions of the agreed ransom money were brought by the Marzans to the NBI in three batches—P1 million, P4 million and another P1 million—which were received by Cabillan and Esplana.

The Marzans claimed the money came from their own pockets. Although Ohara denied that the ransom money came from her, the panel noted that Jacqueline first knew about the abduction from Rosemarie, who is working in Japan. Rosemarie relayed the information about the abduction just an hour after it took place.

The panel also found that Garcia had given his personal bank account number to Ohara to be sent to her contact, probably Rosemarie.

Cabillan said that after the second installment (P4 million) of the ransom was delivered, he heard Garcia saying that he would take care of his “boss”—referring to assistant director Medardo de Lemos.

Cabillan also recounted how on December 8, Gatdula called him to the NBI library where he was meeting several people—Gatdula’s chief of staff Anthony Endrendal, spokesperson Boy Zamora, public information chief Alex Carbonel, Elizaldo Beltran of internal affairs, Garcia and Gutierrez.

During the meeting, Cabillan said Gatdula told him: “Someone has to sacrifice. Someone has to admit guilt. We must do damage control so that this will stop,” Gatdula said, to which Garcia replied, “OK Sir, I will take full responsibility.”

      So it follows, that NBI Gatdula has a networks of kidnappers within the organization. Akala niya hindi siya matanggal dahil manok siya ng Iglesia ni Cristo. Iyon kasi ang gusto ng Iglesia, kung hindi magbigay sa kanila ang DOJ secretary, they go for the NBI. Let’s watch baka Iglesia ni Cristo pa rin ang ipalit.

      They should all go to jail, pay 6 million back  to the victim, investigated for other illegal actions including not returning library book and barred from holding any government position including trash collector or dog catcher. For every illegal actions charged and proven in court, they should be fined 1/3 of their net worth. Leave their family barely enough to live poorly. Maybe they can get rich again legally next time, by earning it honestly.

        I concur with you estong… the culture of impunity and unprofessionalism started with the Marcos years…  that is one bad legacy that hasnt been discussed at length before… But it is very true,  true then and it is still true to this day…hence the state of our Law Enforcement everywhere – mostly PMAers – in part and in whole  –  is wrapped in a culture of corruption… Most Marcos loyalists do not see this though… But look at the after-effects,  decades since the Dictator has gone.   So sad….

    Who can we trust if even the premier national investigative agency can’t be trusted acting more like a fox guarding the chicken coop…… What a shame, I don’t think a simple leadership change will improve the sorry state of this agency. Perhaps a thorough revamp all the way down the janitor level should be instituted to regain the integrity they once enjoyed.

    Kung totoong Iglesia itong si Gatdula, ibig sabihin pareho silang Iglesia ni Cuevas na defender ni Corona? Sayang lang ang pagtatakip mo Gatdula kay Lacson noong wanted pa siya, akala ko pa naman malakas ang kapit mo sa itaas, may malakas pa pala sa iyo, yung papalit sa upuan mo.     It is very sad that our enforcement institutions (PNP, NBI and Military), have gone to this level.  How do we solve this problem?  I have some suggestions:

    1.  Clean up the institutions.  The government should give early retirement to those who have pending administrative & criminal cases, or with complaints filed by the public.  Proven or otherwise, the mere fact that there are questions about their personalities, is enough ground for early retirement.
    2.  Increase the Salaries & Wages.  A good pay will invite good people into the institutions, and will discourage graft and corruption because they will protect their good paying jobs.
    3.  Transparency.  Make the activities of the institutions transparent to the public (except confidential police  matters and military engagements).  Transparency is a deterrent to graft and corruption.
    4.  Strict disciplinary action.  Apply the rules and regulations of the institutions equally without any favor.  Let the axe fall to where it should.

    As a taxpayer , I supposed it is FAIR enough to SACKING Gatdula…He is the head of the Agency and this agency REFLECTS, SAY a lot of JUSTICE among us the peoples…But how can we, WHAT we can expect with this agency who is manned with no CONTROL among peers and then mulcted money to alleged violators?Gatdula should and must move on…He should go on RETREAT and seek DEVINE guidance…For the more he is saving himself granting media interviews, the more he is digging a FOUL smell of himself?

    General Gatdula’s career as a policeman was above board. This guy deserves the benefit of a doubt  if for that only. He’s got no previous record of any wrongdoing it is possible that someone interested in his position could be behind all this. A full no holds barred investigation is in order.

    Its good that Gatdula got busted for his misdeeds this early, otherwise, he would definitely tarnish the name of the NBI even further, to the detriment of the public he is supposed to be serving.

    What’s wrong with our lawyer-publc servants? Has it became a rule that they should use their knowledge to amass wealth for their families first and reneged on their oath of office?

This agency shall be known as ” BUREAU  OF ENTRAPMENT OPERATION “. This new agency will receive complaints from common citizens being victimized by top ranking officers and officials of various government agencies including the PNP, NBI, Ombudsman, AFP etc. Then, entrapment operation shall be conducted to trap and arrest the extortionists. And file charges in court . . .

      If Gatdula is indeed a member of INC, he won’t be allowed by his church to run for public office.  The late NBI Director Wycoco was also a member and wanted to run but was not allowed by the church.

    The story appears to be a well written script.  Assuming that Gatdula was involved in the said kidnap-extortion case, but why did he order “no take policy” meaning he did not received tongs from gambling lords?  If he really wanted to make money, the weekly or monthly payola from syndicates were a lot more than this kidnapping case.

    Tourists shunned away from Philippines, because our government officers has become bold to the extent of extorting/kidnapping even from foreign tourists and this is something not new.

    Foreigners has lost their trust on our men in uniformed who are supposed to be law protector.
    A foreign offical once said Philippines is so rich in natural resources and has so much potential but she needs to remove/replace many of her government officers, cos its only in Philippines where you can find too many rotten apples in the barrel whereby it supposed to be only few rotten apples in the barrel.

    Pnoy has just officially declared war on INC with the recent sacking of Gatdula.  Pnoy should beware of INC whose behind the scene maneuver is well known.  Sources say the current Executive Edwardo Manalo is different from his late father Erdy Manalo.  The elder Manalo was more patient and calmer.  This new INC leader was reported to be impulsive when he was younger.  In fact, he allowed his members to participate in that violent Edsa Tres.  Lately, his decisions were inconsistent and far different from his father.  If his father was still around, INC would have supported Erap who might have even defeated Pnoy.  The unsuccessful impeachment on GMA was due to INC’s influence on the Congress.

    I don’t think that the dismissal of Magtanggol Gatdula from his NBI post is a political Vendetta of PNoy against the cult of Iglesia Ni Cristo. It is obvious that INC is behind Gloria Arroyo and her cohorts since INC lawyers are defending Arroyo, Merceditas Gutierrez and Renato Corona. The case filed against Gatdula was brought by Gatdula to himself alone. Kidnapping and extortion are both serious matters and cannot be simply made up politically. The criminal charges against the INC member Gatdula occurred even before the Corona impeachment. The clear involvement, testimonies and evidences against Magtanggol Gatdula of kidnapping and extortion cannot be made overnight. Of course, INC members and administration was obviously hurt by this total embarrassment made by their co-INC member Gatdula. The criminal intent is clear. 

    Watch your back President Noynoy Aquino. The cult of Iglesia Ni Cristo was humiliated and they simply cannot ignore this kind of embarrassment. Historically, INC joined EDSA 3 in protest against the Philippine government. INC members were hurt and died in EDSA 3. The cult of Iglesia Ni Cristo is using the doctrine of the Manalo family for different kind of motives; politically, personally and wickedly.

      It’s a political vendetta against INC.  Please take note that Cuevas represented both Merci Gutierrez and Corona, Pnoy’s enemies.  Another INC member Atty. Ferdinand Topacio is GMA’s legal counsel.  The two lawyers would not represent these controversial clients without INC leadership’s permission.  They might have even been asked by the church to represent Pnoy’s enemies.

    What a shame this report came in the open and transmitted online around the world…

    This is not just kidnapping for ransom or just a criminal activity of men in uniform.

    The integrity of the premier law enforcement agency of the our nation is at stake.

    How can we repair the damage this incident has caused? I have no idea,, I am totally at loss.

    Let us wait and see how DOJ will prosecute this extraordinary case and how our Courts will render justice without fear or favor at the earliest coz justice delayed means justice denied.
    Thank God there is no death penalty now…..

              Maybe the presidents’ strategy is go after those that are big obstacles and that will greatly diminished his success in fighting graft and corruption. It also seems to focused on prosecuting the well known individuals that are symbols of the culture of impunity in their particular fields ie. Palparan & Garcia in military, Arroyo in the executive, Abalos in COMELEC, CJ Corona in Judiciary and now, Gatdula in law enforcement. I surely hope that the president keeps going down the food chain down to at least middle management level in prosecuting these corrupt criminals in the government. And after that, he should focus on the unscrupulous  companies on the private sector that steals from the government infra-structure projects that they were entrusted to complete.

    On the basis of Ohara’s testimony, Gatdula and associates should be arrested now. They might go into hiding. Let them justify themselves in the court.

    No kid gloves treatment for them. Otherwise Pnoy and Leila will be dragged down by public opinion.

    Not only termination from service but criminal prosecution as well considering the damage they have done to NBI, tourism industry, and the country.

    I’m sure the international community is keenly watching how the administration deals this case.

They said they were agents of the National Bureau of Investigation (NBI) and were arresting him for raping and murdering a woman in Taytay, Rizal province last year. Inocencio said they were mistaken since he came to Manila only in April this year. When he resisted, one of the men drew a pistol and whipped him in the head twice. He was taken to the NBI headquarters bloodied and handcuffed.

    At the office of the Internal Affairs Division (IAD), two witnesses arrived and said the captors got the wrong guy. After knowing his men made a mistake, IAD chief Oscar Embido reportedly asked Inocencio: ‘Iglesia ka ba (Are you a member of the Iglesia ni Cristo)’ When Inocencio said he was a Catholic, Embido allegedly told him to get out of his office immediately. Not a single word of apology came from Embido for Inocencio?s mistaken arrest and bloodied head. Embido, allegedly an untouchable at the NBI because he was recommended by the INC, was former chief of the anti-organized crime division from which he was removed for alleged abusive conduct. Embido and his men are not authorized to make arrests as their duty is only to investigate complaints from the public against NBI agents.

    What a way to end ones career – with a face splattered with ‘mud and dirt’.  To Sec. De Lima and Pres Aquino, please stop appointing retired police generals to the NBI.  It’s better to appoint an insider who has a simple lifestyle and no derogatory information and no pending admin/criminal case than appoint an outsider especially a retired police general.  It is demoralizing on the part of the ‘insiders’.  Besides, there are 90 million other Filipinos to chose from.

      I seldom witness a person of such high authority in the person of Gatdula who’s a General and NBI Chief so emotional and in tears during interview.  He was very hurt.  He might be really innocent.  Did Palparan and other high ranking PNP and AFP officials feel remorse ?

    I like your suggestions except for giving early retirement for those employees with pending administrative & criminal cases, or with complaints filed by the public. They should be suspended with or without  pay depending on the gravity of the charges and complaint. A complete investigation ie. lifestyle check, SALN, and integrity in paying taxes should be conducted. Their passport should be suspended and they should be advised not to leave the country without court ordered approval. If found not guilty, they should be admitted back and paid all salaries and compensation earned during the suspension with a heart felt apology from the government to the individual and his family. And an investigation should be initiated on the entity and/or individual that filed the false charges. The purpose is to file counter charges to recover government expenses and bring justice to those falsely sued. If the employee is found guilty, throw the book on him and make him pay back salaries paid during the suspension, take away any retirement privileges earned, prohibit him from holding any government job and lastly, jail him. IF ill gotten wealth are discovered, it should be confiscated. That should deter others to make the same mistake of abusing their position of power.

(kung mayaman talaga bakit mo hindi na lang bayaran kasi) I wonder kung nasa interpol siya at kung bakit nasa nbi siya. Still, it would be interesting to know how she acquired a Phil. diplomatic passport at sino yung immgration offciial na sumundo sa kniya,planeside pa at hindi na pina-process sa immigration 2009. Anong naging relasyon niya sa Marzans from 2009 to 2011 (matagal tagal din yan). anong nature at bakit nakipagusap (allegedly)si Gatdula sa Japanese embassy  (mukhang hindi kasi gagawin yan ng isang kidnapper).            Maybe the woman is under in the Interpol’s witness protection program. They usually float around different stories and see which one will stick. =)) But complications might have forced her out because of the alleged NBI kidnapping and they cannot quietly extract her out of the country.  It could be the reason why she had easily and unobtrusively able to enter the country and why Gatdula is allegedly talking to the Japanese embassy. Gatdula is a failure as the top dog in the NBI. If he is not involved in the alleged kidnapping, he was still guilty of being clueless on what is going on within the compound of his headquarters. Imagine how much Gatdula’s awareness would be on conditions and situations in the field. The best he can hope for is to admit incompetence and prove that he is not involved in the kidnapping and then fade away and live quietly in retirement.

    Gatdula admitted to the panel that he went to the SMD office as part of his “routine inspection” but he said he did not remember meeting or even noticing Ohara.

    Based on the report, Gatdula is clearly a LIAR! Good riddance!

    I hope this will deter extortion and other crimes by the Philippine authorities against foreigners. Pilipinos abroad are now center of humiliation and ridicule. All because of these S-O-Bs in the Phiippine government headed by a diffident and disorderly President.
